Nebraska Man’s Murder Conviction, Sentence Upheld on Appeal

 De'Aris Trice
De’Aris Trice

LINCOLN, Neb. (AP) — The Nebraska Supreme Court has upheld the second-degree murder conviction and lengthy sentence of a Norfolk man for the fatal 2010 stabbing of another man.

The high court’s opinion Friday was the second appeal by De’Aris Trice. Trice was first convicted and sentenced in 2013 for the stabbing death of 27-year-old Timothy Warren at a Norfolk house party. But the state Supreme Court ordered a new trial, citing problems with jury instructions.

Trice was again found guilty in 2014 and sentenced to 40 years to life in prison.

In his latest appeal, Trice argued the trial court was wrong to allow transcripts of statements from some witnesses into evidence. He also said his sentence is excessive.

The high court said it found no evidence that the trial court acted wrongly.

2 Bellevue Schools Briefly Evacuated Because of Gas Smell

highschoolBELLEVUE, Neb. (AP) — Authorities say two schools in an Omaha suburb were briefly evacuated because people smelled what they thought was natural gas.

Bertha Barber Elementary and Mission Middle School in Bellevue were emptied around 9 a.m. Thursday as utility workers arrived to check on the reports. The workers gave the all-clear within an hour, so students and staffers returned to the school buildings.

A district spokeswoman didn’t immediately return messages from The Associated Press Friday.

Lincoln Company Faces Penalties for Worker’s Fatal Fall

OSHALINCOLN, Neb. (AP) — Federal safety regulators have proposed $36,000 in penalties for a Lincoln construction company that employed a worker who fell to his death while installing roofing.

The Occupational Safety and Health Administration says the company didn’t provide required fall protection that the agency says would have saved the man’s life.

The agency cited Custom Contracting Inc. for six serious safety violations. A company representative didn’t immediately return a call Friday from The Associated Press.

The accident occurred Oct. 24 in Raymond. The agency says two workers were installing metal roof sheets on a structural steel building when one of the workers stepped into an opening created by the removal of one of the sheets.

Nebraska Judicial Branch Told to Release Training Documents

judicial-branchLINCOLN, Neb. (AP) — A district judge has told the Nebraska Judicial Branch to release documents on how judges are trained to handle child custody disputes.

A Lincoln doctor requested the records in May. Dr. Les Veskrna is executive director of the Children’s Rights Council of Iowa and Nebraska, and he says he has concerns that the information used to train judges.

The Nebraska court administrator denied Veskrna’s request, saying the records weren’t subject to disclosure under state public records law.

Veskrna sued for the release of the documents, and earlier this month the judge ruled that most of the documents are public records and must be released.
