(AP) — The husband of an Omaha woman who authorities say was among four slain by a man recently released from prison has filed a $7.5 million claim against the state of Nebraska.

The claim filed Monday for Michael Kruger says the death of 33-year-old Andrea Kruger could have been prevented. A claim against a governmental entity is a required Nebraska legal step before a lawsuit can follow.

Twenty-seven-year-old Nikko Jenkins has pleaded not guilty to killing Kruger and three other people within a month of leaving prison on July 30. He had served more than a decade for robbery, assault and weapons convictions.

A spokeswoman for the Nebraska Department of Correctional Services says prison officials could not comment.

(AP) — The last of the quintuplets born July 25 in Omaha has gone home to Sioux City in northwest Iowa.

Rosalyn Garcia left Methodist Women’s Hospital on Monday. She’s been there since she and her siblings were delivered via cesarean section. Her sister Jimena went home Sunday, joining their sisters Marah and Arleth and brother, Christobal.

Their mother and father, Bianca and Jose Garcia, also have two older sons: 9-year-old Jose and 7-year-old Abrahan.

Bianca Garcia was on bed rest for more than 10 weeks before the babies were born at 28 weeks, or about three months premature. A team of 35 doctors and nurses delivered the babies, who weighed a little more than 10 pounds total at birth.

(AP) — Fire, smoke and water have damaged an apartment in a residence hall at a Beatrice college campus.

The fire was reported shortly after 9:30 p.m. Monday at Southeast Community College. No injuries have been reported.

Beatrice Fire Capt. Jeff VanWinkle says most of the damage was caused when a sprinkler system activated.

Investigators say a resident of the apartment had begun heating some cooking oil but then left the apartment to visit another student. VanWinkle says the oil caught fire. Flames spread to cabinets and a vent above the stove.

VanWinkle says some students went to a local motel because of the hall damage, which was estimated at between $25,000 and $30,000.

(AP) — A 69-year-old Nebraska businessman has been given six months in prison for not paying to the government money he’d withheld for federal taxes.

John Clabaugh Jr. was sentenced on Monday and ordered to pay more than $135,000 in restitution.

Federal prosecutors say Clabaugh, of Lincoln, ran an insurance agency out of Crete. Prosecutors say Clabaugh withheld money from his and his employees’ salaries for taxes but stopped paying it to the IRS in 2001.

(AP) — The student who wounded two classmates and killed a teacher and then himself on a Nevada middle school campus was 12 years old.

Authorities say they’re withholding the Sparks Middle School student’s name out of respect for his family. But Washoe County School District Police Chief Mike Mieras released the seventh-grader’s age at a news conference Tuesday.

District police say the boy brought the weapon used in the Monday morning spree from home. They’re still working to determine how he obtained the 9mm semi-automatic Ruger handgun.

Police say the boy’s parents are cooperating with them and could face charges in the case.

Also at the new conference, police lauded the actions of 45-year-old math teacher and former Marine Michael Landsberry. They say he tried to stop the rampage before he was fatally shot in the chest.

(AP) — A 22-year-old woman has died after a crash on a rural road in southeast Nebraska.

The accident was discovered about 3 a.m. Sunday on Fillmore County Road northwest of Fairmont.

The Fillmore County Sheriff’s Office says Kourtney Robbins, of Sutton, was headed south when she lost control of her vehicle after it entered a ditch. She overcorrected and shot across the road into a ditch on the other side. The vehicle ended up lying on the driver’s side. Robbins was partially ejected and was pronounced dead at the scene. She’d been alone in her vehicle.

(AP) — Officials are planning a fish kill at Pioneer Trails Recreation Area near Aurora.

The Upper Big Blue Natural Resources District says it is working with the Nebraska Game and Parks Commission on the project.

The plan is to eliminate carp and bullhead to make way for a restocking yet this year of bass, bluegill and other catfish. The overabundance of bullheads and common carp can harm sport fishing.

Pioneer Trails Recreation Area was built on a tributary of Lincoln Creek in 1986.

(AP) — Authorities say a 48-year-old Omaha man has died following a weekend hunting accident near Macy, in northeast Nebraska.

The state Game and Parks Commission says the man was shot in the buttocks with a rifle on Sunday while hunting with four other people. The incident took place on the Omaha Indian Reservation, where an early deer-hunting season was in progress.

The man was taken to a Winnebago hospital, where he was pronounced dead. An autopsy has been ordered. Authorities did not identify the man.

The Nebraska Game and Parks Commission, the Nebraska State Patrol, Omaha tribal officers and the Thurston County sheriff’s office are investigating.

(AP) — The second trial of a former Beatrice State Developmental Center worker accused of abusing developmentally disabled adults who lived at the center will be moved.

Gage County District Judge Paul Korslund agreed to move the trial to Jefferson County District Court in Fairbury because of concerns about publicity.

Matthew Pangborn was sentenced last year to 15 to 23 years in prison after being convicted in July 2012 of four counts of abusing a vulnerable adult and several other charges. He was accused of beating and choking residents when he worked at the Beatrice State Developmental Center in 2011.

The Nebraska Supreme Court ordered a new trial because jurors at Pangborn’s first trial used a chart that prosecutors created during deliberations.

(AP) — Open arguments have begun in the trial of a man who is accused of killing a Nebraska couple last year.

Matthew Hinrichsen is charged with two counts first-degree murder for the deaths of Victoria Lee and her husband, Alex Vargas. Vargas died from three gunshot wounds, and Lee died of blunt force trauma to her head. Their bodies were found in a trailer in rural Antelope County, where the newlyweds were living.

Prosecutor Sandra Allen told jurors that Hinrichsen shot the couple in December 2012 because he had decided that “if he couldn’t have her, nobody could.”

The trial is expected to last at least a week, with 35 witnesses slated to testify.
