A man serving a life sentence for kidnapping and sexually assaulting a Scottsbluff girl almost a decade ago is asking a court to vacate his sentence.
48-year-old Henry Delgado filed for post-conviction relief in a Scotts Bluff County court. Post-conviction relief motions are filed after all other appeals have been exhausted.
Delgado was convicted of kidnapping and sexual assault for abducting an 8-year-old Scottsbluff girl after visiting her home in April 2003. The girl’s mother reported her missing, triggering one of the state’s first Amber Alerts.
Police rescued the girl near Gering about three hours after the alert was issued.
In his motion, Delgado says the jury was not allowed to hear some evidence, violating his rights.
