MADISON, Neb. (AP) — A man has been found guilty of second-degree murder in the stabbing death of a man in Norfolk, following a second trial in the case.
Judge James Kube announced his decision Wednesday in Madison County District Court at the end of a short trial for 24-year-old De’Aris Trice. Sentencing has been set for Nov. 21.
Trice was convicted of the same charge following the death of 27-year-old Timothy Warren in December 2010. He was sentenced to between 40 years and life in prison. But the Nebraska Supreme Court overturned the conviction in July 2013, saying it found fault in an instruction given to jurors.
Kube said the state met the burden of proof beyond a reasonable doubt to convict Trice a second time.
