Man Who Killed Blair Woman as Teenager Resentenced in Case

gavel-and-scaleOMAHA, Neb. (AP) — A judge has imposed the same sentence on the second man who as a teenager raped, robbed and bound a Blair woman in a car, which was sent hurtling into the Missouri River.

A judge sentenced 49-year-old Brian D. Smith to 90 years to life in prison Monday for the January 1983 crime that led to the death of 21-year-old Mary Jo Hovendick.

It was the same sentence given to 50-year-old Dale Nollen last month.

The men initially were sentenced to life in prison in May 1983. The new sentences were prompted by a U.S. Supreme Court ruling that says judges must have the ability to sentence juveniles to something other than an automatic life term.

The men will be eligible for parole in 12 years with credit for time already served.

Lincoln – Jessica Shepard scored 20 points, Natalie Romeo added 19 and Anya Kalenta pitched in her first career double-double off the bench as Nebraska ran to an 87-69 women’s basketball win over Penn State on Tuesday night at Pinnacle Bank Arena.

Snow Storm Forces Closure of Stretch of I-80 in Nebraska

snowstormOMAHA, Neb. (AP) — Heavy snow and strong winds forced officials to close more than 100 miles of Interstate 80 in eastern Nebraska because of dangerous conditions Tuesday.

The Nebraska Department of Roads closed I-80 from Lincoln west to Elm Creek because of the hazards.

In western Nebraska, Interstate 76 was also closed between I-80 and I-70 in Colorado.

Several smaller highways in southwest Nebraska are also closed leading into Kansas.

Officials say the wind and snow are creating blizzard conditions across much of the state. So officials are not recommending travel across most of Nebraska.

Sidney J. Kibler, Jr.

sidney-kiblerSidney J. Kibler Jr. (Papa Sid), age 56, of Council Bluffs, Iowa passed away Sunday January 31, 2016, at his residence.

Sidney was born June 14, 1959, in LaJunta, Colorado, to the late Sidney J. Sr. and Polly Porter Kibler. He grew up in North Platte, Nebraska.  He was an Electrician for IBEW.

Survivors include daughter, Kacie Kibler and her daughter, Alina, of Council Bluffs;  former wife, Brenda Kibler, of North Platte; brothers, Rusty (Brenda) Huff, of Gothenburg, Neb., Jim Huff, of Tenn., Jay Huff and Sam Kibler, both of North Platte; sister, Paula (Tom) Richardson, of Nevada.

Visitation Thursday, 6 p.m. to 8 p.m., at Cutler-O’Neill-Meyer-Woodring Bayliss Park Chapel in Council Bluffs, Iowa. Cremation will follow the visitation.

Report: DOJ Should Track Its Monitoring of Marijuana Legalization

marijuana-budWASHINGTON (AP) — The Government Accountability Office says the Justice Department needs to better document how it’s tracking the effect of marijuana legalization in the states.

In a report Monday, investigators noted that the DOJ said in 2013 it would allow states to regulate marijuana for medical or recreational use, as long as they meet federal law enforcement priorities that include keeping pot away from children and keeping criminal organizations out of the industry.

But, the GAO said, the government isn’t documenting how it is making sure states meet those priorities. The report recommends that the Justice Department start doing so, which will put it in better position to identify states that aren’t meeting federal pot enforcement priorities.

The DOJ said it agrees with the recommendations.

Four states — Colorado, Washington, Oregon and Alaska — and the District of Columbia have legalized recreational pot use.

Union: Longevity Raises Would Reduce Problems in Agencies

ne-legislature-13LINCOLN, Neb. (AP) — Union officials say Nebraska could avoid many of the recent problems in state agencies by rewarding employees with experience and institutional knowledge.

Workers’ advocates urged a legislative committee Monday to advance a bill that would offer longevity raises.

The measure by Sen. Matt Hansen of Lincoln would begin with a pay increase of 6.25 cents per hour, or about $130 a year for salaried employees, after five years. The raise would increase every five years by the same amount, to a maximum of 50 cents per hour at 40 years.

Hansen says more than a dozen states set longevity pay in law.

Opponents say the bill could be unconstitutional because state wages are set through collective bargaining with the executive branch and not state law.

Vernon George Yanney

Vernon George Yanney, 88, passed away on January 29th, 2016, after being in declining health for many years. Vernon was born on July 6, 1927, to Elias K. Yanney and Mary H. (Abraham) Yanney in Kearney, Nebraska.
He graduated from Kearney High School in 1945. Vernon was a life-long drummer, and as young man was a member of the American Legion Drum and Bugle Corps. They won state competition to represent Nebraska in national competition in New York City. Vernon won national awards as a drummer.
He was drafted into military service shortly after graduating from high school. Vernon served in the Army Air Corps in the Pacific Theater from 1945-1946, serving as a teletype operator for most of that time.
Upon returning from his military service, Vernon enrolled in what was then Kearney State Teacher’s College, and obtained his B.A degree in Education in 1950, and later his Master’s Degree in 1958. He completed his Specialist Degree in Educational Administration at the University of Nebraska-Lincoln, in 1965.
Vernon married Lena K. Jacob on October 19, 1952 at St. George Orthodox Church in Kearney.
Vernon worked for Safeway Stores in Kearney from 1950-1953. He and Lena then moved to Aurora, Nebraska where he worked for Metropolitan Insurance Company for one year. He then obtained a teaching position in Red Cloud, Nebraska, and they lived there for the next two years. Their daughter, Brenda, was born in Red Cloud, shortly before they moved to North Platte.
Vernon came to North Platte as a High School teacher, and later guidance counselor. He taught History and Driver’s Education from 1956-1962. He was appointed principal of the “new” Madison Junior High in 1962, and served in that capacity until his retirement in 1989. Their son, Wayne, was born during Vernon’s first year at Madison. Vernon also taught night classes at North Platte Junior College when it was in its infancy.
Vernon was active in many church, civic, and professional organizations throughout his life. He was a Past President of Nebraska Schoolmasters’ Club, Past President of North Platte Area Retired Teachers Association, and served on the Alumni Board of Directors of the University of Nebraska at Kearney. He was proud member of the Buffalo Bill Kiwanis Club, and received the Kiwanian of the Year Award for 1990-1991.
Vernon was a member of the First United Methodist Church of North Platte. Prior to moving to North Platte, he was a member of St. George Orthodox Church in Kearney, which was founded by his grandfather, Nicola Yanney.
One of the highlights of his career was when former Mayor Jim Kirkman and the City Council declared April 29th, 1988 as V. G. Y Day in recognition of his serving as Madison’s first and only principal for 25 years. Vernon received numerous awards from education associations throughout his career.
Vernon’s favorite hobby was gardening, and another significant highlight in his life was being recognized as having the Yard of the Week in August of 1990. After his retirement, he was very active with the Lincoln County Historical Society and Museum.
Vernon was preceded in death by his parents, sisters Martha Abraham and husband, George, Madeline Shada and husband Eli, Margaret Shada and husband Mike, and Minnette Steinbrink, along with brother Harvey Yanney, and brother E.K. Yanney and wife, Shirley.
He is survived by his wife, Lena, son Wayne of North Platte, daughter Brenda of Blue Springs, MO, sister, Milly Shada of Omaha, brother, Michael Yanney of Omaha, brother-in-law Paul Steinbrink of Kearney, sister-in-law Shirley Jacob of Casper, WY, several nieces and nephews and their families, and many cherished friends.
Visitation will be at Carpenter Funeral Home Thursday, February 4th, 8:30 am-8:00 p.m., with family present from 3-5 p.m. Graveside service will be at Kearney Cemetery, Kearney, Nebraska on Friday, February 5th at 2:30 p.m. Memorial Service on Saturday, February 6th at 10:30 a.m. at First United Methodist Church in North Platte.
Memorial contributions are suggested to First United Methodist Church in North Platte, Lincoln County Historical Museum, St. George Orthodox Church in Kearney, or Yanney Heritage Park in Kearney.

Danny Gene Pinkerton

Danny Gene Pinkerton, age 69, of Irvine, CA, formerly of North Platte, NE, passed away at home on Thursday, January 28, 2016, after a battle with cancer.

Danny was born January 12, 1947, to Gene and Margie Clark Pinkerton at Lexington, NE. He grew up in the Lexington and Cozad area before the family moved to North Platte. Danny graduated from high school in 1965 then joined the U.S. Navy in July and served in Vietnam.

Following his discharge in 1969, Danny returned to North Platte and married Betty Jane Naranjo. They had three children and eventually moved to Fort Collins, CO and later divorced. When he returned from the service, Danny hired on with the Union Pacific Railroad and worked there for 22 years, becoming Yard Master then Conductor.

On July 7, 2000, Danny was united in marriage to Peggy Irene Hampton at Santa Anna, CA and they lived in Denver, CO before moving to California. Danny was employed as a Financial Advisor then a Mortgage Banker before he retired in 2006.

Danny enjoyed cooking, fishing and spending time with his family.

He leaves behind his wife, Peggy, of Irvine, CA; his children, Michal (Jackie) Pinkerton, of North Platte, Melissa (Robert) Gardner, of Fort Collins and Melinda ‘Mindy’ (Bruce) Kennie, of Louisville, CO; nine grandchildren, Miranda (Richard), Quintin, Alexis ‘Lexi’, Hayden, Zachary, Amelia, Emily, Sierra and Logan; two great-granddaughters, Ava and AnnaBelle; two brothers, JR Pinkerton, of Aberdeen, TX, and Tim (Heather) Pinkerton, of Portland, OR; sisters, Linda (Dan) Carroll, of Amarillo, TX, and Phyllis (Joe) Capparelli, of Nassau, NY; mother and father-in-law, Esther and Bruce Hampton, of McCook, NE; sister-in-law, Pam (Heinz) Wallace, of Junction City, KS; and many nieces, nephews and other family.

Danny was preceded in death by his parents, Gene, Sr. and Margie; and five brothers, baby Michal and Kenneth, ‘Roger’ Rocky, Jay and Alan Pinkerton.

Funeral Service will be 10 a.m. Friday, February 5, 2016, at Odean Colonial Chapel at C & Sycamore with Chaplain Gary Smith officiating. Burial with military honors will follow in Fort McPherson National Cemetery. Visitation will be 9 a.m. to 7 p.m. Thursday at Odean Colonial Chapel at C & Sycamore which is in charge of arrangements.
