Omaha Public Schools Settles Drowned Student Case for $250K

omaha-psOMAHA, Neb. (AP) — The Omaha Public Schools board has approved a $250,000 settlement with the mother of seventh-grader who drowned at a middle school in 2014.

The district voted in favor of the settlement Monday night.

Demariont’e Brown-Elliott was found in Nathan Hale Middle School’s pool during gym class in November 2014.

Adrienne Elliott filed a $1 million claim against the district last January, alleging that her 12-year-old son died because of negligence by district employees and administrators who failed to ensure student safety and properly supervise the swim class.

The district admits no wrongdoing or liability in the settlement, which also bars Elliott and her attorneys from speaking publicly about the claims.

The district also agreed to pay $5,000 for the boy’s funeral services.

Suspect Arrested in Lincoln Murder

On January 4, 2016, at 11:35 a.m., members of the Lincoln Police Department and Lincoln Fire & Rescue responded to the report of shots fired and a man injured in the 1300 block of N. 20th Street.

Officers found 27-year-old James William Carr lying in front of 1337 N. 20th Street, with multiple gunshot wounds. He was declared deceased at the scene. It is not known how many times James Carr was shot. An autopsy has been scheduled for January 5, 2016.

Through further investigation, 24-year-old Matthew Pavey was developed as a suspect. He had been talking outside with the victim just prior to the shots. The two men have had an on-going feud with one another. Matthew Pavey taken into custody at 2:30 p.m. at a residence in the 2900 block of S. 11th Street. He was later arrested for 1st degree Murder and Use of a Weapon to Commit a Felony. He was lodged at the Lancaster County Jail.

Early Morning Dope Break Leads to Felony for NP Man

A North Platte man is facing a felony drug charge after he was caught using drugs near some storage units.

At around 3:00 a.m., on January 5, an officer observed a car with out-of-state plates parked with its headlights on in between some storage units in the 3000 block of South Willow Street.

The officer approached the vehicle and observed a person, later identified as Cole Hoop, sitting in the driver’s seat.

According to Investigator John Deal, the officer asked Hoop what he was doing the he gave an answer that “didn’t make sense.”

Through his investigation, the officer learned that Hoop was on probation with a search clause.

Officers searched the vehicle and located numerous items of drug paraphernalia, including a scale, plastic straws, and numerous small ziplock baggies.

One of the baggies contained a white crystal substance which field-tested positive for methamphetamine.

As a result, Hoop was placed under arrest and jailed on a charge of felony possession of a controlled substance with intent to deliver.

Hoop is being held at the Lincoln County Detention Center.

Suspect Arrested in Lincoln Gun Death, Police Say

lincoln-policeLINCOLN, Neb. (AP) — A 24-year-old man has been arrested in Lincoln, suspected of shooting to death another man who police say died in an alley.

Authorities say police officers and medics were dispatched around 11:35 a.m. Monday to the report of a shooting. They found the wounded man in the alley just east of the University of Nebraska-Lincoln’s City Campus. He was pronounced dead there.

Police say witness statements led officers to the man, who was arrested Monday afternoon.

Online court records don’t show that the man has been charged yet.

Authorities ID Nebraskan Who Died After ATV Fell Through Ice

madison-county-sheriffNORFOLK, Neb. (AP) — Authorities have released the name of a 57-year-old man who died after his all-terrain vehicle broke through ice on a pond in northeast Nebraska.

On Monday the Madison County Sheriff’s Department identified him as Randall Simpson, of rural Norfolk. Rescuers pulled him from the pond late Saturday afternoon. He was pronounced dead later at a hospital.

Authorities say Simpson was unable to get his seat belt disconnected as the ATV sank into the icy water.

Nebraska Lottery Tops $581 Million to Beneficiary Funds

nebraska-lotteryLINCOLN, Neb. (AP) — Five state programs will benefit from nearly $9 million received from the Nebraska Lottery this week.

The Nebraska Lottery distributed $8.9 million from Scratch and Lotto sales the week of Jan 1.

According to percentages established by Nebraska voters in 2004, the Nebraska Environmental Trust Fund received 44.5 percent, the Nebraska State Fair Support and Improvement Fund received 10 percent and the Compulsive Gamblers Assistance Fund received 1 percent.

The remaining 44.5 percent was directed toward education and split between the Education Innovation Fund and Nebraska Opportunity Grant Fund, which provides financial aid to undergraduate college students.

Nearly $582 million has been distributed in quarterly transfers since the Nebraska Lottery began operation on Sept. 11, 1993.

Karen Elaine Svejkovsky, age 35, of North Platte, NE, died unexpectedly at home on Friday, January 1, 2016.

Karen was born January 15, 1980, to Fredrick Glen and Velda Joanne Schrayer Emert at Geneva, NE. She grew up and attended school in North Platte and later married Dave Nowatzke.

Karen worked as a telemarketer for five years then worked a couple years at the Opportunity Center as a support worker. She later stayed home to care for her daughter, Morgan.

On May 9, 2014, Karen was united in marriage to Kip Alan Svejkovsky at North Platte where they made their home. Karen grew up in the United Methodist Church and attended the Harvest Christian Fellowship. She supported the National Federation for the Blind and did lots of driving and support work. She also liked to read.

Karen leaves behind her husband, Kip, daughter, Morgan Nowatzke, and mother, Joanne Emert, all of North Platte; her father, Glen (Linda) Emert, of Broken Bow, NE; father and mother-in-law, Pat and Janice Fitzpatrick, of Butte, MT; sisters, Joy (Bobby) Martin, of Inola, OK, Kelle (Merlin) Dikeman, of North Platte, Bernice (Terry) Holland, of Willimson, GA; step siblings, Kevin (Mary Ann) Miller, of Hermitage, MO, Kent (Glenda) Miller, of Sandborn, IA, and Karma (Ronnie) Reed, of Wiley, CO; brothers-in-law, Ken (Tag) Svejkovsky, of Vancouver, Canada, and Kerry (Susan) Svejkovsky, of Sutherland, NE; and other family.

She was preceded in death by her stepmother, Janelle Emert.

Cremation was chosen. Memorial Service will be 10:30 a.m. Wednesday, January 6, 2016, at Odean Colonial Chapel at C & Sycamore. The memorial book may be signed at odeanchapel.com or from 9 a.m. to 6 p.m. Tuesday at Odean Colonial Chapel at C & Sycamore which is in charge of arrangements. Memorials are suggested to the National Federation for the Blind or the donor’s choice.

Lincoln Police Investigate Shooting Death of Man

crime-scene-police-shootLINCOLN, Neb. (AP) — Lincoln police are investigating the shooting death of a man just east of the University of Nebraska-Lincoln’s City Campus.

Officer Katie Flood says officers were dispatched to check a report of a shooting at 11:35 a.m. Monday. The man was pronounced dead at the scene.

Flood says officers are poring over the neighborhood, looking for witnesses and evidence. She would not confirm that the man was a homicide victim.

No arrests have been reported.

University police urged students and staffers to avoid the area during the city officers’ investigation.

Report: Nebraska Overuses Solitary Confinement for Juveniles

juvenile-justiceLINCOLN, Neb. (AP) — A new report says Nebraska is overusing solitary confinement on juveniles and warns that policies on how it is enforced vary widely throughout the state.

The report released Monday by the ACLU of Nebraska says some juveniles have been placed in isolation for minor rule violations, such as talking back to staff members, having too many books or refusing to follow directions.

The group also found that the maximum lengths of time in solitary differ by facility, from a little as five days to as many as 90.

National child psychiatry groups have warned that prolonged stays in solitary confinement do more harm than good for juveniles.

The ACLU of Nebraska report was based on record requests filed with each of the state’s nine juvenile detention centers.
