Police: 2 Brothers Arrested in Lincoln Sexual Assault Case

Jail-Bars-and-Cuffs_mediumLINCOLN, Neb. (AP) — Authorities say two Lincoln brothers have been arrested in the sexual assault of a 10-year-old girl.

The suspects, ages 22 and 32, were arrested Sunday morning.

According to Lincoln Police Investigator Troy Cockle, authorities believe the 22-year-old suspect has sexually assaulted the victim at least three times. He faces two counts of first-degree sexual assault of a child and one count of third-degree sexual assault of a child.

Cockle said police believe the 32-year-old brother has assaulted the girl on a weekly basis. The suspect faces one count of first-degree sexual assault of a child.

Both men are set to appear in court Tuesday.

Man Charged in 2009 Slaying at Northeast Omaha Home

OMAHA, Neb. (AP) — A 25-year-old man awaiting trial in two 2014 slayings has been charged again with fatally shooting one man and wounding another at a northeast Omaha store in 2009.

Police say Akeem Jones is charged with murder, assault and two weapons counts stemming from the March 11, 2009, shooting inside BJ’s convenience store. Twenty-two-year-old Gary Holmes died later and Rodney Smith, then 22, was hospitalized.

Jones was charged with the same crimes then, but a judge dismissed the case a year later when a key witness didn’t show up for a hearing.

Jones also is accused of killing Johnnesha Brown and her boyfriend, Stephen Arps, in November 2014. Jones has pleaded not guilty.

His attorney in the 2014 case didn’t immediately return a call Tuesday from The Associated Press.

Man Hospitalized After Fire Damages Grand Island Apartment

grand-island-fire-departmentGRAND ISLAND, Neb. (AP) — A man has been hospitalized after a fire that damaged an apartment in Grand Island.

The fire was reported around 11 p.m. Sunday at the Holiday Garden Townhouses. Grand Island Fire Chief Cory Schmidt says firefighters found the man near the doorway to the apartment, and he was taken to a hospital. The carcass of a dog was found inside the apartment.

Schmidt says the fire was contained to the apartment kitchen, but smoke reached other apartments as well, temporarily displacing the tenants.

The fire cause is being investigated.

Man Gets Probation for Crash Death of Gering Man

GERING, Neb. (AP) — A 22-year-old Mitchell man has been given two years of probation for the crash death of a Gering resident.

Michael Fiscus was sentenced on Monday in Scotts Bluff County Court. He’d pleaded no contest and was convicted of misdemeanor vehicular homicide. Prosecutors had lowered the charge in exchange for Fiscus’ plea.

Prosecutors say Fiscus caused the death of 36-year-old Seth Thompson. Thompson died in September 2014 after being injured in the Dec. 20, 2013, accident. Scotts Bluff County authorities say Fiscus didn’t halt at a stop sign as he drove west on a county road, and his vehicle struck a northbound vehicle driven by Dustin Beaudette, of Scottsbluff. Thompson was a passenger in Beaudette’s vehicle.

Nebraska Manslaughter Trial Delay for Woman Charged in Custer County Newborn’s Death

judgeshipBROKEN BOW, Neb. (AP) — A trial has been scheduled in April for an unlicensed midwife charged with manslaughter and other crimes in the 2011 death of a Nebraska newborn.

The trial of 68-year-old Judy Jones, of Irene, South Dakota, had been scheduled to begin next month. Custer County Attorney Steven Bowers asked for a delay, however, so evidence from a defense expert could be reviewed. The nonjury trial has been rescheduled to begin April 19.

Jones is charged with manslaughter, practicing without a license and criminal impersonation. Authorities have said Jones helped deliver a baby in rural Custer County home in September 2011, defying orders prohibiting her from practicing as a midwife in Nebraska and South Dakota. The infant died shortly after birth.

Nebraska Man Accused of Shackling Teen Pleads Not Guilty

gavel-and-scalePLATTSMOUTH, Neb. (AP) — A December trial has been scheduled for a 35-year-old eastern Nebraska man accused of shackling his teenage nephew to a bed to keep the boy from going out and misbehaving.

Cass County District Court records say Wade Merry, of Plattsmouth, on Monday pleaded not guilty to felony child abuse. His trial is set to begin on Dec. 2.

Police say the 14-year-old was shackled to the bed at least a dozen times. A court document says Merry told police he restrained the boy while Merry worked overnight shifts at a bakery. Merry says he was frustrated by the boy’s behavior problems.

Police say Merry gave the boy a cup in case he needed to use a bathroom while shackled.

Nebraska Senator Talks About State’s Death Penalty Repeal

RALEIGH, N.C. (AP) — A Republican legislator from Nebraska says North Carolina GOP lawmakers should consider abolishing the death penalty because the process is financially inefficient, subject to errors and does not give closure to victims’ families.

Nebraska Sen. Colby Coash visited the Legislative Building on Tuesday to talk about his experiences leading efforts this year to repeal capital punishment in his state. The group North Carolina Conservatives Concerned about the Death Penalty brought in Coash for Raleigh, Greensboro and Charlotte appearances.

Nebraska became the first traditionally conservative state to eliminate the punishment since 1973 when its legislature overrode the veto of Gov. Pete Ricketts.

Republican Rep. Jon Hardister of Greensboro also opposes the death penalty. Hardister says he hopes Coash’s visit will start discussions with fellow GOP lawmakers about repeal legislation.
