Bellevue Man’s Post-Conviction Relief Appeal Fails

LINCOLN, Neb. (AP) — The Nebraska Supreme Court has upheld a lower court’s decision to dismiss a Bellevue man’s motion for post-conviction relief without first holding an evidentiary hearing.

Jonathan Armendariz is serving 80 to 100 years in prison for second-degree murder and a weapons conviction in the 2011 shooting death of 18-year-old Kyle Williams. Armendariz was 17 at the time of the killing and had said he shot his friend during an argument over money.

Armendariz appealed after a Sarpy County District Court dismissed his motion for post-conviction relief, which is typically filed once all other appeals are exhausted.

On Friday, the state’s high court rejected Armendariz’s claims that his attorney didn’t effectively defend him

St. Pat’s Boys and Girls Earn Top Seeds in SPVA Tournament

SPVAThe brackets for the SPVA boys and girls basketball tournaments were released Friday and North Platte St. Patrick’s is the top seed in both tournaments.

The SPVA used the NSAA points system to determine the seeding for the tournament and the St. Pat’s boys with a 10-1 record had 45.73 points at seeding time. St. Pat’s will host eighth-seeded Maxwell in the first round of the tournament at 7:00 pm Monday. Maxwell comes into the tournament with a 5-7 record.

Hershey is the fourth-seed in the 2015 tournament and will host No. 5 Perkins County at 7:00 pm Monday. The Panthers are 4-8, while the Plainsmen at 5-6. Sutherland is the No. 7 seed and will travel to second-seeded Chase County for a 6:00 pm tip-off Monday. The Sailors are 2-8 on the season and the Longhorns are 8-3.

The higher seeded team hosts the first round games then the tournament moves to North Platte Community College. The bracket for the boys tournament can be seen below.

The Lady Irish from St. Pat’s are 10-2 on the season and earned the No. 1 seed with 44.17 points. St. Pat’s will host eighth-seeded Perkins County at 7:00 pm on Tuesday. St. Pat’s beat the Plainswomen 57-22 on Friday, January 9. Perkins County is still looking for its first win at 0-10.

Hershey is the No. 4 seed in the girls tournament and will host No. 5 Sutherland at 6:00 pm Tuesday. The Lady Panthers are 6-6 and the Lady Sailors are 4-7, but Sutherland beat Hershey 45-29 on Tuesday. Maxwell is the No. 7 seed and will travel to No. 2 Kimball to play at 7:00 pm Tuesday. The Lady Wildcats are 6-6 on the season and Kimball is 6-4.

Illness Forces Cancellation of School in Ravenna

highschoolRAVENNA, Neb. (AP) — So many students and staffers have called in sick that school’s been canceled in the central Nebraska city of Ravenna (ruh-VA’-nuh).

Officials say 15 of 70 staff members and 100 of 460 students called in sick Thursday.

There will no school for four days in a row. The district called off classes for Friday, to be followed by the weekend and the Martin Luther King Jr. Day holiday on Monday.

Superintendent Dwaine Uttecht says flu is the primary illness going around.

Man Dies After Being Dragged by Car on West Side of Omaha

douglas-county-sheriffOMAHA, Neb. (AP) — A 58-year-old man has died after being struck and dragged by a car on the west side of Omaha.

The Douglas County Sheriff’s Office says the man was walking north on 204th Street when he was hit around 8 p.m. Thursday by a northbound car. Lt. Rob Jones says the driver reported that she didn’t see the man, who was dragged about 75 yards.

The driver was treated at a hospital for cuts by glass from her shattered windshield.

The names of those involved haven’t been released. The crash is being investigated.

Senators Defeat Effort to Open Votes for Legislative Leaders

NE LegislatureLINCOLN, Neb. (AP) — Nebraska lawmakers have rejected an attempt to end secret-ballot voting for legislative leaders.

The proposed rule change would have required senators to disclose their votes when picking committee leaders and their speaker. The measure failed on Thursday, with 12 senators voting for it and 33 against.

Some conservative lawmakers argue the Legislature should have to vote publicly when picking leaders as a matter of transparency.

Democrats and some Republican lawmakers say the proposal is attempt by state and county GOP officials to exert control over them. They also say it could lead to resentment and retaliation and make the Legislature more partisan.

Republicans outnumber Democrats 35-13 in the officially nonpartisan Legislature, yet Democrats hold five of the 14 standing-committee chairmanships. Speaker Galen Hadley is a Republican.

Former Knight Montalvo, Gant lead Texas State past South Alabama 82-71

SAN MARCOS, Texas (AP) — Emani Gant scored a career-high 22 points on 11-of-14 shooting to lead Texas State to an 82-71 win over South Alabama on Thursday night.

Kavin Gilder-Tilbury, who made 7 of 11 field-goal attempts, added a career-high 16 points for Texas State (10-5, 4-2 Sun Belt). Ethan Montalvo scored 14 and D.J. Brown 12.

Ken Williams hit a 3 with 18:10 left to pull South Alabama (4-12, 2-4) within three, but Montalvo hit a pair of 3-pointers during a 15-3 run which made it 55-41 about 5 minutes later.

The Jaguars trailed by double digits the rest of the way.

South Alabama shot 54 percent from the field and made nearly twice as many free throws (27) as Texas State attempted (15), but it wasn’t enough.

Texas State converted 15 offensive rebounds into 17 second-chance points and scored 26 off of 19 South Alabama turnovers.

Williams led the Jaguars with 23 points.

Kaminsky helps No. 7 Wisconsin beat Nebraska 70-55

Nebraska-Huskers-BasketballMADISON, Wis. (AP) — Frank Kaminsky scored 22 points in his return from a concussion that sidelined him a game to help No. 7 Wisconsin beat Nebraska 70-55 on Thursday night.

Kaminsky was 4 of 5 from 3-point range and 7 of 11 overall after missing the Badgers’ loss at Rutgers on Sunday night. In the first half, Kaminsky blocked Leslee Smith from behind on a drive to the basket, gathered the loose ball, sprinted the length of the court and floated an alley-oop to Sam Dekker.

It was the first full game for the Badgers without starting point guard Traevon Jackson, who injured his ankle Sunday. Bronson Koenig filled in well with 11 points for the Badgers (16-2, 4-1 Big Ten). Nigel Hayes scored 13 points, and Dekker added 11.

Terran Petteway led Nebraska (10-7, 2-3) with 27 points. He had 20 in the first half.

Survey: Economy Remains Weak in Nebraska, 9 Other States

economyOMAHA, Neb. (AP) — A monthly survey of bankers suggests the economy will remain weak in rural parts of 10 Midwestern and Western states because of low grain and oil prices.

The region’s overall economic index improved slightly to 50.9 in January from December’s neutral score of 50. The index ranges from 0 to 100. Any score above 50 suggests growth while a score below 50 suggests decline.

Creighton University economist Ernie Goss says growth is being restrained in rural areas because of low corn and fuel prices. But bankers say ethanol plants haven’t slowed production much.

Despite the concerns, rural businesses have adding some jobs. The January hiring index was 52.8, down from December’s 55.2.

Bankers from Colorado, Illinois, Iowa, Kansas, Minnesota, Missouri, Nebraska, North Dakota, South Dakota and Wyoming were surveyed.
