Nebraska Tax Receipts Slightly Below Projections in July

ne-department-of-revenueLINCOLN, Neb. (AP) — A new report says tax receipts for Nebraska state government were slightly below projections in July.

The Department of Revenue said Monday that the state’s net tax receipts for the month totaled $241 million. Nebraska was projected to collect $242 million in its certified revenue forecast.

The department report says net revenue from sales-and-use taxes and corporate income taxes came in higher than projected. Those amounts were offset by lower-than-expected net revenue from individual income taxes and miscellaneous taxes.

The state revenue projection was approved by the Nebraska Economic Forecasting Advisory Board in February.

FDA Approves First DNA-Based Test for Colon Cancer

fdaWASHINGTON (AP) — The Food and Drug Administration has approved the first screening test for colon cancer that uses patient DNA to help spot potentially deadly tumors and growths.

The Cologuard test from Exact Sciences detects irregular mutations in a patient’s stool sample that can be an early warning sign of cancer. Patients who test positive for the mutations should undergo a colonoscopy to confirm the results.

Doctors have long used stool tests to look for hidden blood that can be a warning sign of tumors and precancerous polyps.

But company studies of Cologuard showed that it was more accurate at detecting cancerous tumors and worrisome polyps than traditional stool blood tests. The new test was less accurate at correctly ruling out cancer, as it reported more growths when none were actually present.

Cargill Settles EPA Dispute in Iowa, Nebraska

epaEDDYVILLE, Iowa (AP) — Cargill Inc. has agreed to pay more than $187,000 to settle allegations that it violated the Clean Water Act at large oil storage facilities in Iowa and Nebraska.

The U.S. Environmental Protection Agency’s Region 7 says the privately held multinational corporation lacked a response plan at two facilities that outlined procedures for addressing serious oil discharges.

The facilities are located in Blair, Nebraska, and Eddyville, Iowa. Each facility produces and stores more than one million gallons of oil.

The EPA identified the issue during site visits in 2013. The Minnesota-based company submitted response plans in June 2014.

Patrol Probes Death of Adams County Jail Inmate

state-patrol-logoHASTINGS, Neb. (AP) — The Nebraska State Patrol is investigating the death of a 39-year-old inmate at Adams County Jail in Hastings.

The body was found in a cell around 6:30 a.m. Saturday. Sheriff Gregg Magee says the man’s death does not appear to be from natural causes.

Magee identified the man as Matthew Arterburn. Magee says the jail had been waiting on paperwork to send Arterburn to a state prison so he could serve his time there on convictions for child pornography.

Magee didn’t release any other information about Arterburn’s death.

Kearney Residents Cleaning Up After Flooding

Kearney,-NEKEARNEY, Neb. (AP) — Residents of Kearney are cleaning up debris and damage after heavy rain Friday night caused flooding in the eastern Nebraska city.

At least 3.89 inches of rain fell Friday night and flooding streets and some buildings in Kearney.

Buffalo County Emergency Manager Darrin Lewis says most of the rain fell in under an hour. That caused floor drains in many homes in eastern and central Kearney to back up.

One business that was especially hard hit was the Kearney Drive-In Self Storage because floodwater invaded all 378 units. Many people who rent storage units spent the weekend trying to salvage what they could.

NP Man Allegedly Uses Stolen Credit Card to Make Nearly $3K in Purchases

A North Platte man is facing a felony charge after he allegedly used a stolen credit cart to make nearly $3,000 in purchases.

According to Officer Rodney Brown, at around 9:15 p.m., on August 9, officers with the North Platte Police Department responded to a residence in the 1200 block of  South Willow on the report of a theft.

A 50-year-old male alleged that he lost his credit sometime the night before, and someone used it to make $2,900 in purchases from local businesses.

Following further investigation, investigators were able to identify the suspect as 27-year-old Joseph Moody through surveillance video.

After determining that there was probable cause to charge Moody, officers placed him under arrest.

Moody has been charged with unauthorized use of a financial transaction device, a Class III felony.

He was jailed at the Lincoln County Detention Center.

US Gas Prices Down 6 Cents a Gallon

gas-cardCAMARILLO, Calif. (AP) — The average U.S. price of gasoline has dipped 6 cents a gallon in the past two weeks and prices in California have fallen 9 cents in the same time period.

According to the Lundberg Survey released Sunday, the average nationwide for a gallon of regular is now $3.52. The average price for midgrade gasoline is $3.83 and premium is $3.88.

Of cities surveyed in the Lower 48 states, the lowest price, $3.19, was in Jackson, Mississippi.

San Francisco had the highest price at $3.95.

In California, prices for a gallon of regular dropped 9 cents to $3.86.

The lowest price, $3.76, was in Bakersfield.

The survey says the average U.S. price of regular grade gasoline dropped a total of 19 cents over the past seven weeks.

The average price for a gallon of regular in Nebraska is $3.39.

Teen Charged in Murder of Former NP Woman Faces Assault Charge

COLUMBUS, Neb. (AP) — A Nebraska teen convicted of attempted assault could see his sentencing postponed while he faces a second-degree murder charge for the stabbing death of his grandmother.

19-year-old Chase Micklevitz is charged with second-degree murder and use of a deadly weapon to commit a felony in the death of 58-year-old Deanna Micklevitz, formerly of North Platte.

Chase Micklevitz has a Wednesday court hearing scheduled for the murder charge and a Friday sentencing hearing in the assault case.

His public defender, Nathan Sohriakoff, says he will file a motion to postpone the sentencing until both cases are resolved.

Chase Micklevitz pleaded guilty to attempted assault by a confined person in connection with the March 15 incident at the county jail. He was accused of assaulting two corrections officers.

Backers of Nebraska Nurse Practitioner Bill Will Try Again

nurseLINCOLN, Neb. (AP) — A vetoed bill that would have given nurse practitioners in Nebraska more independence will come up for debate again next year in the Legislature.

Sen. Sue Crawford of Bellevue says she plans to again introduce the measure, which Gov. Dave Heineman vetoed last year despite strong support from lawmakers.

The bill would have removed a requirement that nurse practitioners secure a written agreement with a doctor, who would be available for collaboration or referral if a patient doesn’t respond to treatment.

Heineman vetoed the legislation in April, citing concerns for patient safety. Lawmakers had approved the bill on a 43-0 vote, but the session ended before they were able to attempt an override. The governor is leaving office in January due to term limits.
