Neb. official won’t be prosecuted in jail dispute

GRAND ISLAND, Neb. (AP) – A jail official in central Nebraska won’t be prosecuted for refusing to take custody of a prisoner.
Hall County assistant corrections director Jimmy Vann’s case was referred to a special prosecutor. The special prosecutor, John Marsh, said in a report also released to the newspaper that refusing to process the prisoner was improper, but “criminal prosecution is not the appropriate response.”
Vann had refused on Feb. 1 to process 32-year-old Jeremie Mitchell into the jail after he was arrested by a Grand Island officer on a bench warrant for missing his trial on a charge of criminal mischief.
Marsh’s report says Vann’s refusal followed a dispute between the officer and jail workers about Mitchell’s handcuffs.
Mitchell eventually was booked into the jail.

Nebraska’s spring turkey season opens Saturday

LINCOLN, Neb. (AP) – The Nebraska Game and Parks Commission says the spring turkey season for shotgun hunters opens Saturday.
That’s a week after it opened for youth shotgun hunters. The archery season for turkey hunters opened in late March.
The turkey seasons all close on May 31.
A spring turkey permit or spring youth turkey permit allows a person to hunt with archery equipment during the archery season and a shotgun during the shotgun season.
Each hunter may have up to three permits. The bag limit is one male or bearded female turkey per permit.
Permits may be bought online at OutdoorNebraska.org.

Nebraska inmate lawsuit bill set for final vote

Sen. Scott Lautenbaugh

LINCOLN, Neb. (AP) – A bill that would limit the number of frivolous lawsuits prisoners can file at public expense is set for a final vote in the Nebraska Legislature.
Lawmakers are scheduled to vote on the bill when they return to the Capitol on Tuesday.
The proposal by Omaha Sen. Scott Lautenbaugh would prohibit prison inmates from filing lawsuits at public expense, once a judge has found that three of their previous claims were frivolous. It would only apply to lawsuits filed after the law has taken effect.
The law includes exceptions if a judge determines that the inmate is in danger of serious bodily injury.
The bill is LB793.

Wembling Mother Nature has farmers wary…

OMAHA, Neb. (AP) – Most Nebraska farmers are still waiting to start planting as the early spring gets a touch of frost.
The U.S. Department of Agriculture says in the weekly crop report on Monday that while conditions were favorable for planting last week, only a limited number of fields were planted with most farmers waiting for the crop insurance initial plant date.
Temperatures averaged 3 degrees above normal in the western half of the state, while the eastern half was up to 10 degrees warmer.
March 2012 was the warmest on record for the central U.S., which could lead to an increased risk for freeze damage – which could happen this week. A freeze warning is issued for central and eastern Nebraska into Tuesday morning. Lows could dip into the upper 20s.

Heineman: No new gambling on old horse races

NE Governor Dave Heineman

LINCOLN, Neb. (AP) – Nebraska Gov. Dave Heineman has vetoed a bill that would allow machine bets on previously run horse races, saying it would create to a new form of gambling.
The Republican governor said Monday that the measure contradicts the spirit of live horse racing that has been approved by Nebraska voters.
Heineman says in his veto message that the bill would expand gambling beyond what the state constitution currently allows. He says that a horse racing exception in the constitution has always been construed to apply only to live races.
The bill’s sponsor, Omaha Sen. Scott Lautenbaugh, has said the measure would save jobs in the struggling horse racing industry.
Lawmakers approved the bill 26-18 – four votes short of the support needed to override Heineman’s veto.

Dozens of cats rescued from Nebraska home

PLATTSMOUTH, Neb. (AP) – Authorities say dozens of cats have been rescued from deplorable conditions in a house in Plattsmouth in eastern Nebraska.
33 cats were seized on Monday. Officials say there were containers full of feces, which also covered walls and a bathtub, and floors were warped because of urine.
Plattsmouth Animal Control officer Sue Baker says the homeowner had 60 cats a few years ago, and had been working with officials to comply with the ordinance. Officials obtained a warrant after learning she was in violation of the ordinance.
Plattsmouth allows two pets per household.
Baker says the homeowner has faced several tragedies in her life and won’t face criminal charges.

Carjacking sends jacker to pokey

GERING, Neb. (AP) – An 18-year-old Gering man has been given five to eight years in prison for his role in the beating and robbery of a man in Scottsbluff.
Dimas Garza was sentenced on Monday. He’d pleaded no contest to aiding and abetting a felony. In exchange for his plea, prosecutors lowered that charge from robbery and dropped three misdemeanor assault charges.
Prosecutors say Garza was one of four men who beat another 18-year-old man and stole his car last October.
Raymond Furrey was placed on probation for his role. Two other accomplices, Antonio Ybarra and Santana Garza, are scheduled to be sentenced later this month.
Furrey, Ybarra and Santana Garza also are 18.
