(AP) — The Nebraska Supreme Court has upheld the convictions and 2-to-3-year prison sentence of a Grand Island man for two separate drunken driving incidents in 2012.

Daniel Matit, also known as Yai Bol, was convicted of fourth offense of driving under the influence, another DUI with refusal to submit to a chemical test and driving while his license was revoked for incidents that occurred in 2012 on March 5 and May 7 in Lincoln.

Matit appealed, saying he only sat in his running car on private property in March. In the other case, Matit argued that police did not have probable cause to approach and question him.

On Friday, the state’s high court dismissed his arguments, saying that starting a vehicle, whether it’s moved or not, constitutes operating a vehicle.
