Lexington Lawsuit Alleges Mosque Violates Zoning Rules

ne-supreme-court-gavelLEXINGTON, Neb. (AP) — The city of Lexington has sued the local mosque, saying it’s been violating city zoning ordinances.

The lawsuit against the Islamic Center was filed Friday. The center wants to renovate the property it occupies and an adjacent building. The city says a certificate of occupancy hasn’t been obtained and a conditional use permit is required before the property can be used as a church.

On Wednesday the American Civil Liberties Union of Nebraska told the city that the City Council violated the religious rights of Muslim residents by voting Dec. 22 to deny a permit to expand the Islamic Center. ACLU of Nebraska says the permit denial also violates federal law.

The Islamic Center’s attorney, Claude Berreckman Jr., says his clients are disappointed by the city’s action and the lawsuit.

Nebraska Net Tax Receipts Higher Than Expected in January

ne-department-of-revenueLINCOLN, Neb. (AP) — Nebraska’s net tax receipts were slightly higher than estimated in January.

The Department of Revenue said Wednesday that the state collected $372 million, which is nearly 2 percent higher than the certified forecast of $366 million.

Net individual and corporate incomes taxes were higher, as were net sales-and-use taxes. Net miscellaneous taxes were lower than projected.

The comparisons are based on the forecast made by the Nebraska Economic Forecasting Advisory Board in October. During that meeting, the board revised its current fiscal year forecast down by $70.9 million.

The forecasts play a key role in the state budget, determining how much money lawmakers have at their disposal. The forecasting board will meet again near the end of this month.

Youth Baseball Coach Convicted of Groping 2 Boys in Lincoln

LINCOLN, Neb. (AP) — A 34-year-old youth baseball coach has been convicted of sexually assaulting two boys in Lincoln.

Online court records say a jury took about four hours Tuesday to find Jeff Hawks guilty. His sentencing is set for March 22.

Prosecutors say Hawks groped one boy during a private training session and groped another 12-year-old boy after wrestling with him.

Hawks denied touching either boy intentionally.

Woman Sentenced in Fatal Eastern Nebraska Hit-and-Run

PLATTSMOUTH, Neb. (AP) — A 30-year-old woman convicted in a fatal hit-and-run collision in eastern Nebraska has been sentenced to eight to 10 years in prison.

Mandy MacDonald was sentenced Tuesday. MacDonald pleaded no contest in November to motor vehicle homicide and a felony count of leaving the scene of an injury accident. She will receive credit for 255 days served in jail.

Authorities say MacDonald lost control of her car on May 31 near the Interstate 80 Greenwood exit and collided with another westbound vehicle. That vehicle went into a roadside ditch and rolled, ejecting its driver, 50-year-old Kristin Olson of Grand Island.

Authorities say MacDonald fled the scene, but was stopped by a state trooper a few miles west of the collision.

Farmers, Schools at Odds Over Ricketts Tax Plan

taxesLINCOLN, Neb. (AP) — Gov. Pete Ricketts property tax plan is drawing praise from Nebraska’s farming community and opposition from school officials, who would face new restrictions on their budget authority.

Both sides argued their case Tuesday to the Legislature’s Education Committee, which is reviewing one of two bills introduced on the governor’s behalf.

Farmers testified that property taxes have increased even though the economy has weakened. School officials say the state should increase its funding for K-12 education.

Sen Kate Sullivan of Cedar Rapids says the measure she introduced is reasonable, doable and not overly intrusive.

Ricketts says the bill strikes a balance because some farmers and ranchers believe it doesn’t do enough, and some school officials say it’s too burdensome.

Carol Ann Bender, 67, of North Platte passed away February 8, 2016 at Great Plains Health.
She was born in Scottsbluff, NE on December 16, 1948 to Rueben and Rose (Reizenstein) Wiege. Carol grew up in various towns, finishing her high school career at North Platte High School. She married Gary Ridinger on July 7, 1968 in North Platte. The couple lived in various places due to Gary’s Army Career before settling in Big Springs, NE. Carol started her upholstery business in 1973, attending classes and taking much pride in her work. She and Gary moved to North Platte to further her career leading to them opening Carol’s Upholstery. To their union two daughters were born, Tammy and Joy.
Carol married Ervin P. Bender on September 29, 1983 in North Platte. She attended Harvest Christian Fellowship. She loved flowers and gardening, enjoyed playing pool and was on two leagues, was captain of her teams and acquired MVP status. Carol participated in Bunco, enjoyed WWE Wrestling, especially John Cena and Roman Reigns. She loved her pets, dancing and music, junk shopping, and having dances at her home for her friends and daughters. She especially enjoyed spending time with her daughters and family.
Survivors include daughters, Tammy Kimminau of Mishawaka, Indiana and Joy (Troy) Epler of North Platte, Nebraska; grandchildren, Jordan May, Jared May, Anthony Epler, Isaiah Epler, Gracie Epler, and Josiah Epler; great-grandchild, Kennedy May; sister, Judy (Daniel) Fegler of Oregon City, OR; several other family members and many friends.
She was preceded in death by her parents.

Disturbance Involving Panhandlers at NP Walmart Leads to High Speed Chase

Two people are in custody and facing charges after an exciting series of events on Tuesday afternoon in North Platte.

At around 3:43 p.m., the North Platte 911 Center received a call from management at the Walmart Super Center, 1401 South Dewey Street, stating that a male and female were panhandling on their property.  Management told dispatchers that they had asked the couple to leave, but they became confrontational.

An officer arrived and made contact with the male subject, 58-year-old Anthony L. Lack.

According to Lieutenant Steve Reeves, Lack was placed under arrest for 2nd-degree criminal trespassing, for disobeying management’s request that they leave, and placed in the back of a patrol car.

The officer then began to deal with the female subject, 40-year-old Anita V. Lack, who was not only refusing to leave the property but was also threatening to harm one of the managers, according to Reeves.

As the officer placed Anita under arrest for 3rd-degree assault and 2nd-degree trespassing, Reeves says Anthony was able to get his hands in front of his body by slipping his feet through the handcuffs, thus allowing him to escape from the patrol vehicle.

Police say Anthony was able to get into his older model Dodge van and flee the area.

With officers in pursuit, Lack traveled west on Leota Street, through the Great Plains Health parking lot, then back eastbound on Leota.  Lack then allegedly traveled southbound on Highway 83 before coming to a stop at Halligan Drive.

As officers approached the vehicle, Lack again sped off and headed west on South River Road, then south on Buffalo Bill Avenue, reaching speeds of 60-70 mph.

According to Reeves, an officer deployed a spike strip at Buffalo Bill and Walker Road and was able to flatten at least one of the van’s tires.

Police continued to pursue Lack to the intersection of State Farm Road and Buffalo Bill, where the vehicle became disabled.

Officers were able to take Lack into custody and, once again, detain him.

In addition to the original charges, Anthony Lack was also charged with willful reckless driving, flight to avoid arrest and resisting arrest. Reeves says a criminal history check of Anthony may result in some of the charges being enhanced to felonies.

The North Platte Police Department, Nebraska State Patrol, and Lincoln County Sheriff’s Office were all involved in the pursuit.
