OMAHA, Neb. (AP) — A Scottsbluff man has been sentenced to five years in prison after the Nebraska Supreme Court overturned his previous convictions on first-degree sexual assault of a child and four counts of child abuse.

36-year-old Eric Rocha was sentenced after pleading guilty to the third-degree sexual assault of a child. He was given credit for 117 days already served.

Rocha was originally convicted in February 2012 and sentenced to 40 years to life in prison. Those convictions were thrown out in July because his attorney hadn’t sought to have separate trials on the sex abuse and child abuse charges.

Investigators say a young girl was sexually assaulted for two years and her brothers, ages 3, 5 and 10, were choked and beaten.
