Driver Beaten After Striking Child in Minnesota

police-lights-redWINONA, Minn. (AP) — Police say a pickup truck driver who accidentally struck a 4-year-old boy who had dashed into the street was beaten by bystanders in southeast Minnesota.

The child and the driver were taken to a hospital in Winona to be treated for their injuries Monday.

Deputy Police Chief Tom Williams told KAGE that when the man got out of his vehicle to check on the child, bystanders started kicking and punching him. Winona Police Chief Paul Bostrack told The Associated Press that two or three people attacked the man.

Police say the 18-year-old driver sustained scrapes and a chipped tooth and was released from the hospital. Authorities don’t know if the boy also has been released but said his injuries don’t appear life-threatening.

Winona is about 110 miles southeast of Minneapolis.

Second Cancers Are on the Rise; 1 in 5 US Cases is a Repeat

When doctors talk about second cancers, they mean a different tissue type or a different site, not a recurrence or spread of the original tumor.

The trend is partly a success story: More people are surviving cancer and living long enough to get it again. Second cancers also can arise from the same gene mutations or risk factors, such as smoking, that spurred the first one. And some cancer treatments such as radiation can raise the risk of a new cancer forming later in life.

Doctors say cancer survivors should have a formal plan for monitoring and screening in the future.

Earliest Breast Cancer More Risky for Some Women, Study Suggests

Medical-ChartCHICAGO (AP) — New research finds that chances of dying from very early breast cancer are small but the disease is riskier for young women and blacks. Those disparities have been seen previously in more advanced cancer.

Death rates 20 years after diagnosis totaled about 3 percent for women whose breast cancer was confined to a milk duct. The death rates were twice as high for those younger than 35 and in blacks — but still lower than those with more common invasive breast cancer.

The findings will likely add to the debate over how to treat these early kinds of tumors.

Researchers analyzed government data on more than 100,000 women diagnosed with DCIS — ductal carcinoma in situ.

The study was published Thursday in the journal JAMA Oncology.

Army Pilot, Military Cop 1st Women to Pass Ranger School

army-rangerFORT BENNING, Ga. (AP) — A pilot of attack helicopters who competed in triathlons and a wilderness enthusiast who became a military police officer because it was the closest she could get to a combat job are the first women to finish the Army’s elite Ranger School.

In a joint statement, their families say 25-year-old First Lt. Shaye Haver of Copperas Cove, Texas, and 26-year-old Capt. Kristen Griest of Orange, Connecticut, are “just like all the soldiers” graduating this week from the grueling two-month Ranger course.

Griest and Haver are “happy, relieved, and ready for some good food and sleep” before they line up Friday at Fort Benning alongside 94 male soldiers who also earned the coveted black-and-gold Ranger tab to adorn their uniforms.

A Look at the Allegations, Charges Against Ex-Subway Pitchman

jared-fogleINDIANAPOLIS (AP) — Longtime Subway pitchman Jared Fogle has agreed to plead guilty to paying for sex with minor girls and receiving child pornography in a case that’s destroyed his career with Subway. Fogle, 37, made an initial appearance in U.S. District Court in Indianapolis on Wednesday, telling a judge he understood the proceedings. Here’s a look at the allegations and plea deal, as well as the specific federal charges that could land Fogle in prison for more than a decade:

ALLEGATIONS ABOUT SEX WITH MINORS

Prosecutors say Fogle used trips to New York on behalf of Subway and his Jared Foundation, which raised awareness about childhood obesity, to seek out child prostitutes for sex. He allegedly had sex on different occasions with two girls, both of whom were 16; some of the trysts with one occurred after she turned 17.

SEEKING OUT OTHER MINORS

Court filings say Fogle offered one minor he had sex with a fee if she could find other underage girls he could pay for sex. Fogle allegedly indicated in a text about the kind of minor he sought that “the younger the girl, the better.” He’s also accused of asking escorts for help finding minors, with documents alleging he would only make such requests after engaging in sex acts with the escorts to ensure that they were not undercover police.

PORNOGRAPHY ALLEGATIONS

Prosecutors say much of the child pornography Fogle received was produced by the former director of his charitable foundation. They say some of the material was footage taken by a camera hidden in a clock radio and was of young children changing clothes or bathing.

THE FORMAL CHARGES

Fogle faces two counts: distribution and receipt of child pornography, which carries a maximum 20-year prison sentence, and travel to engage in illicit sexual conduct with a minor, which carries a 30-year prison term. He’s expected to enter a formal plea at a later hearing.

THE SENTENCE HE FACES

The plea deal says prosecutors won’t seek a sentence of more than 12½ years in prison and that Fogle won’t ask for less than five. Judges often end up sentencing a defendant within agreed-to ranges. But they aren’t obliged to adhere to those recommendations and can use their discretion to go above or below those ranges.

RESTITUTION

The plea agreement released by prosecutors says that Fogle will pay $1.4 million in restitution to 14 minor victims, who will each receive $100,000.

Police: Man Accidentally Shot, Killed by 2-Year-Old Son

police-lights-redHOOVER, Ala. (AP) — A 2-year-old boy apparently shot and killed his father in what police in Alabama are calling a horrible accident.

Hoover police Capt. Gregg Rector says investigators have all but ruled out suicide and other scenarios in the shooting.

Rector says an autopsy is being conducted Wednesday on the 31-year-old man. He was found shot once in the head in an apartment on Tuesday afternoon, and no one else was inside other than the toddler.

Rector says there’s no sign of an intruder or a self-inflicted wound, and police know there was a semiautomatic pistol in the apartment.

Rector says it’s not difficult for a 2-year-old boy to pull a trigger on that kind of weapon, and investigators believe that’s what happened.

The victim’s name hasn’t been released.

Doctor Fined for Mistaken Hysterectomy on Pregnant Woman

Medical-ChartWATERBURY, Conn. (AP) — A Connecticut gynecologist has been fined $5,000 for mistakenly performing a hysterectomy on a patient he didn’t know was pregnant.

The state Medical Examining Board issued the fine against Dr. Jonathan Foster on Tuesday.

Foster performed a laparoscopic hysterectomy, a procedure that removes the uterus, on the woman at Saint Mary’s Hospital in Waterbury in January 2011.

A consent order Foster signed in July says he failed to detect the pregnancy before the operation.

The order says he relied on the patient’s belief that she wasn’t pregnant. While he did perform a pregnancy test, the order says the result couldn’t be determined either way.

Foster didn’t contest the board’s findings and waived his right to a hearing, which means he accepted the terms to keep his license.

13-Year-Old Tulsa Boy Charged in 2-Year-Old Cousin’s Death

Jail-Bars-and-Cuffs_mediumTULSA, Okla. (AP) — A 13-year-old boy has been charged in the death of his 2-year-old cousin in Tulsa.

According to Assistant District Attorney Sarah McAmis, the boy was charged Tuesday with child abuse murder. Court records say the boy was seen carrying his cousin’s body down a street, knocking on neighbors’ doors asking for help early June 26.

The girl was transported to a hospital where she was pronounced dead. Court records say the toddler had several injuries including a liver laceration, a fractured rib and contusions to her head, face and back.

The Associated Press is not naming the boy because it is not yet clear if he will be tried as a juvenile or as an adult.

1 Dead, 3 Injured When Vehicle Hit Child’s Wagon

ambulance-lightsSOUTHAMPTON, N.J. (AP) — One child is dead and three others are in critical condition after their wagon was struck by a vehicle in southern New Jersey.

Police say five siblings were pulling the wagon along Buddtown Road in Southampton when they were hit around 8:30 p.m. Tuesday. Four were injured.

A 3-year-old died and three others remain at Cooper hospital.

Paul O’Neill said he and his wife heard a loud boom and he found two children lying on the side of the street and a girl in the middle of the street.

Police say the driver stopped and it appears the motorist was driving the speed limit at the time of the accident. Police say the road lacks a real shoulder.

No names have been released.

Officials: Military to Open Most Combat Jobs to Women

soldierWASHINGTON (AP) — Two women have passed the Army’s grueling Ranger test, and even tougher and more dangerous jobs could lie ahead. Senior officials tell The Associated Press the military is poised to allow women to serve in most front-line combat jobs, including Navy SEALs and the Army’s Delta Force.

Officials say the Army, Navy and Air Force likely will not seek exceptions that close any jobs to women. Marine Corps leaders, they say, have expressed concerns about women in infantry jobs and yet may seek an exception.

But that would likely meet resistance from senior officials.

Even Special Operations Command is likely to allow women to compete for military commando jobs.

The services must make their recommendations to Defense Secretary Ash Carter this fall.
