Omaha Attorney Suspended Indefinitely

ne-supreme-courtOMAHA, Neb. (AP) — The law license of an Omaha attorney has been suspended indefinitely by the Nebraska Supreme Court.

The high court on Friday cited findings by the Nebraska Counsel for Discipline that Nick Simon had violated his oath of office as an attorney in nine counts related to his mishandling of immigration matters.

The nine counts generally allege misconduct, incompetence, failure to communicate and failure to act diligently.

The soonest Simon can seek reinstatement is June 1, 2015. He also faces two years of monitored probation if he is reinstated.

A business phone for Simon rang unanswered Friday. A home phone number for him could not be found.

NSP Investigating Seward County Body as Homicide

state-patrol-logoBEAVER CROSSING, Neb. (AP) — The death of a man found on the bank of the Big Blue River is being investigated as a homicide.

Nebraska State Patrol Investigative Services Lt. Bob Frank says a recent autopsy revealed the man did not die of natural causes. Additional information was not released.

Authorities are seeking help from the public in identifying the body, which was found Wednesday afternoon near Beaver Crossing in Seward County. The body did not have any form of identification, though Frank says the man had a distinctive tattoo of a panther on his upper left arm.

Warrants Issued for Nebraska Prisoners Released Too Early

ne-department-of-correctionsLINCOLN, Neb. (AP) — Nebraska officials have issued arrest warrants for about 20 of the 306 inmates who were released early because the Department of Correctional Services miscalculated their sentences.

Gov. Dave Heineman said Friday that state officials will not seek 257 inmates who were let out early but would have finished their correct sentence by now. Three others have died since their release, and five have successfully completed their parole.

Of the remaining inmates, an unspecified number is back in custody and some qualify for furlough programs. One is being paroled.

Heineman and Attorney Jon Bruning say another 567 inmates were given incorrect sentences, but none of those prisoners were released.

Bruning says the inmates being pursued generally have 1 to 4 years remaining on their sentences.

Omaha Police Release Name of Stabbed Officer

omaha-policeOMAHA, Neb. (AP) — Authorities have released the name of an officer who was stabbed by a man at a convenience store in northeast Omaha.

Police say the officer was attacked Thursday afternoon while responding to a trespassing disturbance at the store.

The officer was identified Friday as 51-year-old Sophia Jordan, who has almost 15 years on the force.

Twenty-nine-year-old Gary Jackson, of Omaha, was arrested. He remained in Douglas County Jail on Friday, pending charges of attempted murder and use of a weapon. Online court records don’t list the name of his lawyer in the case.

Alliance Woman Pleads Not Guilty to Theft from Soccer Club

ne-supreme-court-gavelALLIANCE, Neb. (AP) — A western Nebraska woman has pleaded not guilty to a charge that she stole nearly $12,000 from a youth soccer team in Alliance.

Online court records say Erinn Merrill faces two counts of felony theft.

Prosecutors say Merrill used the soccer team’s debit card to withdraw $8,180 cash in 39 different transactions between September 2012 and August 2013. They say she also used the team card to make nearly $3,500 in purchases.

Nebraska Court Orders New Trial for Wyoming Man

judgeshipOMAHA, Neb. (AP) — The Nebraska Supreme Court has again thrown out the conviction of Wyoming man accused of posing as a licensed car dealer and ordered a new trial in the case.

Thomas Merchant, of Cheyenne, Wyoming, has twice been convicted of being an unlicensed dealer after prosecutors said Merchant bought 19 vehicles from the Nebraska Auto Auction in June 2011. The business said the checks Merchant wrote for the vehicles bounced, and that Merchant included a fake dealer’s license number on paperwork that also indicated Merchant was a “wholesale” dealer.

His first conviction was reversed last year because of improperly admitted evidence. He was again tried and convicted and sentenced to 12 to 26 years in prison.

On Friday, the Nebraska high court vacated his second conviction, citing faulty jury instructions.

Nebraska Girl Back Home After Rattlesnake Bite

western-massasauga-rattlesnakeHARRISON, Neb. (AP) — A 7-year-old Nebraska girl has returned home to recover from a rattlesnake bite received while picking flowers alongside a road in the northwest corner of the Nebraska Panhandle.

Britney Klein was discharged from Children’s Hospital Colorado in Aurora, Colorado, on Thursday and arrived home in Harrison, Nebraska, late that night. Lisa Klein told The Associated Press on Friday that her daughter “couldn’t be any better.”

Britney Klein was struck in a leg on Tuesday a few miles from Harrison. She was given some anti-venom while she and her mother were being flown to a Scottsbluff hospital. Britney was then taken to the Colorado hospital for specialized care.

Joplin Campaign to Help Nebraska Tornado Victims

pilger-tornado-3JOPLIN, Mo. (AP) — Residents of a southwest Missouri city devastated by a 2011 tornado are reaching out to the northeast Nebraska town of Pilger, which was torn apart by a tornado last week.

Joplin residents on Thursday announced a “Joplin Loves Pilger” campaign to help victims of the June 16 tornado in Pilger.

The campaign includes a Facebook page to offer encouragement and an account at Pinnacle Bank in Joplin, with all proceeds to go to the Pilger Community Development Fund.

The May 2011 tornado damaged hundreds of homes and businesses and killed 161 people in Joplin.

Joplin resident Doug Hunt, who was working Saturday in Pilger, says the campaign is part of his efforts to thank you to people who helped him and his city.

Record Overnight Rating for NBA Draft on ESPN

nbadraftNEW YORK (AP) — The NBA draft delivered its highest rating on ESPN, surpassing the mark set 11 years ago when LeBron James was the No. 1 pick.

The telecast Thursday had a 3.1 overnight rating, according to Nielsen, a 19 percent increase from last year’s 2.6 mark.

The previous record for the draft was 2.7 overnight in 2003, the first year the network televised it. James was the first pick that year in a top five that included Carmelo Anthony, Dwyane Wade and Chris Bosh.
