(Update) Victim of Nebraska train-truck accident released

ODESSA, Neb. (AP) – Buffalo County authorities have released the name of a 19-year-old man who was killed when the pickup he was driving was rammed by a train at an Odessa crossing.
The accident occurred about 8:40 p.m. Wednesday when the Kansas-bound coal train struck the pickup.
Buffalo County Attorney Shawn Eatherton on Thursday identified the victim as Jimmy Ray Barnett. Barnett’s hometown has not been verified.
Eatherton says an autopsy has been ordered.
Union Pacific spokesman Mark Davis says no one on the train was injured and there was no derailment of the three locomotives and 123 cars full of coal.
Davis says the crossing had white X markings and stop signs but no gates or flashing lights.

Horse racing deja vu???

LINCOLN, Neb. (AP) – Allowing bettors to wager on horse races that have already happened is needed to save the horse racing industry in Nebraska, a state senator says.
Sen. Scott Lautenbaugh of Omaha says instant racing terminals should be allowed at licensed horseracing tracks as a way to boost revenue for the industry and the state. He says it also could create jobs.
Opponents say adding the machines merely expands gambling and does nothing to help Nebraskans.
The Judiciary Committee on Wednesday heard more than an hour and a half of testimony on Legislative Bill 806, which would allow betting at gambling machines that show races from a library of tens of thousands of old races.
Supporters argue it would not be expanded gambling because the machines would be at horse tracks.

Ex-Neb. police officer convicted of child porn

Tyler Reinpold

SCOTTSBLUFF, Neb. (AP) – A jury has convicted a former Scottsbluff police officer in a child pornography case.
Twenty-seven-year-old Tyler Reinpold, of Scottsbluff, was found guilty of 10 counts of possessing child pornography on Wednesday in Scotts Bluff County District Court. The jury deliberated for about five hours before returning the verdict.
Reinpold faces up to 20 years in prison. Sentencing is March 9.
Defense attorney Sterling Huff claimed the images were part of an investigation Reinpold was conducting. County Attorney Doug Warner said there was no evidence that the images were part of any ongoing investigation.
The Nebraska State Patrol began investigating Reinpold in August 2010. Reinpold was a Scottsbluff police officer for about three years before leaving in January 2011.

NE Legislature targets prairie dogs

LINCOLN, Neb. (AP) – A bill designed to limit the spread of black-tailed prairie dogs in Nebraska has won first-round approval in the Legislature.
Lawmakers voted 30-0 on Wednesday to advance the measure by Ellsworth Sen. LeRoy Louden.
The proposal (LB473) would give counties the power to carry out a management program to help control the animals, which ranchers often view as pests.
The bill is intended to prevent black-tailed prairie dog colonies from expanding from one person’s property to another.
Counties would have the power to notify landowners that a  colony is not being managed, and could require landowners to take action.
Landowners would also have to notify counties that they have moved to address the problem.
The bill requires two more votes before it goes to Gov. Dave Heineman.

NP man shoots self; headed to Federal prison

NORTH PLATTE, Neb. (AP) – A North Platte man who was wounded when his gun went off inside his pants has been sentenced to federal prison.
A news release from the office of U.S. Attorney Deborah Gilg says 24-year-old Shane Reed, of North Platte, was sentenced to 70 months for being a felon in possession of a firearm.
The release says Reed was found lying in a North Platte street on March 22 last year. He told police his leg wound came from a drive-by shooter. Police soon determined that a handgun tucked inside Reed’s pants had gone off.
Reed was convicted in 2008 of felony theft and burglary in Lincoln County.

Is that a gun in your pocket…better get it licensed

LINCOLN, Neb. (AP) – The Nebraska State Patrol is again reminding Nebraskans holding a permit to carry a concealed handgun that, for some of them, it’s time to renew those permits before they expire.
Such permits issued in Nebraska are good for five years. If the permit is renewed before its expiration, the permit holder will not be required to retake a certified training course. The cost for renewing a permit is $50.
Those who allow their permits to expire will be required to retake a certified training course and pay a $100 fee for a new permit.
Since 2007, the State Patrol has issued 16,185 conceal carry permits. Nearly 3,500 were issued within the first year.

Fairer funding formula?

LINCOLN, Neb. (AP) – A bill that seeks to ease a long-standing funding fight between Nebraska’s urban and rural community colleges has advanced for debate in the Legislature.
The Education Committee voted 6-0 Tuesday to advance a bill that would change the state’s funding formula for Nebraska’s six community colleges.
York Sen. Greg Adams said his bill (LB946) would make it easier for each college to predict how much they will receive each year in state aid.
The community colleges agreed to the new formula after months of closed-door talks. But one member of Omaha’s Metropolitan Community College Board argued Tuesday that his school still wasn’t getting its fair share. Board member Dave Newell says the new formula unfairly favors smaller, rural community colleges with fewer students.

Murder case delayed for North Platte man

Roger Diaz

NORTH PLATTE, Neb. (AP) – A North Platte man suspected of killing his wife has had his case continued until at least February.
Thirty-four-year-old Rogelio Diaz is charged with second-degree murder in the death of his 35-year-old wife, Michelle, at their home on June 25.
A Lincoln County District Court judge on Monday continued the case until Feb. 27 for a status hearing.
Police say Diaz killed his wife in their backyard. Police say he told officers that she fell from steps, but he later changed his story.

Herring ‘Houdini’ sentenced for escape

Christopher Herring

NORTH PLATTE, Neb. (AP) – A North Platte man who escaped from a hospital while in custody has been given 18-to-36 months in prison.
Nineteen-year-old Christopher Herring had pleaded no contest to charges of escaping from custody and criminal mischief. In exchange for the plea, prosecutors dropped several other charges. Herring was sentenced on Monday.
Herring was serving jail time for theft when he was taken to Great Plains Regional Medical Center in North Platte for treatment on Oct. 5. He broke out a window, jumped onto the roof and escaped.
He was captured a few hours later.
