Kearney man sentenced for selling misbranded drugs

us-attorneyOMAHA, Neb. (AP) — Federal prosecutors say a 46-year-old Kearney man has been sentenced for selling misbranded drugs online.

The prosecutors say U.S. District Judge Laurie Smith Camp sentenced Paul Martin on Monday to 11 months behind bars. He also must serve two years of supervised release after he leaves federal custody.

Court records say Martin pleaded guilty to delivery of misbranded drugs, mail fraud and wire fraud.

Prosecutors say Martin was indicted after Food and Drug Administration investigators learned that he continued selling foreign products with banned ingredients despite being warned that it was illegal to do so.

Man shot by Kearney officer also charged in incident

KEARNEY, Neb. (AP) — A man shot by a Kearney officer who has since been charged with assault also will face trial.

Court records say Jose Klich has pleaded not guilty to misdemeanor charges of obstructing a peace officer and of driving with a suspended license. His trial is set to begin Jan. 9 in Buffalo County Court.

The officer who shot Klich, Derek Payton, has pleaded not guilty to felony assault. The records don’t show that a trial has been scheduled.

Payton is accused of shooting three times on June 5 at Klich, striking him once in the abdomen. An affidavit in support of Payton’s arrest warrant says Payton was not in the path of Klich’s car when he fired as Klich began to drive away from the scene of a traffic stop.

Another prison staffer struck by inmate, department says

prisonLINCOLN, Neb. (AP) — Officials say another staff member has been assaulted at the Nebraska State Penitentiary in Lincoln.

The Nebraska Correctional Services Department says an inmate being moved from one location to another in the prison Tuesday stuck the staff member in the face. The staffer was treated for injuries and released.

The department says it won’t release the names of those involved. The attack will be investigated and findings will be submitted to the Lancaster County attorney for possible prosecution.

Officials have reported several attacks on corrections officers and staff at various Nebraska prisons over several months, including one in August at the Lincoln Correctional Center that officials say was carried about by a dozen inmates and left nine officers injured.

3 vehicle crash kills 1 in Scotts Bluff County

fatal-accidentA three-vehicle crash just east of Minatare in Scotts Bluff County on Tuesday evening claimed one life and sent another person to the hospital.

The crash involving two cars and a pickup occurred just before 5:00 p.m. (MDT), October 18, in a construction zone about 1 ½ miles east of Minatare on Highway 26.

A 2016 Ford Focus, driven by Barbara Fritzler,68, Alliance, was stopped in a construction zone waiting for a pilot car, when her car was struck from behind by a 2006 Ford pickup. The force of the collision knocked Fritzler’s car into a 2004 Buick stopped ahead of her.

Fritzler died at the scene of the crash. The driver of the pickup, Trevor Teichroeb, 29, Mitchell, had to be extricated from his vehicle. He was flown by medical helicopter to Regional West Medical Center in Scottsbluff with serious injuries.

The driver of the Buick, Pamela Taylor, 52, Bridgeport, was not injured. Everyone involved in the crash was wearing a seat belt.

The investigation into the cause of the crash continues. The collision closed a portion of Highway 26 for approximately two hours.

The Nebraska State Patrol was assisted by the Scotts Bluff County Sheriff’s Office, the Nebraska Department of Roads, Minatare Fire and Rescue and Valley Ambulance.

Nebraska agency increases oversight after billing errors

DHHSLINCOLN, Neb. (AP) — A state agency that serves people with developmental disabilities says it has taken new steps to prevent the kind of billing errors that could force Nebraska to repay millions of dollars to the federal government.

Courtney Miller of the Department of Health and Human Services told lawmakers Wednesday that her agency has hired a person to ensure the state’s developmental disabilities division stays in compliance with federal rules. The new position was created last month.

Her comments came under questioning from a legislative committee. The agency acknowledged last year that payment errors made under a previous administration could cost the state as much as $32 million because they didn’t adhere to federal requirements. The department has said it is negotiating with federal officials, and the reimbursement required could be less.

Gale: Nebraska voter registrations exceed early expectations

voteLINCOLN, Neb. (AP) — Nebraska’s top elections official says voter registration totals have exceeded his expectations.

Secretary of State John Gale said Tuesday that nearly 1.2 million residents have registered to vote in Nebraska. Gale says he had hoped to see 1,185,000 registered voters, but the total so far has reached 1,198,546.

Nebraska counties are seeing a lot of early voting. Sarpy County Election Commissioner Wayne Bena says more than 21,000 voters in his county have requested an early ballot, and the upcoming election could break all previous records.

Lancaster County Election Commissioner Dave Shively reported mailing 22,000 ballots from his office by Monday. Nearly 900 people in his county have appeared in person to vote early.

Voter registrations online and by mail will end at the close of business on Friday.

Treasurer seeks guidance in wrongful conviction lawsuit

LINCOLN, Neb. (AP) — The state treasurer has asked for guidance on whether Gage County can borrow money from Nebraska to pay off the $28.1 million judgment owed in a case in which six people were wrongfully convicted in the 1985 rape and murder of a Beatrice woman.

The so-called Beatrice Six sued Gage County for violating their civil rights. Together, they spent a combined 77 years in prison in the rape and killing of Helen Wilson.

A jury awarded the $28.1 million, plus attorneys’ fees, to the six people in July.

State treasurer Don Stenberg recently asked the attorney general whether Nebraska is obligated to make a low-interest loan to the county, which hasn’t taken any steps to the pay the judgment, since the verdict was in federal court.

A spokeswoman says the attorney general will provide an answer on the matter as soon as possible.

Nebraska law enforcement affiliates criticize death penalty

lethal-injectionOMAHA, Neb. (AP) — Death penalty opponents who have worked in Nebraska law enforcement are urging voters to retain the Legislature’s repeal of capital punishment.

The group that spoke against the punishment on Monday includes a former Lincoln police chief, deputy county attorneys ,and retired judges. It also featured a former detective who was involved with a death penalty case.

An Omaha police officer and former Nebraska correctional officer says he’d rather see the money spent on the death penalty go to prison employees.

Several of the death penalty critics point to the case of the so-called Beatrice Six, who were convicted in the 1985 rape and murder of a Beatrice woman but later exonerated.

Nebraskans for the Death Penalty has won support from the Nebraska Sheriff’s Association and the Nebraska County Attorneys Association.
