Neb. Court: Limited Access to Prison Library OK

judgeshipLINCOLN, Neb. (AP) — The Nebraska Supreme Court says a state inmate was not harmed by prison rules that limited his access to the prison law library to one hour a day.

The state high court decision came Friday in the case of inmate Christopher Payne, who appealed last year after a Lancaster County District Court granted summary judgment in favor of the state prison at Tecumseh.

Payne argued that he needed more than one hour a day in the prison law library so that he could prepare for an appeal to his criminal conviction and four lawsuits he had filed against authorities.

The state’s high court agreed with the lower court, saying that Payne’s limited access to the law library had not hindered his ability to repeatedly bring his grievances to court.

Man Makes Plea Deal in Panhandle City Theft Case

gavel-moreBAYARD, Neb. (AP) — The theft case against a former Bayard (behrd) city worker has been dismissed because he’s agreed to testify against his former boss.

29-year-old Joshua Buskirk agreed to give up his nearly $1,300 share of the profits from the April sale of scrap metal taken from the city. Prosecutor Travis Rodak says he can refile the case if Buskirk changes his mind about testifying against 44-year-old Kevin Wurm.

Wurm is charged with theft. Buskirk and 31-year-old Joshua Kinney were charged with aiding a felony. Court documents say streets superintendent Wurm told Buskirk and Kinney to sell the metal and divide the proceeds between the three of them.

Wurm’s attorney didn’t immediately return a call Friday from The Associated Press. Kinney’s attorney declined to comment.

Nebraska Woman Gets Probation for Aiding Suicide

SIDNEY, Neb. (AP) — A western Nebraska woman convicted of helping her husband kill himself has been sentenced to time served and three years of probation.

Fifty-three-year-old Deann Kimble was sentenced on Thursday. She’d pleaded no contest to a felony charge of aiding a suicide. In exchange for her plea, prosecutors dropped a charge of concealing human remains.

Deputies have said Kimble told them she promised 61-year-old Russell Kimble that she would not intervene when he decided it was “his time to die.”

Deann Kimble told investigators that her husband shot himself March 22 inside their rural Sidney home. She said he used her 20-gauge shotgun, a youth model, because he couldn’t properly align his larger shotgun. She says that as he made his final preparations, she went outside and sat in their van.

Body Found in Southwest Neb. Creek ID’d

CAMBRIDGE, Neb. (AP) — Skeletal remains found in a southwest Nebraska creek have been identified as those of a Cambridge man who’d been missing for about 18 months.

Furnas County authorities say the body was that of 41-year-old Tivis Ferrell. His wife reported him missing about 10 days after he left their home. Authorities say Ferrell committed suicide.

Three juveniles discovered the remains on June 1 while floating on inner tubes from the Medicine Creek Dam to Cambridge.

Rain-Packed Storms Cut Drought in Iowa, Nebraska

DROUGHTDES MOINES, Iowa (AP) — Storms last week brought with them some peril in the form of wind and large hail but they also delivered enough rain to significantly relieve drought conditions in Iowa and Nebraska.

The latest U.S. Drought Monitor report released Thursday shows Iowa’s remaining drought is mostly confined to the northwest and southeast corners of the state. About 40 percent of the state has some drought down from nearly 56 percent a week earlier.

In Nebraska, the drought area has been reduced to 63 percent of the state from nearly 70 percent the week before. Extreme drought was removed from central Nebraska.

About 30 percent of the 50 U.S. states and Puerto Rico have moderate drought or worse, compared with 31 percent a week earlier.

Domestic Assault, Fight with Police Leads to Charges for NP Man

A North Platte man is in jail on felony charges after he allegedly assaulted his girlfriend and fought with police.

According to Investigator John Deal, officers responded to a disturbance in the 1100 block of South Tabor at around 10:46 a.m., on Thursday.

Officers met with the residents, 32-year-old Kenneth Cassell and a female.

Officers determined that an argument had taken place and Cassell had pushed the female down, causing her pain.

As officers attempted to place him under arrest, Deal said Cassell grabbed onto a fence in an attempt to gain leverage and pull away.

Deal said as officers took Cassell to the ground, part of the fence broke.

During the melee, one of the officers sustained a cut to his forehead.

Eventually, Cassell was subdued and transported to the Lincoln County Detention Center.

He’s been charged with domestic assault, criminal mischief, resisting arrest and felony assault on an officer.

Strip Club Owner Bemoans Buffalo County Ordinance

adults-onlyKEARNEY, Neb. (AP) — The owner of a central Nebraska strip club says a new Buffalo County ordinance is costing him thousands of dollars a week.

Jonathon Canterbury, the owner of Paradise City in Elm Creek, spoke Tuesday to the Buffalo County Board of Supervisors.

The ordinance approved in February requires adult entertainment venues to be closed between 1 a.m. and 10 a.m.

Canterbury is asking the board to adopt a grandfather clause for existing clubs. He says Paradise City used to be open until 4 a.m., and more than half of his business was generated between 1 a.m. and closing time. He says he previously made $3,000 to $5,000 a week, but is now falling short of $2,000.

The board agreed to schedule a public hearing.
