ACLU: 15 Counties Aren’t Following Nebraska Abortion Laws

aclu-nebLINCOLN, Neb. (AP) — An American Civil Liberties Union of Nebraska investigation has found that 15 out of 25 counties aren’t following state law for minors seeking an abortion.

Nebraska law requires a minor seeking an abortion to either have parental consent or court permission. It also requires counties to display forms a minor would need to petition the court for permission to have an abortion, to help minors complete the petition and to be able to answer questions about the process.

The ACLU says the counties didn’t have the forms on display and that officials in some of the counties didn’t know what the investigator was asking about.

The counties included Adams, Box Butte, Buffalo, Cherry, Cheyenne, Dodge, Lancaster, Garden, Otoe, Sarpy, Saunders, Scotts Bluff, Seward, Washington and York.

Nebraska Senators to Debate Grand Jury Transparency

LINCOLN, Neb. (AP) — A bill that would make Nebraska grand juries report their proceedings to the public will be debated by the full Legislature.

An eight-member committee unanimously advanced the measure by Sen. Ernie Chambers of Omaha on Tuesday.

Grand juries are called to investigate deaths of a person who is being apprehended or in custody. Currently, if that jury does not produce an indictment, the public receives no explanation. Chambers says that secrecy fuels distrust of law enforcement.

Chambers’ measure would require a grand jury that does not produce an indictment to release transcripts of their deliberations and create a public report with the prosecuting attorney explaining their rationale. Douglas and Lancaster County prosecutors have endorsed the bill.

Nebraska ‘Right to Farm’ Proposal Stalls in Committee

farmlandLINCOLN, Neb. (AP) — A ballot proposal that would have enshrined farming rights in Nebraska’s constitution has stalled in a legislative committee.

The measure failed to muster enough support Tuesday from members of the Agriculture Committee, some of whom raised concerns that the amendment was too broad.

Sen. Jerry Johnson of Wahoo, the committee chairman, says lawmakers need more time to study the issue. Johnson says he doesn’t plan to bring it up again this year.

The proposal would guarantee the right to “engage in farming and ranching practices” and prevent the Legislature from passing new regulations without a compelling state interest.

North Dakota voters approved a similar measure in 2012, followed by Missouri in 2014. Oklahoma voters will also consider a right-to-farm amendment in the November general election.

Nebraska Senator Says Aid-in-Dying Bill Not Yet Dead

senator-ernie-chambersLINCOLN, Neb. (AP) — A bill that would let Nebraska adults suffering from a terminal illness legally end their own lives has stalled in committee, but its sponsor says he’s confident the Legislature will still debate it this year.

The Legislature’s Judiciary Committee voted 4-4 Tuesday on the bill by Sen. Ernie Chambers of Omaha.

Chambers says he will talk to committee members individually to try to secure another voter on the bill.

If committee members hold their positions, Chambers says there are other ways to get the issue debated on the floor, such as amending it to another bill or making a motion to pull it from committee.

Chambers has designated the measure his priority.

2 Arrested in Nebraska Murder-for-Hire Plot

Jail-Bars-and-Cuffs_mediumAn investigation into a murder-for-hire plot has led to the arrest of two men on charges of Conspiracy to Commit Murder.

On Friday, Feb. 26, the Nebraska State Patrol was contacted by the Aurora Police Department reference an Aurora man who had solicited another individual to kill his estranged wife.

The case investigation continued through the weekend and on Monday, Feb. 29, a Nebraska State Patrol undercover investigator made contact with the suspect identified as Robert S. Honken, 37, of Aurora.  During the contact, Honken arranged to pay the undercover investigator to kill his estranged wife. He provided the undercover investigator, with a cash deposit for the murder of his estranged wife, with the remainder of the agreed upon price to be paid after the murder was completed.

After completing the deal, Honken who was under surveillance by NSP investigators and the NSP Aviation Support Division drove away. His vehicle was then stopped by a Nebraska State Patrol trooper and he was taken into custody. Honken was lodged in the Hall County Jail on a charge of Conspiracy to Commit Murder.

A second suspect, Derrick Shirley, 30, of Bradshaw was also taken into custody in conjunction with the investigation.  Shirley had made a previous arrangement with Honken in which he was also paid cash to kill Honken’s estranged wife.

Shirley was lodged in the Hamilton Jail on a charge of Conspiracy to Commit Murder.

‘Christmas at the Cody’s’ Deemed a Success for 2015

xmas-at-the-cody'sThe final tallies for Christmas at the Cody’s 2015 are in, and the event was a success for everyone involved – the Buffalo Bill Ranch State Historical Park, the non-profit organizations that decorated the rooms and provided volunteers, and the community of North Platte.

Checks for a division of the proceeds from the event are being distributed to Lincoln County Historical Museum, North Platte JayCees, Experience Works, Maranatha Bible Camp, Relay For Life, Golden Spike Tower & Visitors Center, Rape & Domestic Violence Prevention, People’s Family Health, Express Softball, MPCC Rodeo Team, Kids Klub, Buffalo Bill Ranch State Historical Park, P.E.O., Wish I May, Lincoln County Tourism Advisory Council, XI Alpha Sigma, and North Platte Opportunity Center.

After expenses were deducted from the proceeds, each room earned the decorating organization $295.70, with several organizations decorating more than one room and some receiving the proceeds of the “People’s Choice Awards” – visitors to the Christmas at the Cody’s event voted with their dollars for their favorite room. People’s Choice First Place goes to the Rape and Domestic Abuse Program; Second Place goes to Mid-Plains Community College Rodeo Booster Committee; and Third Place goes to Maranatha Bible Camp.

Plans are already underway for the 2016 event, with some major changes in the schedule. The 2016 Christmas at the Codys will run on the weekends during the entire month of December. Dates for 2016 are Dec 2 – 4; 9 – 11; 16 – 18; and 22 and 23. It is hoped that the expanded schedule will give more visitors the opportunity to make Christmas at the Cody’s a family holiday tradition and will allow organizers to include more activities in the event.

4th Nebraska Student Pleads No Contest in Alcohol Death Case

LINCOLN, Neb. (AP) — A fourth University of Nebraska-Lincoln fraternity member charged in the alcohol death of another member has pleaded no contest to procuring alcohol to a minor.

According to court records, Vance Heyer entered his plea Monday.

Deputy Lancaster County Attorney Bruce Prenda said that Heyer was 21 and vice president of the FarmHouse Fraternity when he purchased bottles of vodka for an off-campus party on Sept. 4, 2014. Eighteen-year-old Clayton Real was found dead the next morning in his room at the fraternity house. Affidavits in the case say Real died of acute alcohol intoxication.

Twenty-year-old Thomas Trueblood, 23-year-old Ross Reynolds and 23-year-old Cory Foland pleaded no contest to procuring alcohol to a minor in February.

All four men are scheduled to be sentenced April 25.

Midwest Economic Survey Index Rises for 2nd Time in 2 Months

economyOMAHA, Neb. (AP) — Figures from a survey of supply managers in nine Midwest and Plains states have risen for the second month in a row, suggesting more improvement in the regional economy.

A report issued Tuesday says the Mid-American Business Conditions Index climbed to 50.5 in February from 48.3 in January. The survey results are compiled into a collection of indexes ranging from zero to 100. Survey organizers say any score above 50 suggests economic growth. A score below that suggests decline.

Creighton University economist Ernie Goss oversees the survey, and he says a strong U.S. dollar and economic weakness among the nation’s chief trading partners remain a restraint on regional growth.

The survey covers Arkansas, Iowa, Kansas, Minnesota, Missouri, Nebraska, North Dakota, Oklahoma and South Dakota.

Lawsuit Says Lancaster County Ignoring Commissioner Law

gavelLINCOLN, Neb. (AP) — A man has sued Lancaster County, saying the county doesn’t have as many commissioners as required by state law.

Gary Aldridge filed the lawsuit last week, seeking to force the five-member board to add two more commissioners. The county’s chief administrator declined to comment about the lawsuit.

The law requires counties with populations of more than 300,000 to have seven commissioners within a year after reaching that figure. The lawsuit cites U.S. Census Bureau estimates that say the county reached 300,000 in population by December 2014.

In January Sen. Matt Hansen, of Lincoln, introduced a bill that would increase the population threshold to 400,000 and make it effective only after a general census. The next is scheduled for 2020.

Tecumseh Man, 24, Dies in Head-On Collision Near Syracuse

fatal-accidentSYRACUSE, Neb. (AP) — A Tecumseh man has died in a head-on collision on a highway south of Syracuse.

Otoe County Sheriff’s office says 24-year-old Ryan Dela Cruz drove his southbound car over the center line on U.S. Highway 50 and collided with a semitrailer just after 8 a.m. Monday.

Dela Cruz’s sedan was knocked back toward a road intersection, and the semitrailer went into a ditch east of the highway.

Dela Cruz was pronounced dead on the scene. Investigators say he wasn’t wearing a seat belt. The semitrailer driver was wearing a seat belt and had minor injuries.
