Man Gets 3 Years for Strangulation Conviction in Nebraska

jailBEATRICE, Neb. (AP) — A 52-year-old Beatrice man convicted of strangulation has been given three years in prison.

Leon Williams was sentenced Wednesday in Gage County District Court. Williams had pleaded no contest to the charge. Prosecutors dropped a charge of domestic assault in exchange for Williams’ plea.

A court document says his fiancée told an officer on Nov. 2 that Williams had been drinking when he forced her down on a bed and put his hands on her face and neck. She grabbed a hammer in an attempt to get free, and he released her to grab it and throw it in a corner of the bedroom.

Nebraska Woman Pleads Not Guilty to Child Pornography, Abuse Charges

gavel-and-scaleWAYNE, Neb. (AP) — A 32-year-old Wayne woman has pleaded not guilty to child abuse and child pornography charges.

The woman entered her pleas Wednesday in Wayne County District Court. Her trial is scheduled to begin April 11.

She was arrested in December. Nebraska State Patrol investigators allege the woman “traded or provided to another visual depiction of sexually explicit conduct with a child.” The child is 3 or 4 years old.

To protect the child’s privacy, The Associated Press is not using the woman’s name.

UNL Students Plead No Contest in Alcohol Death Case

farmhouse-fraternityLINCOLN, Neb. (AP) — University of Nebraska-Lincoln fraternity members accused in the alcohol death of another member have pleaded no contest to lesser offenses.

According to court records, 20-year-old Thomas Trueblood, 23-year Ross Reynolds and 23-year-old Cory Foland each pleaded no contest Wednesday to misdemeanor alcohol procurement charges.

Eighteen-year-old Clayton Real was found dead at the FarmHouse Fraternity house in 2014. Affidavits show he died of acute alcohol intoxication. Affidavits in the case say fraternity members threw a party the night before and provided alcohol to underage attendees, including Real.

The three men were initially charged in 2014 with felony counts of procuring alcohol for a minor resulting in death. They each face up to a year in jail. Their sentencing hearing is set for April 25.

Nebraska Child Welfare Groups Seek Religious Exemption

gaymarriageLINCOLN, Neb. (AP) — With Nebraska’s ban on gay foster parents no longer in place, Christian placement agencies say they might be forced to choose between their religious beliefs and state funding.

A legislative committee heard testimony Wednesday on a bill that would shield those agencies from state retaliation if they refuse to license gay, lesbian, bisexual or transgender foster parents on religious principle.

Christian placement agencies say the measure would protect their right to continue offering support services to a specific religious demographic without fear of losing state contracts.

But opponents say the sweeping religious exemption opens the system to broad discrimination and hinders the state’s ability to find homes for more than 3,000 foster children.

Judge in Omaha Removes Himself from Ex-Doctor’s Murder Trial

OMAHA, Neb. (AP) — A county judge in Omaha has removed himself from a murder trial involving a former doctor accused of killing four people with ties to an Omaha medical school.

Douglas County District Judge Duane Dougherty removed himself from Anthony Garcia’s murder trial due to health reasons during a Wednesday afternoon court hearing.

Judge Gary Randall will now be assigned to the case.

Garcia is charged with first-degree murder in the 2008 deaths of Thomas Hunter, the 11-year-old son of Creighton University pathologist William Hunter, and Shirlee Sherman, the family’s housekeeper, as well as the May 2013 deaths of Creighton pathologist Roger Brumback and his wife, Mary.

His trial was previously set to begin on April 4 but will likely be delayed.

Senators Wade Into Debate Over Nebraska Oil, Gas Regulations

oil-rigLINCOLN, Neb. (AP) — An effort to impose new regulations on Nebraska’s oil and gas industry is drawing support from environmental advocates but opposition from company officials, who say the proposals are unnecessary and redundant.

The bills presented to a legislative committee on Wednesday were introduced following public complaints about a Colorado energy company’s plan to discard oil and natural gas wastewater underground in northwest Nebraska.

One measure would require companies to carry at least $1 million in liability insurance for injection and disposal wells and at least $5 million for any site that disposes of more than 500 barrels of wastewater a day.

A second bill would require disclosure of a well’s location to nearby local governments and periodic testing at each site, among other requirements.

Toyota Recalls Over 1.1M SUVs for Possible Seat Belt Failure

toyota-featureDETROIT (AP) — Toyota is recalling more than 1.1 million small SUVs in the U.S. because the seat belts might fail in a crash.

The recall covers RAV4 SUVS from the 2006 through 2012 model years, as well as the RAV4 electric vehicle from 2012 through 2014.

Toyota says it’s possible that the belts in both second-row outside seats could come in contact with the metal seat cushion frame in a severe frontal crash. If that happens, the belts could become cut and would not restrain passengers.

The company says it will add plastic covers to the seat cushion frame at no cost to owners. It was unclear when the recall would begin.

Tobacco-Free Policy Approved for Outdoor Spaces in Columbus

no-smokingCOLUMBUS, Neb. (AP) — The Columbus City Council has unanimously approved a measure to cut down on youth’s exposure to tobacco use and secondhand smoke.

The policy, which isn’t backed by potential legal ramifications or fines, places a tobacco-free designation on park areas where children are frequently present.

These spots include playgrounds, picnic shelters, athletic fields and courts, concession stands and spectator viewing areas.

The local health department will provide signs for tobacco-free areas, and the city will rely on citizens’ good conscience and peer pressure to enforce the policy.

Councilman Terry Reardon says that the policy is a way for citizens to be respectful of one another without adding a burden to the local police department.

Health department officials say 18 other Nebraska communities have similar policies.

Nebraska Game and Parks Commission Member Beggren Dies

Nebraska_game_and_parksBROKEN BOW, Neb. (AP) — A member of the Nebraska Game and Parks Commission has died.

Pat Berggren tells Lexington says his father, commission member Lynn Berggren, collapsed Tuesday while hunting with another of his sons, Kevin. Lynn Berggren was pronounced dead at a Lexington hospital. He was 65.

Commission Director Jim Douglas said Wednesday that Lynn Berggren was entering his eighth year on the commission, representing north-central Nebraska. He had also operated a construction company in Broken Bow, Berggren Home Builders

His son, Pat, says his father was passionate about what Nebraska offered in public hunting, fishing and outdoor activity and that “he promoted it, he lived it.”
