LINCOLN, Neb. (AP) — A former North Platte man who served more than a decade in prison for accidentally shooting a friend to death when he was 16 is headed back to prison for a drug offense.

According to court records, 30-year-old Tyler Keup was sentenced Tuesday in U.S. District Court in Lincoln to five years in prison. He had pleaded guilty in February to conspiracy to distribute 5 grams or more of methamphetamine.

Keup was released from prison in 2011 after an appeal because he was 16 in 2000 when he shot 18-year-old Maricella Martinez in the head with a pistol while showing her the gun.

The judge ruled in the appeal that Keup couldn’t form the intent to kill, which was necessary for a second-degree murder conviction.
