South Dakota man gets jail, probation in Nebraska ATV crash

HARTINGTON, Neb. (AP) — A South Dakota man accused of drinking alcohol before the fatal Nebraska crash of an all-terrain vehicle has been sentenced to 180 days in jail and five years of probation.

Cedar County District Court records say 27-year-old Derrik Nelson was sentenced Monday. He’d pleaded no contest to vehicular homicide and false reporting. Prosecutors dropped manslaughter and other charges in exchange.

The records say Nelson was driving the ATV after drinking for several hours before the June 2017 crash near Fordyce that killed his passenger, Jessi Anderson, a South Dakota State University student.

Prosecutors also dropped an accessory charge filed against Nelson’s father, J. Douglas Nelson. Prosecutors say he dismantled the ATV to hide evidence. He’d said he was merely repairing damage he’d noticed.

The two men live in Yankton, South Dakota.

Man ordered to pay back disability money to 2 US agencies

OMAHA, Neb. (AP) — A man convicted in Omaha of embezzling government funds has been ordered to make restitution to two federal agencies.

Federal prosecutors say 62-year-old Michael Basile was sentenced Thursday in U.S. District Court in Omaha to five years of probation and 150 hours of community service. He also was told to pay the Department of Veterans Affairs more than $62,000 and the Railroad Retirement Board more than $108,000.

The prosecutors say Basile did contract work from June 2014 through September 2017 and had his payments made to a family member in order to conceal the income from the VA and the retirement board. He was receiving disability payments from both agencies at the time and was required to report any income.

Woman accused of bilking nearly $98,000 from boyfriend

LINCOLN, Neb. (AP) — A 29-year-old Lincoln woman is accused of bilking nearly $98,000 out of her boyfriend.

Lancaster County Court records say Brandee Curry is charged with felony theft. The records don’t list the name of an attorney who could comment for her.

A police investigator says in court records that Curry met Michael Matthews, of Spencer, in May 2017 on an online dating website. Soon after they started dating he received $355,000 from the sale of some land. She began asking for financial help, which he provided between July 5 and Nov. 20 last year.

The investigator says Curry told Matthews various tales, including that she needed $14,000 for her son’s medical treatment and more money to pay her father’s gambling debt after his sudden death. The investigator determined that Curry lied about her son and that her father hadn’t died.

Nebraska tourism guide mistakenly features Missouri picture

LINCOLN, Neb. (AP) — Nebraska’s newest state travel guide mistakenly features a picture of a Christmas celebration at Union Station in Kansas City, Missouri.

The Omaha World-Herald reports that a production error allowed the picture of the Kansas City station to be used instead of Union Station in Omaha.

A spokeswoman for the Nebraska Tourism Commission Erin Lenz says the two historic train stations look similar, and staff members who proofed the guide didn’t catch the error before 200,000 copies were printed.

The publication cost $94,000 to print and another $84,000 to distribute.

The Durham Museum occupies Omaha’s Union Station. Museum spokeswoman Jessica Brummer says she figures everyone makes mistakes sometimes, and the error probably earned the Durham some free publicity in Kansas City.

Treatment ordered for woman accused of attempted murder

KIMBALL, Neb. (AP) — The scheduling of a trial for a woman accused of trying to kill her mother at a Nebraska Panhandle motel has been postponed while she undergoes psychiatric treatment.

Kimball County District Court records say 37-year-old Shirrin Sharifpour, of Kimball, last week was found incompetent to stand trial. A judge ordered her sent to the state psychiatric hospital in Lincoln for treatment and scheduled a Feb. 5 hearing to check her progress.

Sharifpour is charged with attempted murder, two counts of assault and one of evidence tampering. The woman’s mother told police her daughter shot her in the back of the head and face at the motel on Oct. 3. Police recovered a BB revolver.

Board refuses to reinstate surgeon’s medical license

LINCOLN, Neb. (AP) — A Lincoln trauma surgeon accused of unprofessional conduct with patients has lost his bid to have his medical license reinstated.

The Nebraska Board of Medicine and Surgery voted Friday to deny Reginald Burton’s request, saying it didn’t have “enough evidence to believe he can practice safely.”

In October 2017 he agreed to a 20-month suspension of his license. The settlement he signed backdated the suspension to Jan. 19 2017.

The original petition filed with state regulators listed nearly 20 concerns from Burton’s former co-workers at Bryan Health. Several of the allegations deal with conduct involving young adult male patients and “fuzzy” prescribing practices. Burton denied the allegations.

He applied for reinstatement this past October, saying he had completed his suspension and fulfilled other state requirements.

Car driver dies in Douglas County collision with SUV

OMAHA, Neb. (AP) — Authorities say a car driver died after her car collided with a sport utility vehicle just north of Omaha.

The accident occurred around 7:10 p.m. Sunday. The Douglas County Sheriff’s Office says the eastbound car crossed a center line and collided with the westbound SUV.

The car driver was pronounced dead at the scene. She was identified as 48-year-old Rhonda Harnett. She lived in Omaha.

The sheriff’s office says the SUV driver was taken to Nebraska Medical Center. The driver was identified as 36-year-old Jodi Bierman, of Blair. Two children in the back of Bierman’s vehicle and the lone passenger in Harnett’s car also were hospitalized.

Admitted killer sentenced to 3 life terms plus max 230 years

OMAHA, Neb. (AP) — A Nebraska man convicted of killing his wife has pleaded guilty to killing his parents and a niece and will spend the rest of his life in prison.

Douglas County District Court records say 46-year-old John Dalton Jr. entered the pleas Monday to three counts of first-degree murder and four weapons counts, but he offered no explanation for his actions.

Dalton was sentenced to three life terms plus up to 230 years in prison.

“They’re looking for answers — and they’re asking lots of questions — but sometimes there are none. It’s just pure evil,” chief deputy Douglas County attorney Brenda Beadle said.

Prosecutors say Dalton shot 70-year-old John Dalton Sr., 65-year-old Jean Dalton and 18-year-old Leonna Dalton-Phillip in Omaha last December . Police say his 6-year-old niece was also present, but she hid under a couch and was able to identify John Dalton Jr. as the shooter. He was captured in Jackson, Tennessee.

Dalton pleaded guilty to manslaughter in the 1998 shooting of his wife, Shannon Dalton. He was imprisoned for 11 years, and paroled in 2010.

All three of the couple’s daughters were home during the 1998 shooting. Dalton’s youngest daughter, Alicia Dalton, said Monday that the deaths of her grandparents and cousin were devastating.

“In a matter of seconds,” she said, “everything I had was lost.”

Nebraska village board member to pay $5,000 state fine

LINCOLN, Neb. (AP) — A southeast Nebraska village board member has agreed to pay a $5,000 civil penalty for allegedly using his position for financial gain and failing to disclose his interest in a village contract.

The Nebraska Accountability and Disclosure Commission approved the settlement last week with Jansen village board members Kevin and Diana Belding.

State officials say Kevin Belding steered payments totaling $20,750 in village money to a company he owned, K&B Construction. Officials say the payments were made before the village board formally approved them, and Kevin Belding didn’t properly disclose his interest in the contract for street work.

Officials say his wife and fellow board member Diana Belding didn’t properly disclose her interest when she voted to approve the contract.

The allegations against Diana Belding were dismissed in the settlement.

Jury acquits ex-Omaha officer in death after repeated stuns

OMAHA, Neb. (AP) — A jury has acquitted a former Omaha police officer charged after the death of a mentally ill man who was shocked a dozen times with a stun gun.

Jurors on Monday found 39-year-old Scotty Payne not guilty of second-degree assault and use of a weapon in the June 5, 2017, death of 29-year-old Zachary Bearheels. Jurors deliberated about seven hours after a two-week trial.

Payne was among officers called to an Omaha convenience store that Bearheels had refused to leave. Bearheels had been wandering Omaha streets after being kicked off a bus headed to Oklahoma.

Payne shocked Bearheels 12 times and could be heard on cruiser camera video asking if he wanted another shock.

An autopsy determined Bearheels didn’t die directly from the shocks but from excited delirium.
