LINCOLN, Neb. (AP) — A Lancaster County grand jury has concluded that a deputy U.S. marshal didn’t break any Nebraska laws in the fatal shooting of a 34-year-old man during at arrest attempt in Lincoln.

County Attorney Joe Kelly reported the jury’s decision but declined last week to disclose the marshal’s name.

Thirty-four-year-old Tyson Hubbard, of Omaha, was shot March 5 as members of the Metro Fugitive Task Force tried to take him into custody as Hubbard sat in a car outside a Lincoln motel. Hubbard was wanted on a warrant for failing to show for a court appearance to face an assault charge.

Lancaster County Sheriff Terry Wagner has said the deputy marshal opened fire after seeing Hubbard reach for a revolver under the car seat.
