Mom Charged with Killing Children Asks for Death

gavel-and-scale(AP) — A mother charged with killing her two children has asked a California judge for the death penalty.

Forty-two-year-old Marilyn Edge appeared by video Tuesday in Orange County Superior Court to be arraigned on two counts of murder following her arrest over the weekend.

Judge Craig Robison asked Edge if she wanted her arraignment postponed to Oct. 25, and she twice said she would agree to that if the judge promised her the death penalty.

The judge postponed the arraignment.

A phone call by The Associated Press for comment from Edge’s public defender was not immediately returned.

Edge was involved in a custody dispute and had been ordered to return her son and daughter to their father in Georgia. They were found dead in a Santa Ana hotel room on Saturday.

Pool Hall Loses Fight Against Nebraska Smoking Ban

(AP) — An Omaha pool hall owner has lost his court fight against a statewide smoking ban. But state lawyers are likely to appeal, because the judge found that exceptions to the ban for some businesses are not fair.

Lancaster County District Judge Jodi Nelson ruled Friday against Big John’s Billiards, which also had a pool hall in Lincoln.

Nelson found that Nebraska’s smoking ban is a permissible, legitimate exercise of sovereign power.

But during the course of the case, Nelson also ruled that the ban’s exceptions for cigar bars, tobacco stores and some hotel rooms amounted to special treatment, making them unconstitutional.

The Nebraska Attorney General’s Office says it will appeal that ruling.

U.S. Lottery Players Could See More Giant Jackpots

powerball(AP) — If it seems that giant lottery jackpots have people lining up at convenience stores more frequently, just wait.

Most of the attention has been on Powerball since its rules were changed a couple years ago to boost payoffs. On Wednesday, Powerball’s estimated $400 million jackpot will be the nation’s fifth-largest ever.

Organizers of the country’s other big lottery, Mega Millions, are now also planning changes to increase jackpots.

Mega Millions, which is sold in 43 states, plans to boost the initial jackpot to $15 million. It also will lessen the odds of winning jackpots and make other changes that will result in faster growing prizes to grab the public’s attention.

Nebraska Appeals Order to Return $1 Million to Woman

federal-court-of-appeals(AP) — Government attorneys are appealing a judge’s order to return more than $1 million seized in a Nebraska traffic stop to a California woman.

The U.S. Attorney for Nebraska filed the notice of appeal on Friday. The case will now go the 8th U.S. Circuit Court of Appeals.

In July, a federal judge ordered the government to return $1.07 million — plus interest — to Tara Mishra, of Rancho Cucamonga, Calif. Mishra sued earlier this year, saying the cash taken in a March 2012 traffic stop near North Platte was her life savings earned over years as an exotic dancer.

U.S. District Judge Joseph Bataillon said government lawyers failed to prove the money was connected to illegal drugs, as it had claimed, noting that Mishra showed she had paid income taxes on the money.

Zimmerer Named to Allstate AFCA Good Works Team

CJ-Zimmerer-Huskers-NebraskLincoln – University of Nebraska fullback CJ Zimmerer was honored for his efforts on and off the field on Tuesday, as he was named to the 2013 Allstate AFCA Good Works Team®.

Zimmerer, a senior fullback from Omaha, has been a mainstay on the Husker offensive and special team units throughout his career. He has played in 31 career games, including a pair of starts this season. His efforts at fullback helped Nebraska lead the Big Ten in total offense and rushing offense during the 2012 season.

Off the field, Zimmerer served as the inaugural president of the Uplifting Athletes chapter at Nebraska during the 2012-13 year, raising money and awareness for pediatric brain cancer. A two-time member of the Brook Berringer Citizenship team, Zimmerer has alsovolunteered his time with team hospital and school visits, including Madonna Rehabilitation Center, Cub Scouts, School is Cool Week, Husker Hotline, Husker Connect and the YWCA. In the classroom, he graduated in 3.5 years and is a candidate for CoSIDA Academic All-America honors.

For more than two decades, the Allstate AFCA Good Works Team® has recognized college football players at all levels of the sport for inspiring acts of service and off-the-field achievements. This summer, the program received a record 150 nominations from colleges and universities across the country.  From the nominations, an esteemed voting panel comprised of former Allstate AFCA Good Works Team® members and college football media selected 11 players from the Football Bowl Subdivision and 11 players from the Football Championship Subdivision, Divisions II, III and the NAIA to comprise the 22-player team.

“Allstate is thrilled to embark on another year of collaboration with the AFCA, and together honor this group of extraordinary young men for their “good works” in the community,” said Cynthia Whitfield, field senior vice president of Allstate’s Southern region and a member of the 2013 voting panel.  “As fans of college football, Allstate continues to be inspired by the remarkable performances that take place on the field, but equally inspiring are the acts of service that have earned these 22 players a spot on the 2013 AFCA Good Works Team®.”

Zimmerer is the 14th Husker football player to earn the honor since its inception in 1992, a total which ties Georgia for the national lead in that category.  Last year, I-back Rex Burkhead claimed the honor and was selected as the team captain based on fan voting. Other Huskers who have been selected for the Good Works team in previous years include Troy Branch (LB, 1992, 1993), Donta Jones (OLB, 1994), Aaron Graham (C, 1995), Jared Tomich (RE, 1996), Dan Alexander (IB, 1999), Patrick Kabongo (DT, 2001), Troy Hassebroek (WR, 2002), Sandro DeAngelis (P/PK, 2003), Mark LeFlore (WR, 2005), Dane Todd (FB, 2006) and Jared Crick (DT, 2011).

“The AFCA, along with our partner Allstate, has been honoring football student-athletes for their good works, volunteerism and community service for 22 years with the Allstate AFCA Good Works Team,” Grant Teaff, AFCA Executive Director said. “The 2013 class of Good Works Team members is another great example of the outstanding athletes, and even better men, that our nation’s college football programs produce each year.”

On September 17th, 1931, RCA Victor demonstrated the first 33-and-a-third RPM long-playing record in New York.

In 1963, “The Fugitive” began its run on ABC, starring David Janssen as Dr. Richard Kimble.

In 1964, “Bewitched,” starring Elizabeth Montgomery, made its debut on ABC.

In 1967, The Doors performed “Light My Fire” on “The Ed Sullivan Show.” Jim Morrison had been asked to change the line “Girl, we couldn’t get much higher,” but Morrison sang it anyway.

Also in 1967, The Who appeared on “The Smothers Brothers Comedy Hour.” Drummer Keith Moon had set a flash powder explosion in his drum kit, not knowing technicians had already done so. The resulting explosion sent a cymbal into Moon’s leg and singed Pete Townshend’s hair.

In 1972, “MASH” premiered on CBS. It stayed on the air for 11 years.

In 1978, ABC’s expensive sci-fi show “Battlestar Galactica” made its debut.

Also in 1996, London police intercepted and destroyed a booby-trapped book that an obsessed fan sent to singer Bjork (BYORK). The fan shot himself to death hours after mailing the package. The package never reached Bjork’s home.

In 1997, comedian Red Skelton died at a hospital near his home in Palm Springs, Calif., after a long illness. He was 84.

In 2001, David Letterman hosted the first late-night talk show since the terrorist attacks on Sept. 11. Letterman opened the show with no jokes, just his thoughts on the matter. Dan Rather was his first guest and broke into tears.

Nebraskans Brace for Flooding Along South Platte

national-weather-serviceNebraskans who live near the South Platte River are bracing for flooding later this week when the water from Colorado’s torrential rains flows into the state.

The National Weather Service is warning about flooding in low-lying along the South Platte beginning Wednesday and continuing for several days.

The river runs along Interstate 76 and then Interstate 80 when it enters Nebraska from Colorado.

Floodwaters are likely to approach or exceed record levels along the South Platte at least until after it joins with the North Platte River near the city of North Platte.

Lincoln County officials are preparing for flooding in a golf course and some neighborhoods of southwest North Platte.

The Nebraska Emergency Management Agency is sending a team to Ogallala to help local officials respond to flooding.

Feds to Ask for 27-Year Sentence in Child Porn Case

sex-offenders(AP) — A Massachusetts man who authorities say chatted online with other men about their mutual desire to kidnap, rape, kill and eat children is facing a long prison sentence.

Prosecutors plan to ask for a 27-year prison term for Geoffrey Portway of Worcester when he is sentenced Tuesday in federal court in Worcester.

Authorities say they found a dungeon, homemade coffin, butchering kit and other tools in the basement of Portway’s home.

In a sentencing memo, prosecutors say the 40-year-old Portway solicited people for help to kidnap a child with the intent of raping, killing and eating the child.

Portway’s lawyer says the chats were only fantasies. He plans to ask for a sentence of about 18 years, at the low end of the range in a plea agreement with prosecutors.
