Lincoln Settles Lawsuit Filed Over Failed Nightclub Plans

lawsuit-settlementLINCOLN, Neb. (AP) — The city of Lincoln will pay $5,000 to settle a lawsuit filed by a man over his failed plans for a downtown nightclub.

The settlement was reached Monday with Shane Harrington. He’d filed a federal discrimination lawsuit in 2014, alleging in part that former Lincoln police chiefs Tom Casady and Jim Peschong had religious beliefs that led their department to unfairly treat Harrington and the women he worked with. The lawsuit says the police actions influenced a state agency to reject his request for a liquor license.

Harrington told the newspaper that although the $5,000 is far short of the millions he sought, money was not the measure of his victory. In the settlement the city doesn’t admit any fault.

Nebraska Inmates Released without Parole Concern Senators

prisonLINCOLN, Neb. (AP) — A new report says nearly half of all Nebraska prison inmates released in the last months of 2015 left without any parole or other supervision.

Democratic state Sen. Heath Mello and Republican state Sen. Bob Krist called the statistic “unacceptable” and a threat to public safety Tuesday. They said officials with the Nebraska Department of Correctional Services and Nebraska Board of Parole need to further explain why about 47 percent of inmates left prison without parole supervision in the last quarter of 2015.

In response, Jeff Beaty of the Corrections Department and state parole board chairwoman Rosalyn Cotton also said they’re not satisfied with the figure. They said agency and parole changes should decrease the number of inmates who leave prison without supervision.

Omaha Private Detective Imprisoned for Defrauding Client

jailOMAHA, Neb. (AP) — An Omaha private investigator convicted of fraud has been given a year and a day in prison.

Federal prosecutors say 70-year-old Patricia Walker-Halstead was sentenced Friday to two years of supervised release after she leaves prison and was ordered to pay restitution of $500,000.

Walker-Halstead pleaded guilty to one count of wire fraud after prosecutors dropped 10 other counts in exchange for her plea.

Prosecutors say Walker-Halstead lied to a client about developing evidence and conducting background checks. Court records say Walker-Halstead told the unnamed client she asked a Nebraska State Patrol investigator named “Scott” to help investigate the client’s security concerns. She asked her client to give Scott money because of his financial problems and medical bills. Authorities say there was no Scott on the case.

Douglas County Authorities ID 3 Bodies Found in Wrecked Pickup

OMAHA, Neb. (AP) — Authorities have released the names of three people whose bodies were found in a wrecked pickup in a creek in west Omaha.

A police helicopter crew spotted the truck Tuesday afternoon. The three people were reported missing Sunday.

The Douglas County Sheriff’s Office identified the driver as 22-year-old Robert Baker III, of Omaha. His passengers were identified as 21-year-old Patricia Padron and 24-year-old Jonathan Rodriguez, of Grand Island. Autopsies have been scheduled for Wednesday.

The Sheriff’s Office says appears the truck was headed south on 180th Street, crossed over Blondo Street into a cornfield and struck some trees at the edge of the creek. The pickup went across the creek, struck the bank and then rolled down the bank and came to rest at the bottom.

Nebraska Wildlife Area Reopened After Whooping Cranes Flee

whoopingcraneLINCOLN, Neb. (AP) — The Wilkinson Wildlife Management Area in eastern Nebraska has reopened after three whooping cranes left the area.

Officials with the Nebraska Game and Parks Commission say the endangered birds came to the park March 25 and migrated north on Tuesday. The commission temporarily closed off the area to protect the cranes.

The birds’ total wild population of about 300 individuals migrates through Nebraska each fall and spring between wintering sites along the Texas coast and breeding areas in northern Alberta.

They are protected by state and federal endangered species laws. Penalties for killing, possessing or harassing whooping cranes may include fines of up to $50,000, up to a year in jail, or both.

Nebraska Legislature Abandons Medical Marijuana Bill

Medical-Marijuana-leaf

LINCOLN, Neb. (AP) — Marijuana will not become a legal treatment option for Nebraskans suffering from chronic illnesses this year.

Senators fell three votes short of the 33 needed to break a filibuster and force a vote on a medical marijuana bill Tuesday evening.

Opponents say marijuana has not been approved by the Federal Drug Administration and cannot be tested for safety like other drugs.

Attorney General Doug Peterson, Gov. Pete Ricketts and the Department of Health and Human Services also opposed the bill.

Advocates say medical marijuana is already legal in 23 other states and it is in Nebraska’s best interest to regulate it.

Sponsor Sen. Tommy Garrett of Bellevue says he will support a petition process to place the measure on the general election ballot.

LINCOLN, Neb. (AP) — The state’s top election official says early voting appears to be off to a robust start in Nebraska.

Secretary of State John Gale said Monday that officials in 73 counties have mailed more than 24,600 ballots to voters who have requested one. The number far exceeds to the number of ballots mailed out during the first five days of early voting during the primaries in 2014, 2012, 2010 and 2008.

Gale says 87 percent of the ballots mailed out so far have been returned. Those ballots include ones returned by military and overseas voters.

Requests came from nearly 11,400 Republicans, more than 11,200 Democrats, nearly 2,000 registered independents and 62 Libertarians.
