Nebraska Man Makes Plea Deal in Dog Death Case

judgeshipGRAND ISLAND, Neb. (AP) — A 26-year-old St. Paul man accused of using a hammer to kill a puppy has made a plea deal that resolves several cases against him.

Online court records say Michael Berst is scheduled to be sentenced on Feb. 5.

Berst pleaded no contest in Hall County District Court to felony mistreatment of animals and tampering with evidence for an April 15 incident.

A court document says Berst told a friend he’d first struck the dog for relieving itself on a floor and later used the hammer to kill the dog, telling the friend he was putting the 6-month-old animal out of its misery.

The other cases against Berst include one for felony burglary, two on forgery allegations and two misdemeanors.

 

Studies: Some Cancer Treatments Can Be Skipped

Medical-ChartSAN ANTONIO (AP) — New research says tens of thousands of women each year might be able to skip at least some of the grueling treatments for breast cancer without greatly harming their odds of survival.

The research is aimed at curbing overtreatment, a big problem in cancer care.

Breast cancer treatments include surgery, radiation, heavy chemo, hormones or some combination.

But those can be expensive and traumatic and can cause lifelong problems such as arm swelling, heart troubles and even new cancers.

One of the new studies suggests that many women 65 and older can skip radiation after surgery for early-stage tumors.

Deer Carcasses Showing Up in Gage County Ditches

Whitetail-Deer-BuckBEATRICE, Neb. (AP) — Deer carcasses have been showing up in Gage County ditches and creeks.

Officials aren’t sure whether poachers are to blame or the carcasses are being dumped by hunters who legally shot the deer but don’t want to properly dispose of them.

Sheriff Millard “Gus” Gustafson says it’s tough to estimate how many cases of illegal animal carcass dumping occur because many go unnoticed or unreported.

Dumping carcasses in ditches is littering, a misdemeanor.

Complaint Dismissed Against Neb. Judge

OMAHA, Neb. (AP) — A state commission that oversees judges will not investigate a district judge who told a 16-year-old state ward who was seeking an abortion that doing so would “kill the child inside you.”

The Nebraska Commission on Judicial Qualifications on Friday rejected the complaint filed earlier this year against Douglas County District Court Judge Peter Bataillon by two abortion rights groups.

The groups, NARAL Pro-Choice America and RH Reality Check, also submitted in October an online petition with nearly 90,000 signatures to the commission urging an investigation into Bataillon, who was once chairman of an Omaha anti-abortion group.

But the commission said it is prohibited from taking any action against a judge without clear and convincing evidence of fraud, corrupt motive or bad faith.

Group Wants Fisher Price iPad Bouncy Seat Recall

ipad-bouncy-seatWASHINGTON (AP) — Ahh, the first year of a baby’s life — the milestones, wonder and joy. They learn to sit up, crawl and some walk. But how about playtime in their bouncy seat with an iPad and some cool apps?

Fisher-Price is selling a baby bouncy seat with an attachment where parents can insert an iPad so baby can watch video content aimed at the youngest children — an idea that is being criticized by the Campaign for a Commercial-Free Childhood.

The Boston-based advocacy group wants Fisher-Price to recall its Newborn-to-Toddler Apptivity Seat for iPads. The group says it’s not healthy for a baby’s development and encourages parents to leave baby alone.

A reporter’s telephone and email messages seeking company comment were left with a spokesperson for Mattel, Fisher-Price’s parent company.

 

Europe: Diet Sweetener Aspartame Is Safe in Cola

aspartameAMSTERDAM (AP) — The European Food Safety Authority has found that the artificial sweetener aspartame is safe for people to consume at the levels currently used in diet soft drinks.

After conducting a major review of evidence, the agency said Tuesday it has ruled out any “potential risk of aspartame causing damage to genes and inducing cancer.”

The finding will be welcome news to Coca Cola Co., which recently launched an advertising campaign to dispel fears about Diet Coke after other studies showed that aspartame might be dangerous, leading to a fall in sales.

Aspartame, the sweetener used in Diet Coke, is also known under the brand name NutraSweet.

The ESFA, the European Union’s food risk assessment agency, is based in Parma, Italy.

Omaha Man Sentenced for Wire Fraud, Weapons Crime

dept.-of-justiceOMAHA, Neb. (AP) — A 37-year-old Omaha man has been sentenced to federal prison for wire fraud and a weapons violation.

Federal prosecutors said Monday that Joshua Roth was given a year and a day in prison. He must serve five years of supervised release after he leaves custody and must pay restitution of more than $21,300.

Prosecutors say Roth came into possession of a bank account number, user name and password of a First National Bank customer. Prosecutors say he used that information to open a PayPal account and transfer money to it from the bank account. Then, prosecutors say, he used the PayPal account to buy items and have them shipped to his house.

Colorado Man Dies After Nebraska Interstate Crash

fatal-accidentUTICA, Neb. (AP) — A 24-year-old Denver man has died after a pickup he was riding in went out of control on icy Interstate 80 in eastern Nebraska.

The Seward County Sheriff’s Office says the accident occurred around 7:30 p.m. Sunday just west of the Utica interchange.

Deputies say an eastbound pickup carrying Anthony Morales and four other people hit a patch of ice and swerved toward another eastbound vehicle, striking it. The pickup then rotated 180 degrees, slid off the roadway and rolled after it ran down into a steep ditch.

The four others in the truck were able to get out on their own. Authorities say Morales was trapped inside and died before he could be freed.

The Sheriff’s Office reported no other injuries.

Omaha Teacher Accused of Sex Assault

ty-warnerOMAHA, Neb. (AP) — A 28-year-old Omaha teacher has been accused of having a sexual relationship with a 14-year-old student.

Online court records say Ty Warner is charged with two counts of sexually assaulting a child and one count of witness tampering.

Warner was put on paid administrative leave on Nov. 25 from his position at Alpha School, an alternative school for students with behavioral or emotional conditions. He’s been teaching at the school for five years.

Douglas County Jail records say Warner remained in custody on Tuesday. Online court records don’t include the name of his attorney.

Lincoln Gunman Leaves Robbery Victim in Freezer

armed robberyLINCOLN, Neb. (AP) — A Lincoln fast-food worker who was bound by a robber and left in a freezer has been found by customers.

Police say the armed man entered the Subway on North 27th Street a little after 9 a.m. Monday and demanded money.

The employee gave him some cash. He then taped her wrists together and put her in the freezer.

Police say customers found her there, cold but uninjured, about an hour later.

No arrests have been reported.
