Omaha Police Seek to Have Brutality Suit Dismissed

omaha-police(AP) — Several Omaha police officers being sued by a man who accuses them of using excessive force in a 2011 arrest have filed a motion to dismiss the lawsuit, claiming they are immune from such suits.

The videotaped arrest of Robert Wagner, of Omaha, outside a hospital emergency room led to accusations of police brutality.

A hospital security camera captured images of several Omaha police officers pinning down Wagner in the parking lot. The video seemed to show one officer kicking him while he was restrained on the ground. Two officers were fired, but both were later reinstated following arbitration.

Wagner filed a federal lawsuit last November against the city and several officers, saying the officers used excessive force and conspired to deprive him of is constitutional rights.
