Two members of a Michigan-based militia acquitted last year of plotting to overthrow the U.S. government have filed a federal lawsuit against three FBI agents and a state police trooper.
Michael Meeks of Manchester and Thomas Piatek of Whiting, Ind., say their constitutional rights were violated during raids on their homes in 2010.
The two Hutaree members as well as three members of Meeks’ family filed the lawsuit late last month in U.S. District Court in Detroit.
The plaintiffs are seeking at least $25,000 in damages for each of the suit’s 16 counts.
Both FBI spokesman Simon Shaykhet and Michigan State Police spokeswoman Tiffany Brown said Tuesday they had no comment.
Authorities are deciding whether to charge anyone after police say a 6-year-old was shot in the head by a 4-year-old in New Jersey.
The older boy is in serious condition.
Authorities are still investigating how the younger child obtained the .22-caliber rifle from his family’s Toms River home Monday night.
Police Chief Michael Mastronardy says the children were outside the 4-year-old’s home when the boy went inside, got the rifle and shot the 6-year-old about 15 yards away. It’s not clear if the 4-year-old pulled the trigger or if the rifle accidentally discharged.
The parents of the 4-year-old were home at the time.
No names have been released.
The shooting comes amid debate over gun control laws in the wake of the Connecticut school shooting.
No injuries have been reported in a train derailment in eastern Nebraska’s Dodge County.
Union Pacific Railroad spokesman Mark Davis says 21 cars went off the tracks around 4:45 a.m. Tuesday just west of North Bend. They were part of a train headed from Wisconsin to Wyoming. The train consisted of three locomotives and 138 empty coal cars.
The derailment is blocking both tracks in the area. Davis says he had no estimate for when the tracks would be cleared.
He says the derailment cause is being investigated, but heavy winds are suspected.

The time has come for Nebraska and Creighton to renew acquaintances on the diamond. The two in-state rivals meet for the first time this season tonight at Hawks Field in Lincoln. The Huskers enter the game off of their third straight series win in Big Ten play. That’s the first time they’ve accomplished such a streak in conference play since 2008. But the Bluejays are even hotter, coming in ranked 30th in the latest Collegiate Baseball poll thanks to an 18-6 overall record and a four-game winning streak. The Jays lost two out of three to the Huskers last season, and will look to start this year’s series off on the right foot by starting their ace, Tommy Strunc. Nebraska will counter on the mound with Brandon Pierce. First pitch is set for 6:35. The game will be broadcast statewide on NET.
San Francisco’s AT&T Park continues to be a house of horrors for the Colorado Rockies. They saw their five-game win streak snapped with a 4-2 loss to the Giants in game one of their three game series. Hunter Pence’s three-run homer in the first got the Giants out to the early lead. It would be all the damage permitted by Rockies starter Jorge de la Rosa, who worked six otherwise solid innings, striking out six. The Rockies got one back on Carlos Gonzalez’s third homer of the year in the third, a titanic blow that reached McCovey Cove. Chris Nelson’s RBI single in the sixth made it a one-run game, but the Giants bullpen held firm. Game two of the series is tonight at AT&T Park. Juan Nicasio takes the mound for the Rockies. He’ll be opposed by Tim Lincecum for the Giants. First pitch is set for 9:15.
Restricted free-agent running back Lance Ball signed the one year, $1.323 million dollar tender offer from the Denver Broncos yesterday. Ball has been a part of Denver’s backfield rotation since 2010. Last season he rushed for 158 yards and a touchdown on 42 carries and caught 7 passes for 61 yards and a score. Ball’s salary does not become guaranteed unless he makes the Broncos’ season-opening roster.
(AP) — The sheriff’s department in Denver says a deputy has been arrested on suspicion that he helped a fugitive who left the county jail wearing a deputy’s uniform.
Matthew Andrews is a two-year veteran of the department. He’s accused of assisting the escape, a class-three felony. The 36-year-old was arrested Monday at Denver police headquarters.
Sheriff’s officials say 24-year-old Felix Trujillo was being held in connection with an aggravated robbery when he escaped Sunday night.
Denver police are trying to determine what motive Andrews might have had for helping Trujillo escape.
Sheriff’s officials say Andrews underwent a background check before he was hired.
