ACLU of Nebraska to Investigate New Lethal Injection Drugs

aclu-nebLINCOLN, Neb. (AP) — The ACLU of Nebraska is investigating the state’s purchase of new lethal injection drugs to carry out executions.

The civil liberties group filed an open records request Friday to review whether the acquisition was lawful.

Gov. Pete Ricketts announced Thursday that state officials have bought all three drugs required for executions. Nebraska lost its ability to execute prisoners when its supply of sodium thiopental, a required lethal injection drug, expired in December 2013.

ACLU of Nebraska executive director Danielle Conrad says the state has faced legal problems in its past efforts to obtain lethal injection drugs, and her group will hold officials accountable.

Nebraska Solicitor General Jim Smith, who handled previous death penalty cases, has said the issues raised in past cases were later resolved.

Omaha Attorney Suspended from Practicing Law for 3 Months

gavel-and-scaleOMAHA, Neb. (AP) — The Nebraska Supreme Court has suspended the law license of an Omaha attorney for three months over his mishandling of a client’s request.

The high court said Friday that David Steier’s suspension follows his work in 2012 for a client who paid him $800 to file applications for incorporation and tax-exempt status for a cheerleading studio and fitness center.

The Nebraska Counsel for Discipline says the client also gave Steier more than $800 in separate for fees to third parties that were never submitted. Officials say Steier knowingly made false and misleading statements to the client regarding the application.

The high court says Steier acknowledged violating his oath of office and attorney conduct rules.

Steier must also undergo 12 months of monitored probation following his suspension if he seeks reinstatement.

Judge Rules Lincoln Man Now Competent for Trial in Wife’s Slaying

LINCOLN, Neb. (AP) — A judge says a 42-year-old Lincoln man who twice was ruled mentally incompetent to stand trial in his wife’s slaying is now competent.

Kent Burklund is charged with second-degree murder in the death of 41-year-old Bettina Burklund. She was found dead in the couple’s home in April 2014.

Retired Judge Jeffre Cheuvront (shehv-ROHNT’) made the ruling Wednesday, based on an April 30 report by a doctor at the state psychiatric hospital in Lincoln. A trial date has not been scheduled.

Another judge ruled in August last year and again in February this year that Kent Burklund was incompetent for trial. But that judge also said a doctor at the state hospital reported there was a substantial likelihood that Burklund’s competency could be restored.

Death Penalty Repeal Headed to Final Vote in Nebraska Legislature

lethal-injectionLINCOLN, Neb. (AP) — An effort to repeal the death penalty in Nebraska has cleared another critical vote in the Legislature.

Lawmakers voted 30-16 on Friday to advance the repeal measure through the second of three required votes, despite a filibuster led by death-penalty supporters.

One final vote is required before it goes to Republican Gov. Pete Ricketts, a death penalty proponent who has promised a veto. If the current support holds, the bill will have a veto-proof majority.

Some lawmakers have argued that Nebraska should abolish capital punishment because it has only wasted money and created a false promise for victims’ families. The state hasn’t executed anyone since 1997, and some prisoners have been on death row for decades.

Nebraska High School Students to Keep Standard Minimum Wage

minimum-wageLINCOLN, Neb. (AP) — Nebraska high school students will continue to earn the same wages as their adult counterparts after a bill to slash student workers’ minimum wage failed to gain a two-thirds majority in the Legislature.

Senators voted 29-17 on a measure that would have kept the minimum wage for part-time student workers at $8, even after the standard minimum wage increases to $9 in January.

The measure needed 33 votes to pass because it would have modified a citizen-led ballot measure.

Nebraska residents voted to raise the minimum wage last November.

The bill’s sponsor Sen. Laura Ebke of Crete, says she believes public outcry derailed the bill. Ebke does not know whether she will bring a similar measure next year.

Ed was born September 16, 1949, to Herbert Edwin and Lavina Ferne Christensen Scott at Bend, OR. He grew up and attended school in Wiggens, CO. After his schooling he joined the U.S. Army in 1967 and served in Vietnam. Following his discharge in 1972, Ed moved to Brule, NE where he worked for Carl and Alma Schulz Ranching and Feed Lot. Ed married Judy Schulz on August 16, 1970, and to this union their children, Neil and Stacey, were born. Ed and Judy later divorced.

On February 1, 1980, Ed was united in marriage to Betty Lou Lindau McKenna at Sidney, NE where they made their home. Ed worked in Nebraska, Colorado, Wyoming and Kansas doing various farm and ranch work. Ed and Betty later owned and operated the Double E Bar at Wallace for 13 years from 1999 to 2012. Ed then worked part-time for area farmers and was President of the Wallace Gun Club.

He is survived by his wife, Betty, of Wallace; his children, Neil (Angela) Scott, of Chicago, IL, and Stacey Scott, of Sidney, NE; stepson, Randy (Terry) Olsen, of Council Grove, KS; five grandchildren, Austin Scott, Conner Callahan, Samantha Scott, Kylie Scott and Madison Olsen; a great-granddaughter, Samantha Burrows; brothers and sisters, Jack Scott, Rich Scott, Mike Scott, Beverly James and Janet Rosenfield, and a sister-in-law, Linda Scott, all of Colorado; half-sister, Dorothy; his dog, Jett; and many nieces, nephews and other family.

Ed was preceded in death by his parents, Herbert and Ferne; two brothers, Wayne and Jerry Scott; and half-brother, Bob Scott.

Cremation was chosen. Services will be Tuesday, May 19, 2015. Inurnment with military honors will be at 10 a.m. in Fort McPherson National Cemetery followed by a memorial service at 2 p.m. at the United Methodist Church in Wallace with Pastor Harun Gatobu officiating. In lieu of flowers, the family has established a memorial. The memorial book may be signed atodeanchapel.com or from 9 a.m. to 6 p.m. Monday at Odean Colonial Chapel at C & Sycamore which is in charge of arrangements.

Autopsy Reveals Omaha Boy Thrown Into River by Brother Drowned

OMAHA, Neb. (AP) — Douglas County prosecutors say an autopsy shows a boy thrown into the Elkhorn River on the eve of his fifth birthday drowned.

The autopsy says Josue Ramirez-Marinero, whose tiny body was pulled from the river Monday, showed no signs of injury or trauma.

Police say Josue’s 25-year-old half brother, Roberto Martinez-Marinero, threw the boy into the river on May 5 because the boy had witnessed his mother’s killing at the hands of Martinez-Marinero. Police reports say he would have turned 5 on May 6.

Police say Martinez-Merinero also told investigators he had killed his mother, Jesus Ismenia Marinero, on May 5. Her body was found in a southeastern Omaha ditch.

Martinez-Marinero is charged with two counts of first-degree murder. His girlfriend, 24-year-old Gabriela Guevara, is charged with being an accessory.

3 Sent to Hospital After Gas Leak at Hastings Hospital

hastings-fire-departmentHASTINGS, Neb. (AP) — Three people have been taken to a Hastings hospital as a precaution following a natural gas leak at a discount department store.

A forklift hit a heater inside a Walmart at Hastings on Friday, causing the leak.

Hastings Fire Chief Kent Gilbert says employees worked to keep customers safe. He says the building was evacuated, then ventilated.

Gilbert says the three taken to a hospital were treated because they had smelled the gas. Natural gas is colorless and odorless, but an odor is added to it as a safety measure to help people detect leaks.

Nebraska Corrections Director Says Lockdown Will End When Threat Passes

prisonLINCOLN, Neb. (AP) — Nebraska’s state corrections director says a prison struck by a weekend riot will remain under lockdown until the threat of further disturbances has passed.

Director Scott Frakes said in a memo released Friday that the Tecumseh State Correctional Institution’s lockdown will depend on good behavior and how quickly repairs can be made to facilities.

Inmates took control of part of the prison on Sunday. Two inmates were killed. Prison officials have said both men were likely killed by other inmates. Lawmakers said Thursday that fire, water and structural damage from the chaos could total $350,000 to $500,000. Insurance will likely cover the expense.

Some lawmakers have said the upheaval may have stemmed from inmate complaints about a lack of programing. Frakes promised inmates improvements but says they’ll take time.
