Same-Sex Couples Sue Nebraska for Marriage Recognition

gaymarriageOMAHA, Neb. (AP) — Seven same-sex couples have filed a lawsuit to have their marriages recognized in Nebraska.

The American Civil Liberties Union of Nebraska announced Monday that the couples have challenged the state’s constitutional ban on marriage in federal court.

ACLU of Nebraska Executive Director Danielle Conrad says it’s time for the state to extend the freedom to marry to all of its citizens.

The plaintiffs include Susan and Sally Waters of Omaha, who have been together for 17 years. Sally Waters was diagnosed with terminal breast cancer last year. She says without formal recognition of their marriage in Nebraska, her spouse won’t receive the same tax and Social Security benefits to take care of the couple’s children.

Top state officials have said they will fight the lawsuit.

NP Man, 19, Accused of Assaulting 15 YO

Martin Sellers
Martin Sellers

A 19-year-old North Platte man is facing charges after he allegedly assaulted a juvenile.

North Platte Police were dispatched to a disturbance in the 2300 block of West 6th Street, at around 1:30 p.m., on November 14.

Upon arrival, a 15-year-old male alleged that Martin Sellers III had confronted him at his residence, then punched him.

After punching the boy, Sellers reportedly got into the passenger side of a blue pickup and chased after the teen, who was running away.

Officers made contact with Sellers at 3:30 a.m. the next day, and placed him under arrest.

He was charged with felony aggravated child abuse.

Sellers was jailed at the Lincoln County Detention Center.

‘Click It or Ticket’ Campaign Urges Motorists to Buckle Up

click-it-or-ticketReduce serious injury and fatality crashes, increase visibility and raise awareness during one of the busiest travel holidays are the goals of the Nebraska State Patrol’s participation in the national “Click It or Ticket” enforcement campaign, November 24-30.

The special enforcement encompasses the Thanksgiving holiday weekend, one of the most heavily traveled time periods on our nation’s highways.

“It’s been a tough year on Nebraska roadways evidenced by the increase in traffic fatalities,” said Colonel David Sankey, Superintendent of the Nebraska State Patrol. “Our Troopers will be visible and available during this very busy travel time as they work to help keep travelers safe. We encourage all motorists to do their part by voluntarily complying with all traffic safety laws. “

As of November 17, there have been 200 people killed on Nebraska roads. That compares with 184 roadway fatalities at this same time in 2013. Of the 200 people killed, 169 died in motor vehicle crashes where occupant restraints were available. Of those 169 fatalities, 117 were not wearing a seat belt.

Thanks in part to an $18,000 grant from the Nebraska Office of Highway Safety (NOHS), troopers and communication specialists will work overtime hours during the “Click It or Ticket” enforcement campaign.

Special enforcements, including a day-long initiative on Wednesday, November 26 in the central and western parts of the state, will concentrate on reducing crash-causing behaviors such as failure to buckle up, speeding, following too closely and impaired or distracted driving.

Travelers wishing to report a reckless driver or anyone needing non-emergency roadside assistance should call the NSP Highway Helpline when safe to do so, at (star) *55 from any cellular phone or 1-800-525-5555 from any landline. Emergencies should be reported to 911.

Nebraska’s 511 Traveler Information System can be utilized to keep up to date with the latest weather and road conditions. Motorists can access 511 online @ www.511.nebraska.gov or by dialing 511 (800-906-9069) from any cellular phone when safe to do so.

Nebraska Traffic Stops Lead to Meth, Marijuana Arrests

state-patrol-logoTroopers with the Nebraska State Patrol seized methamphetamine and marijuana in three separate traffic stops on Interstate 80 over the weekend.

At approximately 10:45 p.m., Friday, Nov. 14, a trooper stopped an eastbound 2008 Chevy Impala for speeding on I-80 just west (mm398) of the Lincoln Airport Exit in Lancaster County. The trooper was given consent to search the vehicle. The search led to the seizure of 23.3 lbs. of methamphetamine. The drugs contained in 18 packages were located in a hidden compartment in the vehicle. The methamphetamine has an estimated street value of one million dollars.

The driver and lone occupant of the vehicle, Omar Alexis Barguez Perez, 35, of Bellflower, Calif., was lodged in the Lancaster County Corrections on a charge of Possession of a Controlled Substance with Intent to Deliver.

Just before 3:30 p.m., Friday, Nov. 14, a trooper stopped an eastbound Nissan Maxima for speeding on I-80 near the Hampton Exit in Hamilton County. An NSP canine indicated the odor of drugs coming from the vehicle. A probable cause search led to the seizure of 27 lbs. of marijuana. The marijuana was located in three duffle bags in the trunk of the car.

The driver of the vehicle, Kristopher Krey, 40, of Round Lake, Ill., and two passengers in the vehicle, Mai Krey (FM), 45, of Round Lake, Ill., and Alexander Henson, 30, of McHenry, Ill, were each lodged in the Hamilton County Jail on charges of Possession of Marijuana with Intent to Deliver.

Around 11:30 a.m., Friday, Nov. 14, a trooper stopped an eastbound 2013 Chevy Impala for speeding on I-80 in Keith County. The trooper was given consent to search the vehicle. The search led to the seizure of 20 lbs. of marijuana. The marijuana was located in two garbage bags in the trunk of the vehicle.

The driver of the car, John A. Certeza, 38, of Fairfield, Calif., and a passenger in the vehicle, Visakhane Nhothsiri (M), 30, of Ceres, Calif., were each lodged in the Keith County Jail on a charge of Possession of Marijuana with Intent to Deliver.

NP Woman Accused of Running Over Husband with Children in Car

A North Platte woman was arrested over the weekend after she allegedly ran over her husband.

At around 9:30 a.m., on November 16, deputies with the Lincoln County Sheriff’s Office received a report that a man had been run over by a car in the 4600 block of Rodeo Road.

Deputies went to Great Plains Health, where they met with the victim, who was being treated for injuries.

The man told deputies that he and his wife, 24-year-old Bobbi Jo Hartman, got into an argument at a local motel.

According to the victim and witnesses, Hartman left the motel with her children in the vehicle.  Witnesses say the victim held onto Hartman’s vehicle as she left the motel, and continued to hang on as the vehicle drove down Highway 30 at speeds estimated at 50 to 60 mph.

Deputies say, at some point, the victim let go of the vehicle and Hartman drove over his torso.

They say Hartman then took the victim to his brother’s residence, who then took the victim to the hospital.

Hartman was located and placed under arrest for 1st degree assault and felony child abuse.

The children were placed in the custody of the Nebraska Department of Health and Human Services.

Authorities say the victim’s injuries were debilitating, but they were not life-threatening.

Hartman is being held at the Lincoln County Detention Center.

The case remains under investigation.

NP Man Calls Police After He Assaults 2-Year-Old

A 22-year-old North Platte man is facing child abuse charges after he allegedly called police to report that he had assaulted a 2-year-old girl.

At around 2:00 p.m., on November 15, officers with the North Platte Police Department responded to a residence in the 200 block of South Oak on a welfare check.

Police say 22-year-old Johnathan Loving contacted them to report that he had hurt a toddler.

Officers met with Loving who said he had become frustrated with the child and, as a result, slapped her in the face.  Authorities say the child had bruising on her face consistent with being hit.

Following an investigation by police and the Nebraska Department of Health and Human Services , officers determined that there was probable cause to arrest Loving and charge him with felony child abuse.

Loving was transported to the Lincoln County Detention Center and jailed.

Information on the child’s whereabouts was not released.

Obscure Nebraska Panel May Hold Sway Over Pipeline

keystone-xl-pipelineLINCOLN, Neb. (AP) — Congress is scrambling to vote on the Keystone XL oil pipeline, but the project could still end up before an obscure commission in Nebraska that regulates telephones, taxi cabs and grain bins.

The Nebraska Supreme Court is expected to rule within weeks on whether the Nebraska Public Service Commission must first review the pipeline before it can cross the state. Nebraska is one of six states the proposed $5.4 billion pipeline would traverse once completed.

Nebraska Gov. Dave Heineman gave the green light in January 2013.

Landowners who challenged the law say a ruling in their favor would force Calgary-based pipeline developer TransCanada to start over in Nebraska. Project supporters say the Nebraska case pertains only to its proposed route, and shouldn’t prevent the federal government from approving a permit.
