Man accused of assaulting Uber driver faces hate crime count

LINCOLN, Neb. (AP) — A Lincoln man accused of assaulting an Uber driver now faces a felony hate crime charge in the case.

30-year-old James Danahay was charged Monday with third-degree assault committed as a hate crime.

Police say an Uber driver with an Arabic name picked up Danahay just before midnight on Oct. 3. Police say Danahay began asking the driver questions about his family and ethnicity. When the driver declined to answer, police say, Danahay began yelling racial insults and calling the driver an “illegal alien.” Police say Danahay punched the driver when he pulled over and called 911.

If convicted, Danahay faces up to two years in prison. His next court hearing is Dec. 20.

A working phone number for Danahay could not be found Tuesday.

Ricketts still planning tax reforms in tight budget year

taxesLINCOLN, Neb. (AP) — Nebraska Gov. Pete Ricketts says he still plans to advocate for tax reforms in next year’s session despite a nearly $1 billion projected budget shortfall.

The governor said Tuesday that any changes will have to fit within the state budget, which he and lawmakers are required to balance. Ricketts says his focus will remain at least partially on property taxes, a major complaint of farm and ranch landowners.

The Legislative Fiscal Office says Nebraska faces a projected shortfall of $911 million in the upcoming two-year budget. Lawmakers and Ricketts have said they’re likely to draw some of the money needed from the state’s emergency cash-reserve fund.

Ricketts touts program that saved Nebraska residents $15M

Medical-ChartLINCOLN, Neb. (AP) — A federal program that helps the public with Medicare-related questions has saved Nebraska residents more than $15 million over the last year.

Gov. Pete Ricketts announced the number Tuesday to spread awareness about the program to the 280,000 residents who are eligible but have not yet participated.

The Senior Health Insurance Information Program offers one-on-one Medicare counseling, a free telephone hotline, website and public presentations. The program’s 370 volunteer counselors assisted nearly 32,000 Nebraska residents between October 2015 and September 2016.

Program Director Alicia Jones says many of the savings were realized when residents learned about less expensive alternatives for their prescription drug plans. The program also helps residents whose Medicare claims were denied.

Nebraska Insurance Director Bruce Ramge says drug coverage changes every year.

Nebraska toddler found floating in bathtub died, authorities say

police-lights-redPANORA, Iowa (AP) — Authorities say a Nebraska toddler found floating in a bathtub has died in an Iowa hospital.

The Guthrie County Sheriff’s Office says medics were called to a rented condo at Clover Ridge Resort at Lake Panorama on Wednesday. Authorities say the 21-month-old had been placed in the tub with her 4-year-old sibling, who was not harmed.

The Sheriff’s Office says the younger child was flown to Blank Children’s Hospital in Des Moines, where she died on Thanksgiving Day.

She’s been identified as Sawyer Madsen, who lived in Lincoln, Nebraska, with her parents, Elena and Joshua Madsen.

The incident is being investigated. An autopsy was ordered.

Odd pattern brings rare November tornadoes to Iowa, Nebraska

NOAA-NWS6OMAHA, Neb. (AP) — Meteorologists say warmer weather has brought unusual November weather to Iowa and Nebraska: tornadoes.

The National Weather Service says as many as four tornadoes were reported Monday afternoon in central and northeast Iowa, while three were spotted Sunday in south-central Nebraska. The storms caused light damage and no injuries in both states.

Rich Thompson with the Storm Prediction Center said Tuesday that it’s rare for tornadoes to form so far north and west in late fall. He says warmer weather allowed the typical storm track to move north.

National Weather Service statistics show that only seven tornadoes have hit Nebraska in November since 1950. In Iowa, 41 tornadoes were reported in November between 1980 and 2015.

Nebraska Gov. Ricketts defends death penalty proposal

LINCOLN, Neb. (AP) — Nebraska Gov. Pete Ricketts is defending a proposal that would allow the state to obtain lethal injection drugs without disclosing its supplier.

Ricketts said Tuesday that the new protocol would allow greater flexibility for the Department of Correctional Services, which hasn’t executed an inmate since 1997 and has never done so using the current three-drug protocol.

The administrative proposal announced Monday would allow the state corrections director to choose which drugs are used in an execution and withhold the name of the supplier.

Ricketts argues that the changes are already allowed under a 2009 state law which changed the protocol from electrocution to lethal injection. That law allows the identities of “all members of the execution team” to remain confidential.

Death penalty opponents say they plan to fight the proposal.

McDonald’s testing the use of fresh beef in some burgers

mcdonaldsTULSA, Okla. (AP) — McDonald’s is testing the use of fresh, never frozen beef for its Quarter Pounder hamburgers.

The fast food giant says the tests are being carried out in 75 of its restaurants in the Tulsa, Oklahoma-area. It says Quarter Pounders in the restaurants will be made with fresh beef that’s cooked when ordered.

Oak Brook, Illinois-based McDonald’s says it got positive feedback recently from a similar test in the Dallas/Fort Worth-area.

McDonald’s says it has making “significant enhancements” to its food. It says that over last 18 months it has removed high fructose corn syrup from its buns and stopped using margarine in favor of butter.

The company is trying to stage a comeback after losing customers in recent years, with executives conceding they failed to keep up with changing tastes.

Nebraska sledding accident lawsuit settled for $500K

lawsuit-settlementPAPILLION, Neb. (AP) — The mother of a girl injured in a 2014 sledding accident at a Nebraska school will get a $500,000 lump-sum payment as part of a settlement with the school district’s insurance company.

Valarie Potter was 14 when she was injured at what used to be known as La Vista Junior High School. She and a friend slid down a hill together and hit a chain-link fence. A lawsuit filed by Valarie’s mother says Valarie’s legs were fractured and an artery in her left knee was torn.

The lawsuit says Papillion-La Vista Community Schools failed to post a sign or otherwise warn people of the danger, despite knowing that people often struck the fence while sledding.

District spokeswoman Annette Eyman says insurance company officials decided to settle the case.

Weather service confirms 3 south-central Nebraska tornadoes

severe-weatherHASTINGS, Neb. (AP) — The National Weather Service has confirmed three tornadoes reported Sunday in south-central Nebraska.

The service said in a news release Monday that the first touched down a little after 4 p.m. around 2.6 miles southwest of Upland and lifted a minute later. It was rated an EF0 with peak winds of 70 mph.

The second touched down at 4:34 p.m. about 4 miles east of Red Cloud and lifted five minutes later. It was rated EF1 with peak winds of 95 mph. It damaged some farm outbuildings and irrigation systems.

The service says the third twister touched down at 5 p.m. around 6 miles southeast of Lawrence and lifted three minutes later. It was rated an EF0 with peak winds of 75 mph.

No injuries have been reported.

Passenger dies after car crashes on Thanksgiving Day

fatal-accidentSARGENT, Neb. (AP) — Authorities say a passenger has died after the car she was in swerved to avoid a deer on Thanksgiving Day.

The accident occurred a little after 4 p.m. Thursday on U.S. Highway 183, about three miles south of Sargent.

The Nebraska State Patrol says that after driver Virgil Ramsdell swerved, the car ran into a ditch and rolled.

The patrol says Ramsdell and his passenger, 56-year-old Becky Millard, of Sargent, were taken to a Broken Bow hospital. She was declared dead there.
