LINCOLN, Neb. (AP) — A federal judge will let a former Nebraska banker convicted of fraud to spend some winter weeks in Florida while awaiting sentencing.

U.S. Magistrate Cheryl Zwart decided at a hearing Thursday that former TierOne Bank CEO Gil Lundstrom could spend several weeks at his vacation home in Naples, Florida, as he did last year while awaiting trial. He was convicted last week of 12 counts related to the bank’s failure in 2010. He’s free on bond and faces sentencing in Lincoln on Feb. 24.

Prosecutors objected to Lundstrom’s request to leave the state, saying he’s trying to sever ties with the community in which he was convicted and saying he’s a flight risk. Defense attorney Daniel Collins says Lundstrom isn’t severing his Nebraska ties and doesn’t pose a flight risk.
