Sidney Police Chief Loses Appeal of Conviction, Sentence

judgeshipSIDNEY, Neb. (AP) — A judge has upheld the conviction and sentencing of a western Nebraska police chief who didn’t pursue a criminal case against a city official.

Court records say Judge Travis O’Gorman of Cheyenne County District Court on Tuesday rejected an appeal by Sidney Police Chief B.J. Wilkinson.

State prosecutors say Wilkinson failed to pursue criminal charges against city Public Works Director John Hehnke after Hehnke’s ex-girlfriend filed a complaint in January 2014 against Hehnke. The case came to the attention of state prosecutors, who later charged Hehnke.

Wilkinson’s attorney, Thomas Sonntag, said in court Monday that Wilkinson’s 30-day jail sentence was unfairly tough when compared to Hehnke’s $300 fine for disturbing the peace.

O’Gorman says Wilkinson abused his power by failing to uphold and enforce the law.

Woman Convicted of Vehicular Homicide in Lincoln

fatal-accidentLINCOLN, Neb. (AP) — A woman has been convicted in the crash death of an 81-year-old man in south Lincoln.

Online court records say sentencing is scheduled Dec. 4 for 51-year-old Laurie Clemans, who pleaded no contest on Tuesday and was convicted of misdemeanor vehicular homicide.

The accident occurred around 3 p.m. on March 30 at the intersection of Old Cheney Road and Nebraska Highway 2. Police say a car driven by Monty McMahon, of Lincoln, was struck by Clemans’ vehicle as Clemans tried to turn left. McMahon was pronounced dead at a Lincoln hospital.

Man Imprisoned for Unrelated Crime Faces Omaha Murder Charge

OMAHA, Neb. (AP) — Authorities say a man imprisoned for an unrelated kidnapping conviction faces a murder charge in Omaha.

Omaha police say an arrest warrant for first-degree murder and a weapons count has been issued for 24-year-old Kevin Mariscal. He’s in Tecumseh prison, serving 15 years for a 2010 kidnapping in Sarpy County. Online court records don’t list the name of an attorney who could be contacted to comment on behalf of Mariscal.

Mariscal is suspected of killing 50-year-old Barbara Gonzales, of Omaha. Her body was spotted in a south Omaha residential alley by teenagers walking a dog on July 6, 2010. She’d been shot with a handgun.

 

Northeast Nebraska Man Pleads Guilty to Cattle Thefts

CENTER, Neb. (AP) — A 44-year-old man is scheduled to be sentenced in November for stealing cattle from a feedlot in northeast Nebraska.

Timothy Ketelsen, of Bloomfield, pleaded guilty earlier this month to charges of tax evasion, theft and illegal sale of livestock. Prosecutors dropped five other charges in return for Ketelsen’s pleas. His sentencing is set for Nov. 24.

Court documents say Ketelsen’s former boss reported that 13 head of cattle had been stolen from the feedlot. Investigators traced the cattle to a livestock market in Yankton, South Dakota, which paid Ketelsen for them.

Investigators also say they found four other instances in which it appears Ketelsen stole cattle.

Man Pleads Guilty to Bilking $14M from Nebraska Medicaid

gavel-and-scaleLINCOLN, Neb. (AP) — A Lincoln pharmacist accused of defrauding Nebraska’s Medicaid program out of $14 million has pleaded guilty to health care fraud.

44-year-old Scott Tran pleaded guilty Tuesday. Prosecutors say the owner of Tran Pharmacy submitted hundreds of false claims for a solution used in inhalers for cystic fibrosis patients in the names of his customers’ children.

According to court documents, Tran submitted 399 claims for reimbursement between May 2009 and February 2015, stating they had been ordered by six Lincoln-area doctors identified only by their initials.

Tran also agreed to pay just over $14 million in restitution as part of the plea agreement. His sentencing hearing is scheduled for January.

Solo homers not enough for Royals in 4-2 loss to White Sox

kc-royalsCHICAGO (AP) — Eric Hosmer and Kendrys Morales homered and Johnny Cueto threw six quality innings, but the Kansas City Royals lost to the Chicago White Sox 4-2 on Tuesday night.

Offense Getting Ready to Take on Illinois

Lincoln  – The Nebraska football team practiced for 90 minutes Tuesday afternoon. The offense practiced outside on the Ed and Joyanne Gass Practice Field, while the defense practiced inside the Hawks Center.

Keystone XL Developer Drops Nebraska Landowner Lawsuit

keystoneLINCOLN, Neb. (AP) — The developer of the Keystone XL pipeline is reversing course in Nebraska and will drop its eminent domain lawsuits against landowners who don’t want the pipeline running through their property.

TransCanada Inc. announced Tuesday that it will stop pushing for the project under a state law that’s now being challenged in the courts.

The company says it will instead seek approval through the Nebraska Public Service Commission, an agency that regulates pipelines, warehouses and grain bins.

TransCanada won approval from former Gov. Dave Heineman, but the state law that allowed him to do so remains mired in court. TransCanada spokesman Mark Cooper says the company believes that applying through the commission will reduce the local conflicts.

Jane Kleeb, a leading pipeline opponent, says the company was losing ground in Nebraska.

Arrest Made in NP Pipe Bomb Case

North Platte Police say they have made an arrest after a North Platte man was seriously injured by a homemade explosive device.

At around 1:00 a.m., on September 15, officers with the North Platte Police Department responded to the emergency room at Great Plains Health, where a 24-year-old male was being treated for a serious injury to his hand.  Staff at the hospital told police the injury was caused by a homemade explosive device.

Officer met with the victim, who told them that he and another 26-year-old male had been riding in a van with Daniel Smith.

The victim alleged that as they traveled down East Philip Street, in between Bicentennial Street and Newberry Access, Smith lit the fuse on a pipe bomb type explosive device and handed it to him.

The victim said Smith told him to throw it out the window of the vehicle.

According to the victim, and the other passenger, the device exploded before the victim was able to throw it out the window, instead, police say the device detonated in the victim’s hand, causing serious injury to his hand and wrist.

Smith then transported the victim to the hospital and fled the scene.

Officers soon located the vehicle, which had sustained damage to the windshield and several other areas, and towed it to a secure facility.

On September 28, an officer met with Smith, who was being held at the Lincoln County Detention Center on unrelated charges, and questioned him regarding this case.

After further investigation, Smith was arrested and charged with felony 2nd-degree assault and felony use of an explosive device to commit a felony.

Smith remains in custody at the LCDC
