Court upholds dismissal of lawsuit in detention case

federal-court-of-appealsOMAHA, Neb. (AP) — A federal appeals court has upheld the dismissal of a lawsuit by a Papillion man who says he was unlawfully detained and wrongly treated as an illegal immigrant by Sarpy County officials.

A three-judge panel of the 8th U.S. Circuit Court of Appeals on Tuesday agreed with a lower federal court that Ramon Mendoza’s constitutional rights were not violated.

Mendoza sued the Sarpy County sheriff, jail staff and a federal immigration agent for being jailed in March 2010 after he was pulled over by a sheriff’s deputy for a traffic infraction.

Mendoza is a naturalized U.S. citizen from Mexico, but was held for days on suspicion of being in the country illegally.

Dale Lee Kramer

Dale Lee Kramer, age 47, of Elk Point, SD, formerly of North Platte and Stapleton, NE, passed away at home on Sunday, February 19, 2017, after a brief battle with cancer.

Dale was born February 9, 1970, to Walter LeRoy and Sandra Lee (Prinz) Kramer in North Platte where he grew up. He graduated from North Platte High School in 1988.

On August 12, 1989, Dale was united in marriage to Carol Marie Masloskie in North Platte. They lived in North Platte until 1998 when they moved to Stapleton. Dale attended college for two years, eventually earning his Journeyman Electrician’s license. He became a truck driver and drove for six years before training to work for the Department of Homeland Security.

Dale enjoyed fishing and riding his Harley Davidson motorcycle. He loved his wife and children dearly.

He is survived by his wife, Carol, of Elk Point; son, Kyle Kramer (fiancée, Beth Grow), of Guthrie Center, IA; daughter, Kelly Kramer, of Elk Point; his mother, Sandra Kramer, of Lewellen, NE; sister, Helen Kramer, of North Platte; and other family.

Dale was preceded in death by his father, Walter, grandparents and aunt.

Funeral Service will 10:30 a.m. on Thursday, February 23, 2017, at Odean Colonial Chapel at C & Sycamore in North Platte with Job Vigil and KDean Snell officiating. Burial with honors will follow in the McCain Cemetery, southeast of Stapleton. On Saturday, February 25, 2017, a Memorial Service will be held at 2 p.m. at the Elk Point United Parish in South Dakota. In lieu of flowers, the family has established a memorial.

The casket will be closed. The memorial book may be signed prior to the service.

NPCC Knights Softball Team Goes 2-6 over Weekend

NPCC Knights LogoNorth Platte – The North Platte Community College Knights softball team just completed a four day eight game road trip, finishing 2-6 on the weekend.

On Thursday, Feb 16, the Knights traveled to play the Trinidad State Junior College Trojans in Trinidad, Colo. The Trojans swept the Knights 14-4 and 15-7.

On Friday, the Knights went to Borger, Texas and lost to Dodge City Community College 2-1. They rebounded and defeated host Frank Phillips College 10-4.

On Saturday, the Knights split a doubleheader with Frank Phillips, winning the first game 8-3, and losing the second game 5-8.

The Knights completed their road trip with a stop in Garden City, Kan., to play the Garden City Community College Broncbusters. The Broncbusters swept the Knights 11-6 and 8-0.

The Knights are 4-8 on the season and will play next at Northeastern Junior College in a double header on Wednesday, Feb 22. The games were originally scheduled for Feb 28. Game times are at 3 pm and 5 pm CST.

Debbora ‘Deb’ Jane Johnson

Debbora ‘Deb’ Jane Johnson, 60, died Feb. 20, 2017. She was formerly of Gothenburg.

A celebration of life will be held Saturday, March 4, 2017, at 2 p.m. CST at the First Baptist Church in Arnold. Inurnment will be at a later date.

Memorials are suggested to the Deb Johnson Memorial Fund in care of the Family, 41370 Hwy 40, Callaway, NE 68825.

Marjorie TroBaugh Mickelson

Marjorie TroBaugh Mickelson, 94, of North Platte, passed away Feb. 17, 2017, at the North Platte Care Center.

Marjorie was born on July 26, 1922, on the family homestead near Norman to Swan A. and Violet (Estergard) Holsten. She attended school in Norman. The family moved to Hastings, where she met and married Sidney TroBaugh on June 10, 1939.

Marjorie worked at the Richmond Shipyards in California as a “Rosie the Riveter” during World War II. Marjorie worked building Liberty ships that her brothers would serve on in the U.S. Navy.

After the war, she moved back to Cambridge to raise their two sons, Richard and Gaylord, along with her stepson, Darrell.

Marjorie worked at Sid’s Repair as a shoe cobbler in Cambridge until moving to Ogallala. She worked as an assembly line laborer for TRW. She was pulled from the assembly line to make electronic parts for the first lunar landing.

To be closer to family, they bought a motel in American Falls, Indiana. In 1982, they moved to North Platte to care for Marjorie’s mother. Marjorie met and married Clarence Mickelson in 1995. He preceded her in death in 2005.

Marjorie was devoted to volunteering with RSVP (Retired Service Volunteer Program) for over 25 years at the North Platte Senior Center. She loved playing dominoes and cards. She was loved by everyone.

Marjorie was preceded in death by her parents and stepfather, Arthur Bramble; two husbands, Sidney TroBaugh and Clarence Mickelson; stepson, Darrell TroBaugh; brother, Roger Holsten; and two grandsons, Zakk Hanson and Jason Brockman.

Marjorie is survived by her sons, Richard (Darlene) TroBaugh, of San Juan Island, Washington, and Gaylord TroBaugh, of North Platte; brother, Stanley (Helen) Holsten, of Grand Island; eight grandchildren; and seven great-grandchildren.

Memorials may be shared at Lockenour-Jones Mortuary. Online condolences may be shared at lockenour.com.

Services will be at 10:30 a.m. on Thursday, Feb. 23, at the Lockenour-Jones Mortuary in Cambridge. Visitation will be from 10 a.m. to 7 p.m. on Wednesday, Feb. 22, at the Lockenour-Jones Mortuary, which is in charge of arrangements.

Mining company’s lawsuit against Union Pacific moves forward

Union-PacificOMAHA, Neb. (AP) — A federal judge has cleared the way for a lead and copper mining company’s lawsuit against Union Pacific over lead pollution to move forward.

This lawsuit related to contamination in Idaho’s Coeur d’Alene Basin is one of several pending between Tucson, Arizona-based Asarco and Omaha, Nebraska-based Union Pacific.

A judge decided last week to reject Union Pacific’s motion for summary judgment in the case. Railroad officials didn’t immediately respond Monday to questions about the Idaho case.

Asarco says it filed the lawsuits to help ensure the $1.8 billion it paid for cleanups is effective.

Asarco lawyer Gregory Evans says the lead rocks Union Pacific used along its rail lines could threaten the cleanups.

Asarco, now owned by Grupo Mexico, ran lead smelters, metal refineries and numerous mines.

Man killed when semi rammed into his car, Fremont police say

fremont-policeFREMONT, Neb. (AP) — Authorities say a 23-year-old car driver has died in a collision with a semitrailer on the west side of Fremont.

The accident occurred around 4:20 a.m. Monday. Police say a westbound car turned north onto U.S. Highway 30 and was struck by the northbound truck.

Police say the car driver was pronounced dead at the scene. His name isn’t being released until his family is notified about his death. The truck driver was identified as 62-year-old Louis Dohmen, of Columbus. He was treated at Fremont Health Medical Center and released.

The collision is being investigated.

Man hospitalized after house fire in northeast Omaha

OMAHA-FIRE-AND-RESCUE-BADGEOMAHA, Neb. (AP) — Authorities say a man was hospitalized after a fire at a house in northeast Omaha.

Firefighters who were sent to the house around 1:30 p.m. Sunday found a small blaze in a bedroom, which they soon extinguished.

The man had already escaped. He was taken to a hospital to be checked for smoke inhalation.

Firefighters suspect the fire was caused by an electrical malfunction.

People boxed in erratically driven pickup, Cass County authorities say

cass county sheriffLOUISVILLE, Neb. (AP) — Authorities say some people and their vehicles boxed in an erratically driven pickup truck and forced it to stop until deputies could arrive in Southeast Nebraska.

The Cass County Sheriff’s Office said in a news release posted Monday that several people called 911 around 8:50 a.m. Saturday after seeing the pickup run through a ditch while exiting Louisville (LOO’-ihs-vihl) State Recreation Area and onto Nebraska Highway 50 while towing a trailer.

More people called 911 to report the southbound pickup and trailer had drifted into the northbound lanes. The Sheriff’s Office reports that some people then somehow boxed in the pickup and trailer and forced it to stop near Manley.

Deputies soon arrived and arrested the pickup driver on suspicion of several crimes, including driving under the influence of drugs.
