State Settles Nebraska Prison Guards’ Bias Lawsuit

lawsuit-settlementLINCOLN, Neb. (AP) — Nebraska has settled a civil rights lawsuit filed by five Nebraska guards who alleged their prison was a racially hostile workplace.

The five and their law firm will receive just over $777,000. The state did not admit any wrongdoing as part of the settlement.

The five declined to comment. The Nebraska attorney general’s office, which represented the state and several officials named, also would not comment.

The guards filed the lawsuit in 2010, saying they were subject to racially charged comments and other bias at the Nebraska State Penitentiary in Lincoln. The lawsuit was dismissed in 2012 and then reinstated in part by a federal appeals court in February.

Desmond’s Homer Lifts Nationals past Rockies 4-3

colorado-rockiesWASHINGTON (AP) — After a replay review, Ian Desmond’s solo homer provided the go-ahead run and the Washington Nationals rallied from a three-run deficit for 4-3 win over the Colorado Rockies on Wednesday night, sweeping the three-game series.

Jayson Werth also homered for Washington, which has won a season-high five straight.

Right-hander Matt Belisle (2-4) came on to face Desmond with one out in the seventh. Desmond’s hit appeared to bounce off the top of the wall in right center, then off the railing in front of the first row and onto the field.

He ended up on third, but after a review that took 3:42, Desmond was given his 15th homer.

Washington’s Doug Fister (7-2) allowed three runs on seven hits over seven innings.

Rafael Soriano pitched the ninth for his 20th save.

Michael McKenry hit a three-run homer for Colorado.

Rockies Acquire RHP Jair Jurrjens from Reds

WASHINGTON (AP) — The Colorado Rockies have acquired right-hander Jair Jurrjens from the Cincinnati Reds in exchange for minor league first baseman Harold Riggins.

Jurrjens signed a minor league contract with Cincinnati in May, and was 2-3 with a 4.46 ERA at Triple-A Louisville.

He has a 53-37 record with a 3.63 ERA in seven major league seasons, including five with Atlanta. He last pitched in the majors in 2013, appearing in two games with Baltimore.

Riggins was playing at Double-A Tulsa.

The Rockies have used 12 starting pitchers this season, the most in the majors, and have the worst team ERA, 4.99.

A team spokesman said Wednesday that Jurrjens will join the Rockies’ top farm club in Colorado Springs, Colorado.

3 Nebraska Prisoners Erroneously Released Still at Large

ne-department-of-correctionsLINCOLN, Neb. (AP) — The Nebraska Department of Correctional Services says it has accounted for all but three of the 45 prisoners who were released before they should have been and still owe time.

State officials issued arrest warrants for 20 of those inmates. The governor’s office said Wednesday that 12 of them are back in custody, three were previously deported, one is at the Norfolk Regional Center for sex offenders, and one is dead. The remaining three have not been found.

Arrest warrants were not issued for the other 25 inmates. The department says three have been placed on the re-entry furlough program, 10 are pending for the program, and eight have had their parole extended. Two are dead, one was deported, and one is incarcerated in Oklahoma.

Vargas Pitches Royals to Victory, 4-0 over Twins

kc-royalsMINNEAPOLIS (AP) — The Kansas City Royals have played well away from home. They’re consistently capable of winning with only a couple of runs.

If they can keep this up for the summer, they’ll probably be right there in the pennant race at the end.

Jason Vargas threw seven scoreless innings, Raul Ibanez homered in his second game for Kansas City and the Royals beat the Minnesota Twins 4-0 Wednesday.

“We’ve been running the ball out there and doing a good job of keeping our team in the ballgame, and when we’re not the boys are stepping up and keeping us in the ballgame,” Vargas said. “So we’ve got a good combo going on right now.”

Vargas (8-3) allowed four singles and two walks while striking out five, allowing only two runners from a diluted Twins lineup to reach second base. Only five of their 21 outs against him were outfield flies.

“He’s got all the pitches,” Twins manager Ron Gardenhire said.

Mike Moustakas and Jarrod Dyson hit RBI singles in the second inning against Kevin Correia (4-10), and that was all Vargas needed. With Joe Mauer missing, placed on the disabled list before the game because of a strained muscle on his right side, the Twins didn’t cause Vargas any trouble. They were shut out for the sixth time this season and lost for the seventh time in their last nine games.

“Obviously you have to score to win,” said Correia, the league leader in losses. “It’s tough. It’s a good pitching staff they have. It’s going to happen.”

With rookie Yordano Ventura and now Danny Duffy joining the veteran trio of Vargas, James Shields and Jeremy Guthrie, who are all in the top 10 in the league in innings pitched, the Royals have a deep rotation. They’ve pitched well enough to make up for substandard seasons by several key hitters.

Vargas improved to 4-1 in his last eight starts, seven of which have counted as quality: six innings or more and three runs or less. Vargas also became the first Royals left-hander to win eight games or more before the All-Star break since Chris George in 2003.

“I thought he was splendid,” Royals manager Ned Yost said. “He was pretty much in complete control.”

The 42-year-old Ibanez signed Monday with the Royals, the team that first gave him a regular spot in the lineup all the way back in 2001. He had two hits and two runs in this game, including the solo shot to right field in the eighth. Ibanez was released by the Los Angeles Angels last month.

Eric Hosmer, who walked three times, added an RBI single in the ninth inning for insurance.

The Royals won their fifth straight road series. After losing eight of 12 following a 10-game winning streak, Vargas put them back on track.

“Just typical Vargas, just going out, working, throwing strikes, letting his defense work,” Hosmer said. “He really knows his game plan when he’s out there.”

Correia lowered his ERA to 4.95, the only time he’s had that mark under 5.00 since his first start of the year, after surrendering six hits and two walks in six innings while striking out three. The right-hander completed exactly six innings for the fifth consecutive turn, and he has allowed two runs or fewer in four of those starts.

But the second inning was the one that hurt, when five batters reached. He struck out Billy Butler to finish the frame with the bases loaded.

NOTES: The Royals swapped RH relievers Wednesday, calling up Casey Coleman from Triple-A Omaha and sending down rookie Michael Mariot, who gave up five runs Tuesday in his second appearance in as many days. … Chris Parmelee played 1B and batted third for Mauer. He had two hits and stretched his hitting streak to a career-long 12 straight games. … One of the runners to reach second base for the Twins was Sam Fuld, who was originally ruled out on a steal attempt to end the fifth inning. Gardenhire challenged the call, which was overturned. Gardenhire is 9 for 19 on challenges this season. … With a rest day for Royals CF Lorenzo Cain, SS Alcides Escobar batted leadoff for the first time this season. … The Royals have Thursday off before a three-game series in Cleveland against the Indians. The Twins host the New York Yankees for a four-game series.

Nebraska Inmate Released Early Loses Court Bid, Now in Custody

jailLINCOLN, Neb. (AP) — One of dozens of Nebraska inmates who were mistakenly released early after the state miscalculated their sentences has lost his court bid to remain free.

Fifty-seven-year-old Bruce Caton had asked a judge to block prosecutors from sending him back to prison, arguing that he already served the minimum of his 10- to 20-year sentence.

But online court records say Lancaster County District Judge Robert Otte denied Caton’s bid on Friday, saying a trial court couldn’t modify a valid sentence once it’s pronounced. Plus, Otte said, Caton had filed a habeas corpus challenge, alleging he was being illegally detained. At the time, he wasn’t in custody. He is now.

Caton was sentenced in 2004 as a habitual criminal. His record includes burglary, kidnapping, rape and robbery.

SW Iowa Camper Finds Body in Missouri River

body-foundGLENWOOD, Iowa (AP) — Authorities say a camper has found a man’s body in the Missouri River in southwest Iowa.

Chief Deputy Bruce Paulsen, of the Mills County Sheriff’s Office, said a camper found the body about 4:45 p.m. Tuesday in the river at Lincoln’s Landing campground. That’s near the U.S. Highway 34 bridge that connects Mills County to Plattsmouth, Nebraska.

Paulsen says the body had some clothing and indentifying markings, such as tattoos, but he wouldn’t be specific.

He says the sheriff’s office hasn’t received recent reports of a missing man upriver.

The body was taken to the Douglas County Coroner’s Office in Omaha for an autopsy.

Doctors: 12-Year-Old Stabbing Suspect is Mentally Incompetent

ne-supreme-court-gavelWAUKESHA, Wis. (AP) — Doctors say one of two 12-year-old girls accused of stabbing a classmate to please a fictional online horror character is not competent to stand trial.

The doctors’ reports have not been made public, but attorneys said Wednesday that a doctor for the state of Wisconsin and a doctor hired by the girl’s defense agree that she is not mentally competent.

Prosecutors have asked for further evaluation and a hearing on the matter, and the judge has agreed.

Authorities have said the two girls plotted for months to kill their friend to curry favor with the specter known as Slender Man. A criminal complaint says they lured her to a wooded park west of Milwaukee on May 31 and stabbed her 19 times.

The victim is now recovering at home.

Child Abuse Trial Set for Columbus Man, Girlfriend

juan-trejoCOLUMBUS, Neb. (AP) — A September trial has been scheduled for a Columbus man and his girlfriend accused of abusing his 10-month-old son.

22-year-old Juan Trejo and his fiancee, 22-year-old Julie Staroscik, have pleaded not guilty to child abuse charges. Their trial is scheduled to begin Sept. 29 in Columbus.

Authorities say Trejo is accused of fracturing the boy’s skull by throwing him to a floor when the baby wouldn’t stop crying. Trejo faces three counts of child abuse. Staroscik, who is not the boy’s biological mother, faces one count of abuse.

A doctor at Children’s Hospital & Medical Center in Omaha says the boy had about 20 fractures to his skull, ribs, arms and legs in various stages of healing.

Man Convicted in 2003 Council Bluffs Slaying

COUNCIL BLUFFS, Iowa (AP) — A 36-year-old man has been found guilty of killing another man nearly 11 years ago in Council Bluffs.

A jury convicted James Harris on Tuesday of first-degree murder. Prosecutors say he stabbed to death Nelson Alvarez-Hernandez during a robbery on July 31, 2003.

The case went cold until police used DNA results to tie Thomas Sanchez, of La Vista, Nebraska, to the case and arrest him in January. That led police back to Harris, who police say had long been a suspect. Harris was arrested in March. Charges against Sanchez were dropped on June 24.

Harris faces life in prison without parole at his sentencing, which is scheduled for Aug. 20.
