South Dakota man charged with murder in wife’s death

crimeSIOUX FALLS, S.D. (AP) — A South Dakota man has been jailed on $1 million cash bond after prosecutors charged him in the death of his wife.

Forty-three-year-old Irving Jumping Eagle appeared in court Wednesday following his arrest in the death of 33-year-old Alicia Jumping Eagle. She was found dead in the couple’s Sioux Falls apartment Monday.

Irving Jumping Eagle is charged with first-degree murder, second-degree murder and four counts of manslaughter. His public defender did not return a phone call for comment.

Police allege Irving Jumping Eagle had blood on himself Monday afternoon while at a gas station about 300 miles away near Streeter, North Dakota. The Argus Leader (http://argusne.ws/2oE5HYP ) reports the car he was driving hit a bridge pillar Tuesday morning in Deuel County, in eastern South Dakota. He was taken to a hospital and then jailed in Sioux Falls.

LYONS, Neb. (AP) — Northeast Nebraska authorities say a man has died six days after he was shot by his brother, who then killed himself.

The Burt County attorney’s office says 53-year-old Charles Hayes died in an Omaha hospital Saturday. He lived in Naha on the Japanese island of Okinawa.

Lyons Police Chief Jim Buck says Hayes was shot four times March 26 by 49-year-old Kevin Hayes at Kevin’s home in Lyons. Buck says officers found Kevin Hayes’ body when they responded to a report about the shooting. Buck says the brothers’ mother was at the home at the time but was not injured.

Buck says the case has been closed as a murder-suicide.

Lyons is a city of about 850 people.

Nebraska governor signs law creating ‘Choose Life’ plates

choose-life-platesLINCOLN, Neb. (AP) — Nebraska Gov. Pete Ricketts has signed a law creating anti-abortion license plates.

Ricketts said Wednesday that manufacturing the “Choose Life” plates is a small step to celebrate Nebraska’s “culture of pro-life.” He says the license plates will join anti-abortion billboards along state highways in displaying Nebraska’s culture.

Opponents of the law argued the state should not put political speech on license plates, but Lt. Gov. Mike Foley says the landmark Roe v. Wade case allows states to express a preference for avoiding abortion. He and Ricketts say the Legislature will deal with other issues as they come up.

The plates will be available next January and cost $5 more than standard license plates. Revenue from them will supplement federal funding for the Temporary Assistance to Needy Families program.

Nebraska governor plans to push for more prison officers

nebraska-corrections-patch-LINCOLN, Neb. (AP) — Nebraska Gov. Pete Ricketts says he does not understand why a legislative committee working on the next two-year budget would cut the number of additional corrections officers he requested in half.

Ricketts said Wednesday he was “greatly disturbed” by the Appropriations Committee’s decision not to fund all 48 new officer positions. He says lawmakers have spent the past year asking him what the corrections department needs and then chose not to create the positions.

The corrections department has struggled to fill open positions and had nearly 150 officer vacancies as of March 31.

Ricketts says he plans to continue advocating for more guards. Creating 48 new positions would cost about $11 million over two years.

The request comes as Nebraska faces a projected $288 million two-year revenue shortfall.

Senators advance pay 2.5 percent raise for Nebraska judges

judgeshipLINCOLN, Neb. (AP) — Nebraska judges will get a 2.5 percent pay raise over a two-year period if a bill advanced by lawmakers becomes law.

Senators gave the measure first-round approval on Wednesday with a 31-0 vote, amid concerns about retaining quality jurists. Members of the Nebraska Supreme Court would see their salaries increase to roughly $176,300 a year by July 1, 2019. Their current salaries are about $171,975.

Members of the Nebraska Court of Appeals, district courts, juvenile courts, workers compensation courts and county courts will also get raises because their salaries are tied to what Nebraska Supreme Court justices make.

Supporters say judges could make far more money as private attorneys, but they want to serve the public.

Two additional votes are required before the proposal goes to Gov. Pete Ricketts.

Nebraska child sex abuse lawsuit bill wins initial approval

LINCOLN, Neb. (AP) — A bill that would lift the statute of limitations for child abuse sex victims to sue perpetrators has won first-round approval in the Nebraska Legislature.

Lawmakers advanced the measure Wednesday with a 29-3 vote.

Sen. Bob Krist of Omaha says ending the statute of limitations is important because child sex abuse victims sometimes repress their memories or feel too ashamed to talk about what they experienced until later in life.

A statute of limitations would remain in place for people who were abused before the bill goes into effect if their claims were previously time-barred. Victims would have to file lawsuits within 35 years after their 18th birthday or three years after the date when the bill goes into effect, whichever is longer.

Paula Roberta Newmyer, age 88 of Kearney, formerly of North Platte, passed away Sunday April 2, 2017 at good Samaritan Hospital in Kearney, as the result of an accident.

Paula was born on February 15, 1929 in Scotia, NE to John C. and Gertrude (Chase) Poppe.  She grew up in Tekamah, NE and graduated from high school in 1946.  Paula was the sweetheart of Tekamah!  She attended Doane College and received a teaching certificate, then taught school for several years.  She also met Dan, her husband of 67 years, while attending Doane.  Paula and Dan raised their children, Susan and David, in North Platte where they lived for 58 years.  Paula’s greatest joy was her 6 grandchildren.  She was their biggest fan and spent many hours following their activities and athletic ventures.  She leaves behind a legacy of devotion and love for her family.

Paula is survived by her husband Dan K. Newmyer; children Susan (Wade) Evans of Kearney and David (Janet) Newmyer of Wilber; grandchildren Katie (Jake) McCarthy, Janie Evans, Jade Evans, Randy (Ashley) Newmyer, Mark (Erika) Newmyer, and Sam Newmyer (Mariah Morgan); great grandchildren Cruz and Ryan Evans, Cameron McCarthy, Oaks and Willa Newmyer, Clara Newmyer, with 2 more on the way; brother-in-law Kent Newmyer of CT; as well as many nieces, nephews and friends.

She was preceded in death by her parents John and Gertrude Poppe; mother and father-in-law Dan and Doris Newmyer Sr.; 1 sister and 3 brothers.

Memorials are suggested to the First Presbyterian Church and online condolences may be shared at www.adamsswanson.com.  Cremation was chosen and inurnment will be 10:00 a.m. Friday April 7, 2017 at Ft. McPherson National Cemetery followed by a memorial service at 11:30 a.m. at the First Presbyterian Church with Pastor Steve Nofel officiating.  Those wishing to do so may sign the register book from 9:00 a.m. until 5:00 p.m. Thursday April 6, 2017 at Adams and Swanson Funeral Home which is in charge of arrangements.

Prosecutor: Gun play led to Omaha shooting death of Iowa man

crime-scene-police-shootOMAHA, Neb. (AP) — A Douglas County prosecutor says gun play seems to have led to the death of a 20-year-old western Iowa man in Omaha, and two men have been arrested.

Police say 20-year-old Scott Evans, of Council Bluffs, Iowa, was found dead early Sunday inside a home in north Omaha home. Officers were called the house for a report of a shooting.

Officials say an 18-year-old Omaha man has been arrested on suspicion of manslaughter and a weapons count, and a 19-year-old Council Bluffs man has been arrested on suspicion of being an accessory.

Douglas County Attorney Don Kleine says Garbez and Gaytan appeared to have been using a gun in a game similar to Russian roulette, and Evans was shot in the head.

I-80 crash in Omaha damages 2 police cars, injures officer

omaha-policeOMAHA, Neb. (AP) — Police say a chain-reaction crash on Interstate 80 in Omaha damaged two police vehicles and seriously injured an officer.

Police say it happened shortly after 9 a.m. Tuesday on the westbound lanes of I-80 near Q Street. A preliminary investigation shows two police cruisers were on the shoulder as part of a traffic stop when a car hit a cargo van, sending the van into both police cruisers.

Police say Officer Brian Vanderheiden was taken to a hospital with serious injuries, but is expected to survive. The driver of the van was also taken to a hospital with injuries not believed to be life-threatening.

The westbound lanes of the interstate were closed for more than an hour.
