NP Man Pleads Not Guilty to Weapons and Assault Charges

A 23-year-old North Platte man accused of firing a rifle and engaging in a 90-minute standoff with police last month, has pleaded not guilty to the charges.

Justin Valentine entered the pleas in Monday in Lincoln County District Court.  Valentine is charged with two counts of making terroristic threats, one count of attempted second degree assault and two weapons counts.

Officers responded to a house to investigate a report of a shooting on January 19.  Two people at the scene reported that Valentine had threatened them and fired a rifle in their direction.  No one was injured in the incident.

According to police, Valentine surrendered peacefully after a 90-minute standoff.

His next hearing is set for April 22.

 

NE Bill Would Prohibit School Bus Drivers from Using Cell Phones While Driving

ne-legislature-13Nebraska lawmakers are set to review a proposal that would prohibit school bus drivers from using cell phones while driving.

The Legislature’s Transportation and Telecommunications Committee will consider the measure during a hearing on Tuesday.

The bill would prohibit school bus drivers from using any type of interactive, wireless communication device whenever the vehicle is in motion.

The prohibition would not apply to a dispatch communication device. The measure was introduced by Sen. Kate Sullivan, of Cedar Rapids.

Scottsbluff Man Found Competent to Stand Trial in Bank Heist

ne-supreme-court-gavelThe 42-year-old Scottsbluff man accused of robbing a bank on the day before Thanksgiving has been found competent to stand trial.

Michael Scott is facing charges in two separate cases. One is the Nov. 21 robbery of a Valley Bank branch in Scottsbluff. The other case involves theft and fraud charges related to more than $8,000 in losses with bank ATM cards.

The judges for both cases held a joint hearing, and both decided Monday that Scott was competent after reviewing a psychiatric evaluation of the defendant.

Scott has pleaded not guilty. He continues to be held in lieu of $750,000 bond.

Proposal Could Allow NE Lawmakers to Authorize Gambling

blackjackA Nebraska lawmaker wants voters to decide whether the Legislature should have the power to authorize casino gambling.

Sen. Paul Schumacher of Columbus pitched a constitutional amendment Monday that would place the question before voters in the November 2014 election.

The proposal itself wouldn’t authorize gambling. Instead, it would give future Legislatures the power to authorize and regulate games of chance.

Lawmakers could use the revenue as they fit, but unused money would be divided three ways. Fifty percent of the revenue would go toward K-12 education, 49 percent would funnel into health care programs, and 1 percent would be sent to a compulsive gambling treatment fund.

Fire Destroys Sale Barn at Gothenburg Livestock

gothenburg-fireA fire broke out at the Gothenburg Livestock sale barn on Monday afternoon.

The Gothenburg Volunteer Fire Department responded to the report of a structure fire at the barn at around 4:30 PM.

According to fire officials, it appears the building will be a total loss.  No injuries have been reported.

A witness told the Post that flames could be seen shooting out of the side of the building as well as the roof.  They also stated that a sale had been held by Gothenburg Livestock earlier this afternoon, but they did not believe anyone was in the building at the time the blaze broke out.

No information was available on the potential cause of the fire.

Malmkar Sentenced to Six to Ten Years in Death of North Platte Man

A North Platte man has been sentenced to six to ten years in the Nebraska State Penitentiary for the 2011 death of Levern Walter.

Michael Malmkar had entered a plea of guilty to charges of Motor Vehicle Homicide and Leaving the Scene of an Injury Accident.

In June of 2011, Levern and Roberta Walter were riding their bicycles when they were struck by a vehicle driven by Malmkar.  Levern Walter died from his injuries and his wife, Roberta, was seriously injured.  Malmkar left the scene of the accident, and investigators later determined that he had been under the influence of alcohol at the time.

Malmkar’s attorney, Robert Lindemeier addressed the court prior to sentencing, stating that Malmkar was a good kid who had admitted fault in the accident.  Lindemeier pointed our that Malmkar came from a good family, had earned his Eagle Scout and had a great deal of life in front of him.  Lindemeier also argued that Malmkar did not deserve the maximum sentence and requested that he be given the minimum sentence under the law.

The Honorable Judge Donald Rowlands took note of Lindemeier’s statements, however, he also made note of the fact that since the crime, Malmkar had been accused of robbing a business in Lincoln and also had been caught in possession of marijuana at the Lincoln County Detention Center recently.

Rowlands then sentenced Malmkar to four to five years in prison for the Motor Vehicle Homicide charge and two to five years for Leaving the Scene of the Accident.  Additionally, Rowlands ordered that the sentences be served consecutively, meaning Malmkar will serve no less that 6 years in the Penitentiary.  He was given credit for 382 days served in the Lincoln County Detention Center and his driver’s license will be revoked for a period of 15 years beginning when he is released from prison.

Malmkar was remanded to the custody of the Lincoln County Sheriff to await transport to Lincoln.

Two North Platte Men Charged with Stealing Car Parts

Two North Platte men are facing criminal charges after North Platte Police say they stole car parts and tried to sell them.

According to a news release from the North Platte Police Department (NPPD), at around 3:30 PM on February 22, an Officer with the NPPD responded to a residence in the 800 block of East 6th on the report of a theft.  The victim told police that an unknown person stole three car axles from his property sometime over the past three days.  The value of the stolen items was approximately $1,300.00.

On January 23, an Officer responded to North Platte Metals after learning that a suspect in the case, Jeffrey Golden, 48 was at the business with the the suspected stolen axles.  The owner of the axles was able to identify them as his.

Upon further investigation, the Officer learned that there was another victim found to have two bumpers and a grill plate stolen at around the same time as the axles.  This incident occurred in the 700 block of East 3rd.  These items were also located in the trailer Golden was using to haul the stolen axles.  The value of the grill and bumpers was estimated to be around $300.

Following the investigation, the Officer determined that there was probable cause to arrest Golden for Felony Theft by Unlawful Taking for the axle theft, as well as Misdemeanor Theft by Unlawful Taking for the second crime.

An accomplice, Julian Daily, 39 was arrested for Aiding Consummation of a Felony and Misdemeanor Theft by Unlawful Taking.

Both men were arrested and jailed at the Lincoln County Detention Center.

Snowstorm Will Likely Miss Most of Nebraska

snowstormA major snowstorm has been tracking south of original predictions and likely will miss most of Nebraska and much of Iowa.

Rick Chermok of the National Weather Service says 2 to 3 inches of snow is expected to start falling in southeast Nebraska on Monday night.

The same storm is expected to enter south-central Iowa early Tuesday morning and leave behind 4-8 inches of snow as it courses northeast.

Wind gusts to 35 mph in some areas could make travel hazardous.
