OMAHA, Neb. (AP) — A 19-year-old man has been convicted of two weapons charges connected to the death of an Omaha 5-year-old struck by a rifle bullet that penetrated a wall of her home.

Prosecutors made a deal with Jaylen Montgomery, who pleaded no contest on Monday to use of a firearm and discharging a firearm at an occupied building. Montgomery faces up to 54 years in prison when he’s sentenced on April 3.

Montgomery was one of four men charged in the slaying of Payton Benson. Authorities say the four were riding in a stolen vehicle on Jan. 15 last year when they spotted someone they thought was a rival gang member. They opened fire, and one of the bullets went through a wall of Payton’s home, through her and out another wall.

OMAHA, Neb. (AP) — A Douglas County District judge has sentenced Erica Jenkins to life in prison for the 2013 shooting death of a man.

Judge Peter Bataillon also sentenced Jenkins to 80 to 100 years for weapons counts for the Aug. 11, 2013, killing of Curtis Bradford.

Jenkins is the sister of Nikko Jenkins, who last year was convicted in the killing of Bradford, as well as the 2013 shooting deaths of Andrea Kruger and two others in separate attacks.

Erica Jenkins still faces a second murder trial in the slaying of Kruger.

Authorities say the siblings shot Bradford after luring him out on the pretense of committing a robbery.

Erica Jenkins, who’s already serving time for robbery, was not in the courtroom for Tuesday’s sentencing.

Nebraska AG Vows to Continue Fight Against Colorado Pot

LINCOLN, Neb. (AP) — Nebraska Attorney General Doug Peterson is defending his state’s lawsuit against legalized marijuana in Colorado, saying he doesn’t want Colorado’s “failed experiment” to spill over into Nebraska.

The new Republican attorney general argued in a statement Tuesday that the decision by Colorado voters will cause long-term harm to Nebraskans.

Peterson’s predecessor in office, Jon Bruning, announced last month that Nebraska and Oklahoma were asking the U.S. Supreme Court to overturn Colorado’s decision to allow recreational marijuana. Colorado has said it will fight the lawsuit.

Despite growing public support for legalizing marijuana, Peterson says Colorado’s decision has given rise to a multimillion-dollar “impairment industry” with products that are becoming more potent.

Peterson says Nebraska state officials now seize twice as much marijuana trafficked from Colorado as from Mexico and California.

‘Nebraska 150’ License Plate Bill Advanced to Legislature

nebraska-150th-300-250LINCOLN, Neb. (AP) — Nebraska is one step closer to creating new license plates that would recognize the state’s 150th anniversary.

A bill to allow the “Nebraska 150 Sesquicentennial” plates was sent to the full Legislature on Tuesday after a committee vote.

The measure by Sen. Jim Smith of Papillion would direct the state to design a new license plate to commemorate the anniversary in 2017.

Motorists could apply for the new plates between Oct. 1, 2015, and Dec. 31, 2022. Those who choose the optional plate would pay a $70 annual fee, which would help generate money for anniversary events and the Nebraska Department of Motor Vehicles.

NPPD Settles on Route for Power Line Through Sandhills

nppdCOLUMBUS, Neb. (AP) — Nebraska Public Power District has settled on a final route for a new high-voltage power line that will cross several counties in the state’s environmentally sensitive Sandhills region.

The district announced the decision on Monday, saying it sent letters last week to landowners along the route as part of the district effort to obtain entry permission.

Some ranchers along the route say the line poses a threat to the Sandhills’ fragile ecosystem of grasses and dunes. NPPD says it’s working with landowners and a university grasslands expert to protect the land.

The transmission line will start at Gerald Gentleman power plant near Sutherland and go north to a new substation near Thedford and then east toward Holt County to a new substation that will connect into an existing transmission line.

Lorenz apparently fired in self-defense after Toler broke Lorenz’s vehicle windshield with his bare hands. Kleine says Lorenz had gone to the scene to help Toler’s wife during a domestic dispute.

Prosecutor Clears Council Bluffs Officer in Shooting

council-bluffs-policeCOUNCIL BLUFFS, Iowa (AP) — Prosecutors have cleared a Council Bluffs officer who opened fire at a man who police say tried to run down the officer and another.

Pottawattamie County Attorney Matt Wilber said Monday that Officer Jarrod Poore used justified force on Dec. 23.

The officers had approached a parked Corvette that had been reported as stolen. They say the driver accelerated toward them and struck an unmarked police vehicle, but neither officer was injured. A chase ensued across the Missouri River into Omaha, Nebraska, and 33-year-old Jesse Wilkinson soon was arrested. He was treated for gunshot wounds.

Wilber says Wilkinson faces several charges. Online court records don’t list the name of his attorney.

Toddler Left in Day Car Van Found Wandering on NY Street

police-lights-redROCHESTER, N.Y. (AP) — Authorities say a 3-year-old boy left alone in a day care van has been found wandering on a New York street.

Police tell local media in Rochester that the boy was picked up around 8 a.m. Monday and fell asleep in a back seat of the van. Two workers unloaded the other children but apparently forgot about the toddler.

The workers then drove away with the boy still strapped into his seat and parked the van.

The boy was treated at a hospital and released.

The two workers have been charged with endangering the welfare of a child.

NPPD Signs Long-Term Contract for Fuel at Nuclear Plant

nppdBROWNVILLE, Neb. (AP) — The utility that owns Cooper nuclear power plant in southeast Nebraska has signed a long-term deal to buy fuel for the plant through 2034.

The Nebraska Public Power District recently approved the contract with Global Nuclear Fuel.

The contract covers nine planned reloadings between now and 2034. It could be worth more than $100 million for Global Nuclear.

Global Nuclear or one of its predecessors has provided all the fuel for Cooper over the life of the plant near Brownville, Nebraska, on the banks of the Missouri River.

Global Nuclear is a joint venture of GE, Hitachi and Toshiba that has operated since 2000. Before that its predecessor, GE Nuclear, was a subsidiary of GE.

Omaha Man Hospitalized After Shooting Near Park

omaha-policeOMAHA, Neb. (AP) — Authorities say a man has been hospitalized after someone shot him near an Omaha park.

Omaha police say the victim, whose identity wasn’t released, was shot just before 6 p.m. Monday next to Norwick Park.

Lt. Matthew Lippold says the man is estimated to be in his early to mid-40s and was taken to the hospital, where he’s in critical condition.

Lippold tells the Omaha World-Herald the man was alone in the park when he was shot. Lippold couldn’t say how many times the man was shot or where he was shot. No arrests have been made yet.

Meanwhile, officials identified 20-year-old Terence Butler as the man who was critically injured following a drive-by shooting early Monday morning outside an Omaha home.
