William “Smitty” Smith

William John Smith, age 70, of North Platte, NE, passed away on August 15, 2013 with his loving family by his side. He was born January 24, 1943 at Cedar Rapids, Iowa to Phillip and Geraldine (Mitchell) Smith. Bill grew up in Independence, IA and graduated from St. John’s High School in Independence. He started to learn the trade of a meat cutter and later served in the U.S. Army during Vietnam. After his discharge he returned to Iowa and worked at Fareway Stores, Inc. in various communities. Bill moved to North Platte where he owned and operated Smitty’s Fine Meats in 1986. Blessed with a witty humor, he enjoyed people and the many special friendships over the years. He was a member of St. Patrick’s Catholic Church, lifetime member of the VFW, Knights of Columbus, and the Moose Lodge. Survivors include his wife Judy of North Platte, daughters; Lynn (Sherif Abdel-Moemen) Smith of Elmsford, NY and Cary Smith of Denver, CO, brother; Phillip J. Smith of Waterloo, IA, grandchildren, Mariam, Minna, and Jenna Abdel-Moemen, and Elizabeth and Cassie Stambaugh. He was preceded in death by his parents, mother and father-in-law; Clifford and Louise Wills, and his son Christopher Smith. Mass of Christian Burial will be 10:00 am Tuesday, August 20, 2013 at St. Patrick’s Catholic Church in North Platte with the Reverend Neal Hock as celebrant. Rosary will be 7:00 pm Monday at Carpenter Memorial Chapel. Burial will be at Ft. McPherson National Cemetery near Maxwell with military honors. Visitation will be from 3 to 7pm Sunday and 8:30 am to 8pm Monday at Carpenter Memorial Chapel. At Bill’s request, he wanted everyone to wear colorful attire to his service. Online condolences maybe shared at www.carpentermemorial.com. A memorial has been established in his memory.

Nebraska Jobless Rate Rose to 4.2% in July

ne-dept-of-labor(AP) — Nebraska’s preliminary unemployment rate rose in July to hit 4.2 percent.

The Nebraska Labor Department said in a report released Friday that the rate was two-tenths of a point higher than the 4 percent in June and the 4 percent in July 2012.

The national rate dropped two-tenths of a point last month, to 7.4 percent from 7.6 percent in June.

Supreme Court Says BNSF Should Have Deducted Taxes from Alliance Workers Jury Award

bnsf(AP) — The Nebraska Supreme Court says a lower court judge was wrong to order BNSF Railroad to pay the full amount awarded to a former railroad worker by a jury, without deducting federal railroad retirement taxes.

Eddie Heckman, of Alliance, was injured on the job and sued the railroad in 2004. He was awarded $145,000 in 2011. BNSF paid the award, but deducted $6,200 to cover Heckman’s federal railroad retirement tax withholding.

Heckman objected, and a Box Butte County judge ordered BNSF to pay Heckman the $6,200, saying the award was not compensation for lost wages.

On Friday, the state’s high court reversed that ruling, saying that when at least part of a jury award is for lost wages, the whole verdict is considered pay and, therefore, subject to the tax.

Slain Lincoln Man’s Organs Give Life to Others

(AP) — Relatives of a slain Lincoln man find solace when they think of the people helped by his organ donations.

Twenty-year-old Shane Walton died July 2 after being beaten three days earlier.

His grandmother Norma Burgess said she was proud of the good that came from his decision to be an organ donor.

But Burgess says she feels “such a pain in my heart” at his loss.

No arrests have been reported.

Burgess says it scares her that “people with that much rage are walking the streets.”

Landeskog Gets 7-Year Extension from Avalanche

Gabriel-Landeskog-Colorado-DENVER (AP) — The Colorado Avalanche and captain Gabriel Landeskog have agreed on a seven-year contract extension that will keep the young star in Denver through the 2020-21 season.

Landeskog was the second overall selection in the 2011 NHL draft and he won the 2011-12 Calder Memorial Trophy as the league’s top rookie.

Last September, he became the youngest captain in league history at 19 years, 286 days, 11 days younger than Sidney Crosby was when he was named captain of the Pittsburgh Penguins in 2007.

The left winger has collected 31 goals and 38 assists in 118 career games.

After last season, he helped Sweden capture the gold medal at the 2013 IIHF World Championship in Stockholm and Helsinki.

Alliance Man Sentenced to 10-12 Years for Selling Dad’s Farm Equipment

jail(AP) — A 51-year-old Nebraska Panhandle man who sold his father’s farm equipment without permission has been given 10 to 12 years in prison.

Online court records say Kenneth Galinsky, of rural Alliance, was sentenced on Wednesday and given credit for 134 days served. He’d pleaded guilty to theft.

Prosecutors say Galinsky sold $37,500 in farm equipment to an implement dealer earlier this year without the consent of his father, Klaus Galinsky, and kept the money.

Lincoln Man Convicted of Beating Girlfriend with Belt Sues Officials

(AP) — A Lincoln man serving up to 35 years in prison for using a belt to beat his girlfriend and dubbed a “serial abuser” by his trial judge is suing arresting officers, the prosecutor and prison system.

Robert Clayborne pleaded no contest last year to assault and a weapons count. Authorities say he beat his girlfriend with a belt for two hours and threatened her with a knife.

Earlier this week, Clayborne sued in federal court, saying police violated his rights by forcing their way into his home without a warrant and arresting him without reading him his Miranda rights. He also accuses the Lancaster County Attorney’s Office of misconduct and claims the prison has not provided him with medication or mental health services to deal with a bipolar disorder.

Omaha Police Identify Body Found in Open Grave

omahapopo(AP) — Authorities have released the name of a woman whose body was found in an open grave at an Omaha cemetery.

Omaha police identified her as 19-year-old Melissa Rodriguez, of Omaha. Her death is being investigated as a homicide. No arrests have been reported.

Officers were called to Graceland Park Cemetery around 10 a.m. on Thursday to investigate the discovery of the body. The cemetery was closed for the rest of the day, and a scheduled burial at the grave was postponed.

The graveside service was scheduled for 28-year-old Kevin McIntyre, who was shot and killed on Aug. 4. Authorities say they do not believe the McIntyre slaying is connected to the slaying of Rodriguez.

Beatrice Man Convicted of Five Felonies in Gage County

(AP) — A 37-year-old Beatrice man faces sentencing in October after being convicted of several felonies.

Authorities say Gary Kuhn made a plea deal with Gage County prosecutors, who dropped or reduced several charges in two cases. Court records say Kuhn pleaded no contest to four charges and guilty to another on Wednesday. His sentencing is scheduled for Oct. 9.

Records say Kuhn was arrested on Feb. 13 after biting and choking a woman. Children ages 3 and 4 were present but covered their eyes.

The records say Kuhn bonded out of jail and was arrested April 8 after a car crash that ended a police chase. Police say the car had been stolen and that officers suspected Kuhn had been driving while under the influence of drugs.

Nebraska Woman Killed in Collision with Truck

fatal-accident(AP) — Authorities say a 42-year-old Scotia (SOH’-shuh) woman died after her car rammed into a semitrailer in east-central Nebraska.

The Boone County Sheriff’s Office says the accident occurred about 10:15 a.m. Wednesday, about six miles west of St. Edward. The office says Jennifer Markvicka was driving east on Nebraska Highway 56 and didn’t halt at the stop sign controlling the intersection with Nebraska Highway 14. Her car hit the side of the southbound big rig.

She and the truck driver Billy Russell, of Omaha, were taken to Boone County Health Center. Authorities say Markvicka died of her injuries. Russell’s injuries weren’t believed to be life-threatening.
