Feds Address Banking Issues with Legal Marijuana

Colorado-Marijuana(AP) — A Justice Department official says the federal government will enable financial institutions to transact business with the legitimate marijuana industry without fear of prosecution.

The issue has taken on greater urgency now that Colorado and Washington have become the first states to legalize recreational use of marijuana.

Currently, processing money from marijuana sales puts federally insured banks at risk of drug racketeering charges.

In an appearance before the Senate Judiciary Committee on Tuesday, Deputy Attorney General James Cole said the issue was one that the federal government needed to deal with.

The Justice Department announced Aug. 29 that it won’t try to stop Colorado and Washington state from legalizing recreational marijuana use as long as they implement strong enforcement systems. Marijuana is an illegal drug under federal law.

(AP) — Lancaster County Attorney Joe Kelly is planning to seek re-election in 2014.

The top prosecutor in Lincoln formally announced his bid on Tuesday outside the county courthouse.

Kelly was elected to his first term in 2010, after a decade as chief deputy county attorney. He has served as a prosecutor for 28 years, handling homicide, robbery and sexual assault cases and others involving abuse of vulnerable adults.

Kelly says he wants to continue prosecuting people who use computers to entice children. He also points to a new program that lets veterans stay out of the courts if their offense was non-violent and they are suffering from posttraumatic stress disorder.

The Lancaster County attorney’s office filed more than 1,400 felony and 5,500 misdemeanor criminal charges last year.

(AP) — Nebraska officials say a Japanese manufacturer plans to open its first U.S. office in the state, so it can be near the Kawasaki plant that uses its railcar parts.

Lt. Gov. Lavon Heidemann said Tuesday that Morio Denki Co. plans to open in office in Lincoln by the end of the year.

The company will send two people to set up its Lincoln office with plans to hire more staff, but state officials say it wasn’t immediately clear how many people might be hired.

Nebraska spokeswoman Jen Rae Wang says state officials who are currently on a trade mission to Japan are working to gather more details about the company’s plans.

Morio Denki makes electrical equipment that’s used in railroad, automotive, shipping and real estate applications.

(AP) — A new report says Nebraska’s tax collections are roughly on pace with estimates for the current fiscal year.

The tax commissioner’s office announced Tuesday that the state has received about $573 million since the new fiscal year began on July 1. That’s less than 1 percent above the certified forecast of $569 million.

Tax Commissioner Doug Ewald says net receipts for the month of August totaled $341 million, which is less than the forecast of $344 million.

The comparisons are based on an April forecast made by the Nebraska Economic Forecasting Advisory Board. The board’s projections were adjusted for new laws that passed in 2013 and divided into monthly estimates.

Thunderstorm Causes Damage in Sidney

severe-weather(AP) — Residents of Sidney are cleaning up after a thunderstorm caused widespread damage to the city in the Nebraska Panhandle.

The National Weather Service says nearly 2 inches of rain fell in Sidney Monday evening and winds gusted up to 78 mph during the intense storm.

City Manager Gary Person says the storm knocked out power to much of Sidney, uprooted trees and damaged homes and businesses.

A semitrailer truck overturned on Interstate 80 and a train was blown off the tracks west of Sidney.

Person says the power outage forced the school district to keep the elementary school closed Tuesday, but the middle and high schools were open.

Most of Sidney regained power by about noon Tuesday.

Big 10 Pride at Stake with 4 Games vs. Pac-12

Big-Ten-LogoThis is one of those rare weeks when even Michigan hopes for an Ohio State victory.

Minnesota wouldn’t mind a win by Wisconsin, either.

There are four games this Saturday pitting Big Ten teams against top Pac-12 competition. This is the best opportunity until bowl season for the conferences to establish themselves as powers of the sport.

No. 4 Ohio State plays at California. No. 20 Wisconsin travels to Arizona State. No. 23 Nebraska hosts No. 16 UCLA. Illinois takes on 19th-ranked Washington in Chicago.

No. 17 Northwestern got the Big Ten off to a solid start by winning at California. Like Michigan coach Brady Hoke, whose Wolverines took down Notre Dame last week, Wildcats coach Fitzgerald says he’ll be rooting for the rest of the Big Ten this weekend.

Suh Slapped with 100K Fine for Illegal Block

Ndamukong-Suh-Lions-DetroitDETROIT (AP) — Detroit star Ndamukong Suh has been fined $100,000 by the NFL for his illegal low block in the season-opening victory over the Minnesota Vikings last weekend.

NFL spokesman Randall Liu says vice president of football operations Merton Hanks notified the Detroit defensive tackle of the fine. Suh hit Vikings center John Sullivan during an interception return, drawing a penalty that negated a touchdown by Detroit linebacker DeAndre Levy.

Suh said he wasn’t going after Sullivan’s knees, adding that the two discussed the play at halftime. Detroit players said Suh apologized to the team Tuesday.

The NFL fined Suh $30,000 last year for unnecessary roughness when he kicked Houston quarterback Matt Schaub in the groin area. He was suspended two games in 2011 after stomping on Green Bay’s Evan Dietrich-Smith.

FDA Receives 89 Reports of Illness from Yogurt

fda(AP) — The Food and Drug Administration reports at least 89 people have reported getting sick after eating Chobani Greek yogurt manufactured in Twin Falls, Idaho.

FDA spokeswoman Tamara Ward told The Times-News (https://bit.ly/17nnX7P) on Monday that some have described nausea and cramps.

No link has been confirmed between the illnesses and the yogurt. However, Ward says the FDA is working with Chobani to hasten its voluntary recall.

Chobani last week told grocery stores to destroy 35 varieties of yogurt reported to have been contaminated by a mold associated with dairy products. The affected yogurt cups have the code 16-012 and expiration dates between Sept. 11 and Oct. 7.

Health officials have said the yogurt is not a public health threat, but the company said last week the “mold can act as an opportunistic pathogen for those with compromised immune systems.”

Huskers Add 2018 Game with Troy

nebraska_helmetNebraska has added a matchup with Troy University to its lineup of future non-conference football games, the schools announced on Tuesday.

The Trojans will come to Lincoln on Sept. 15, 2018, marking the fifth time Troy has visited Memorial Stadium. Nebraska and Troy previously met in Lincoln four times between 2001 and 2006, with the Huskers winning each of the four matchups.

Troy has opened the 2013 season with a 2-0 record, and has been one of the top programs in the Sun Belt Conference since making the transition to the FBS ranks in 2002. Troy won conference championships in five straight seasons from 2006 to 2010, including outright titles in 2008 and 2009.

The Trojans have also won at least eight games six times since making the transition to the FBS level. Coach Larry Blakeney’s teams also appeared in bowl games five times between 2004 and 2010, with bowl victories in 2006 and 2010.

The first meeting between Nebraska and Troy took place in 2001, when the Huskers won 42-14, before a 31-16 win in 2002 at Memorial Stadium. Nebraska has pitched shutouts in the two most recent meetings between the schools, defeating the Trojans 30-0 in 2003, and 56-0 in 2006.

The matchup between Nebraska and Troy is the second scheduled game on Nebraska’s 2018 non-conference schedule. The Huskers are also scheduled to host Colorado on Sept. 8, 2018, in the first of a four-game series with the Buffaloes.

Judge Dismisses UNL Student’s Rape Case

ne-supreme-court-gavel(AP) — A judge has dismissed a rape case filed against a 21-year-old University of Nebraska-Lincoln student.

Judge Steven Burns ruled Monday that the evidence against Dustin Trauernicht would not support a guilty verdict. Defense attorney Randy Paragas had asked the judge for a ruling after prosecutors rested their case.

Trauernicht was accused of sexually assaulting a 19-year-old woman in January last year at a booze-filled party. Trauernicht said he didn’t remember what happened that night.

At issue was whether the woman was so drunk she couldn’t give legal consent for sex. She conceded during testimony that it was possible the sex was consensual.

Prosecutors objected to the case’s dismissal, saying the woman’s state of intoxication was something for the jury to decide.
