Dismissal of Lawsuit Against Nebraska in Jenkins Cast Upheld

OMAHA, Neb. (AP) — The Nebraska Supreme Court has upheld the dismissal a lawsuit that faulted Nebraska prison officials for releasing an inmate who later shot and killed four Omaha residents.

The decision came in the case of Shamecka Holloway, who says she was shot by Nikko Jenkins on Aug. 24, 2013.

Jenkins has been convicted of four counts of first-degree murder for the shooting deaths of four people in the weeks before Holloway was shot. The shootings occurred after Jenkins was released from prison on July 30, 2014.

Holloway’s lawsuit said prison officials should have known Jenkins posed a danger to others if released.

But the high court Friday agreed with a judge who said state officials had discretion in determining when to release Jenkins and in choosing not to civilly commit him.

Mix 97 One, Q country 107.3, ESPN Radio 1410AM and the North Platte Post had a Community Day the Dr. Seuss Way event this past weekend, a fundraiser for the North Platte Public School Foundation.

On Saturday, March 5th the Saturday after Read Across America week was celebrated in the North Platte Public Schools Eagle Radio celebrated as a community to encourage reading and fun for families.

“We had multiple sponsor booths, Nebraskaland National Bank was grilling hotdogs for a free will donation, a Dr. Seuss movie was provided along with popcorn from H&R Block and the Pop Corner, and reading was provided by Bible Supplies,” says Olivia Brown, sales manager at Eagle Radio.

“It’s important to support our community that we live in and host fun events for families,” Brown added.

The Day was a huge success with almost 400 kids in attendance and plenty of money raised for the public school foundation.

After the event, the funds were gathered from our sponsors, as well as from donation jars set up around the McKinley Education Center and a check was presented Thursday afternoon at the McKinley Education center.

“We were so happy to be able to provide the foundation with a check for $1,555.00 to help with programs under the foundation,” said Brown.

The check was presented to Board President, Laura Troshynski as well as other board members present.

Indianapolis (AP) — The only time Nebraska faced Wisconsin in the regular season, top scorer Shavon Shields was sidelined with an injury. And the Badgers shot better than 50 percent from the field in an 11-point victory.

Thursday night in the second round of the Big Ten Tournament, Shields was a major factor and Wisconsin simply couldn’t shoot straight.

Shields scored 20 points and grabbed nine rebounds to lead 11th-seeded Nebraska to a 70-58 victory over No. 6 seed Wisconsin in the Big Ten Conference tournament. Continue reading “Huskers Beat Badgers 70-58 in B1G Tournament”

Myrtle Jeannette Gary

Myrtle Jeannette Gary, age 88, former longtime resident of Kearney, passed away March 9, 2016 at the North Platte Care Center.
Myrtle Jeannette was born on June 21, 1927 in South Dakota to Steener John and Clara Ruth (Hove) Carlson. She grew up on a farm near White Butte, SD, graduating from Lemmon (SD) High School. She worked at a beauty shop and kept house in Lemmon for her two younger brothers while they attended high school. On April 23, 1947 she married Harold D. Gary in Lemmon. This marriage was a partnership for life and to this union five children were born. Their daughter Gail Ruth died in infancy March 4, 1951. Myrtle and Harold moved to Redfield, SD in 1955 where she babysat and then worked at JC Penney and later in an optometrist’s office. An accomplished seamstress, she was always sewing. Her specialties were prom dresses, wedding and attendants’ dresses and at one time, sewed the velvet robes for the RHS Homecoming Royalty. In 1970 she and Harold bought the Pioneer Motel in Kearney which they owned until retirement in 1995. Myrtle was instrumental in helping start a newborn infant stocking cap program at Good Samaritan Hospital. Hundreds of babies wore her crocheted caps. She loved to dance, especially square dance and schottische. Later, she took up bowling. Proud to be Norwegian, she often used the words “ja” and “uffda” and cooked ludefisk for Christmas. She enjoyed University of Nebraska at Kearney sports and attended many volleyball, basketball, softball and baseball games. She and Harold followed their grandchildren’s school programs and sports. In 2010 she and Harold moved to Lincoln. In 2013 Myrtle moved to North Platte to be near family. She had been a resident of NP Care Center since that time.
Myrtle will be missed by her daughters, Myrna Liebig of North Platte, Melanie Gary and LaNae Gary both of Lincoln; brother, Stener (Fran) Carlson of Loveland, CO; two grandsons, Rory Kay of Las Vegas and Taylan Schoen of Lincoln; a granddaughter, Audra (Gordy) West of North Platte; and two great grandsons, Gage West and Kasen West.
She was preceded in death by her infant daughter Gail Ruth; husband Harold in September 2011; son Dallas in September 2012; four sisters and one brother.
A memorial has been established. Online condolences may be shared at www.adamsswanson.com. Cremation was chosen and memorial services will be held at 2:00 p.m. Sunday March 13, 2016 in Kearney at the O’Brien, Straatmann, Redinger Funeral Home Chapel with Marcia Mapes as officiant. Inurnment will be at a later date at Ft. McPherson National Cemetery. Adams and Swanson Funeral Home is in charge of arrangements.

Annual Cody Park Easter Egg Hunt Set for March 26th

easter-eggsNorth Platte, NE — On Saturday, March 26, 2016, NebraskaLand National Bank, the VFW and the Ladies Auxiliary will host the 57th Annual Easter Egg Hunt at Cody Park.

The search for prizes and decorated eggs will begin at 2:00 p.m. Children up to ten years old are invited to join us and celebrate Easter with a one of a kind Easter Egg Hunt.  The park will be divided into six areas with special needs children on the tennis courts.

Prior to the egg hunt on Thursday, March 24, the VFW will be coloring over 12,000 Easter Eggs.  The community is invited to help.

The Post VFW is located at 2100 East 4th Street. The coloring will start at 7:00 pm.

Elderly Woman’s Body Found in Freezer in Rapid City

police-lights-redRAPID CITY, S.D. (AP) – Law enforcement authorities in western South Dakota say the body of an elderly woman has been found in a freezer.

The Pennington County Sheriff’s Office says deputies found the body Thursday morning in a freezer at a Rapid City home. Deputies made the discovery while responding to a call about a possible missing person case related to an ongoing fraud investigation.

The sheriff’s office says authorities are trying to confirm the woman’s identity and the circumstances surrounding her death.

The sheriff’s office and the Rapid City Police Department are investigating the case. They say they believe the body may have been transported from outside the state to Rapid City.

Senator Stalls Bill to Raise Nebraska Game and Parks Funding

senator-ernie-chambersLINCOLN, Neb. (AP) — A push to increase hunting and fishing permit prices to fund the Game and Parks Commission has hit a roadblock in the Nebraska Legislature.

Sen. Ernie Chambers steered Thursday’s debate away from a bill to increase caps on fees the commission can charge and toward his efforts to end mountain lion hunting in the state.

The bill’s sponsor, Sen. John McCollister of Omaha, says increasing user fees would help the commission pay rising operational costs to maintain trails and outdoor recreation sites. The bill has gained support from sporting groups, conservationists and the tourism industry.

Chambers says he will keep fighting the bill because the Natural Resources Committee killed his proposals to end Nebraska’s mountain lion hunting season.

Senators will continue first-round debate Tuesday.

(UPDATED) Authorities ID Body Found in Canal Near Sutherland

After searching Thursday afternoon and evening, the Lincoln County Dive Team failed to locate Ronald Kubiak’s Chrysler in the NPPD canal.

Authorities believe Kubiak’s vehicle went into the canal after tire tracks were observed upstream from where his body was found on Wednesday afternoon.

The Dive Team will search again on Saturday.  Assistance will be sought from the Nebraska Games and Parks Commission on Monday if Saturday’s search is unsuccessful.


 

The Lincoln County Sheriff’s Office has identified the body found yesterday in the Nebraska Public Power District canal, just south of Sutherland.

Deputies responded to the Gerald Gentleman Power Plant yesterday afternoon after it was reported that a body had been found in the canal leading up to the plant.

Deputies were able to remove the body from the canal, and also discovered vehicle tracks leading into the canal upstream from where the body was found.

Chief Deputy Roland Kramer says the body was that of 50-year-old Ronald Kubiak, of Sutherland.

The Lincoln County Dive Team will attempt to extract Kubiak’s vehicle, a 1993 Chrysler Concorde, from the canal later today.

An autopsy will be conducted at the Central Nebraska Cremation and Mortuary Service, in Gibbon.

The investigation is ongoing, according to Kramer.

Inmate Assaults 2 Officers at Nebraska State Penitentiary

ne-state-penLINCOLN, Neb. (AP) — Prison officials say the Nebraska Department of Correctional Services is investigating a second incident of physical violence against staff this week.

The department says an officer was assaulted by an inmate Wednesday evening at the Nebraska State Penitentiary in Lincoln after he ordered the inmate to return to his cell. A second officer helped in subduing the inmate and was also struck.

The first officer struck was taken to a nearby hospital for non-life-threatening injuries and released.

Department Director Scott Frakes says he is “troubled” by the event but commends prison employees for a quick, team-oriented response.

Three prison staffers at the Tecumseh State Correctional Institution were assaulted by inmates Monday.
