Nebraskan Appeals Conviction in Baby’s Death

Ryan-Kozisek(AP) — A 32-year-old eastern Nebraska man found guilty of killing his 4-month-old daughter has appealed his conviction.

Ryan Kozisek’s filing earlier this week also appeals his sentencing order and an earlier denial of his motion for a new trial.

On Dec. 16 a judge sentenced the former Gresham man to 35 to 50 years in prison. A York County jury had found Kozisek guilty of child abuse resulting in the death of Kayley Kozisek. Kayley died at an Omaha hospital on Jan. 25, 2011, a day after Kozisek called 911 and said she wasn’t breathing.

Kozisek told authorities that his 2-year-old daughter fell off a stepping stool and landed on the baby. A doctor later said such an accident couldn’t have caused Kayley’s injuries.
