(AP) — Sentencing has been delayed for a 26-year-old York man who was wounded in an exchange of gunfire with a York County sheriff’s deputy.

At a hearing Tuesday, a prosecutor asked for a delay so the judge would have time to review certain pieces of evidence that were supposed to have been included in a presentence report on the man, Max McCall. The hearing was rescheduled to Jan. 28.

McCall had pleaded no contest to three charges, including attempted first-degree assault on an officer. Prosecutors dropped other charges in exchange for McCall’s pleas.

The incident occurred Aug. 11, after the deputy responded to a call about McCall threatening a relative. Prosecutors say McCall was shot after he fired at the deputy.
