BEATRICE, Neb. (AP) — Questions have been raised about the public danger posed by a Beatrice man who was convicted of sexually assaulting a child.
The sentencing of 39-year-old Scott Taylor was postponed until the questions are answered. In September Taylor pleaded no contest to sexual assault of a child. Prosecutors had lowered the charge.
Deputy Gage County Attorney Rick Schreiner has filed a petition in support of declaring that Taylor is developmentally disabled and a danger to others. The Nebraska Department of Health and Human Services has filed an objection, saying Taylor is not developmentally disabled as defined in state law.
A hearing is set for Jan. 14 on the department’s objection. A hearing on the disability issue is set for Feb. 26.
