Driver injured when pickup struck train, authorities say

railroad crossingDUNCAN, Neb. (AP) — Authorities say a driver has been injured in a collision with a train in eastern Nebraska’s Platte County.

The crash occurred around 7:30 a.m. Wednesday at a rural crossing about a mile east of Duncan. The Platte County Sheriff’s Office says 18-year-old Rebecca Tworek, of rural Columbus, was headed south when her pickup truck rammed into the train. The crossing is not equipped with flashing warning lights or crossing arms.

Tworek was taken to Columbus Community Hospital. She was cited for failure to yield at a train crossing.

Lincoln bridge being renamed in honor of slain soldier

soldierLINCOLN, Neb. (AP) — A bridge in Lincoln is being renamed in honor of a National Guard soldier killed in Afghanistan.

The bridge system spanning the Antelope Valley Parkway near the Bob Devaney Sports Center will be called the Staff Sgt. Patrick Hamburger Veterans Memorial Bridge.

Officials say Hamburger died in August 2011 when his helicopter was shot down. He was a CH-47 flight engineer assigned to the 2nd Battalion, 135th Aviation Regiment (General Support Aviation Battalion) of the Nebraska Army National Guard. He was a graduate of Lincoln Southeast High School.

A dedication ceremony is scheduled for 1 p.m. Friday at the Nebraska National Guard Spirit of 76 building that sits west of the Devaney Sports Center.

Kansas man guilty in shooting death of Lincoln man

SALINA, Kan. (AP) — A 22-year-old Kansas man will be sentenced in June in the killing of a Lincoln, Nebraska, man at a Salina motel.

DiAntre Lemmie was found guilty Wednesday in Saline County of first-degree murder and five other charges in the April 2016 death of 32-year-old Adonis Loudermilk at the Starlite Motel. Lemmie will be sentenced June 19.

Loudermilk’s body was found at the north Salina motel parking lot.

Prosecutors say Loudermilk was shot during a botched robbery committed by Lemmie and a co-defendant, Amber Nicole Craig.

Craig pleaded guilty in February to second-degree murder, aggravated robbery and conspiracy to commit aggravated robbery.

Lincoln smoke shop owners found guilty of drug conspiracy

jury-boxLINCOLN, Neb. (AP) — The former owners of two Lincoln smoke shops have been found guilty by a federal jury in a drug conspiracy case.

Mother and son duo Sharon Elder and Allen Peithman, who owned Dirt Cheap and Island Smokes, were found guilty Tuesday of conspiracy to sell misbranded drugs, commit mail fraud, evade financial reporting and receive illicit profits.

The jury acquitted 70-year-old Elder and 38-year-old Peithman on eight of the 14 counts in the indictment, including distributing controlled substances and money laundering.

The jury’s deliberation on forfeiture of businesses and personal assets began Tuesday afternoon and continues Wednesday.

Elder faces up to 46 years in prison and Peithman faces up to 53. Elder says the two plan to appeal the verdict.

Boy pleads guilty to killing brother after dispute over girl

ne-supreme-court-gavelHARRISBURG, Pa. (AP) — A 16-year-old Pennsylvania boy has pleaded guilty to shooting his 18-year-old brother to death with a shotgun in a dispute that authorities said was over a girl.

Dakota Thornton, of Williamstown, pleaded guilty Wednesday to third-degree murder in the March 2016 slaying of Dominick Thornton.

Authorities said Dakota Thornton, then 15, told investigators the shooting stemmed from his romantic interest in his brother’s girlfriend.

Prosecutors said no plea deal had been reached on a sentence and Thornton’s juvenile criminal record would be a factor.

Defense attorney Wendy Grella said her client’s mental health issues and alleged abuse while in foster care will also be factors. She called the plea “an appropriate resolution for the entire family.”

Thornton was charged as an adult. Sentencing is set for June.

Teen driver charged with vehicular homicide in fatal crash

omaha-policeOMAHA, Neb. (AP) — Police say a 15-year-old driver involved in a crash that killed a teenage passenger in his car has been charged as a juvenile with felony motor vehicle homicide.

Omaha police say that the 15-year-old boy was arrested and booked Tuesday night into Douglas County Youth Center. Investigators say he was driving recklessly before the crash that killed 14-year-old Kevin Ramirez-Cabrera. The Associated Press generally does not name juveniles charged with a crime.

Police say the crash was reported around 2:25 a.m. Saturday, and first responders found that the car had been speeding, lost control and hit a utility pole. Ramirez-Cabrera, who had been in the back seat, was taken to a nearby hospital, where he died. Investigators say he was not wearing a seat belt.

Nebraska day care provider ticketed after girl tests positive for THC

pot-browniesHICKMAN, Neb. (AP) — A southeastern Nebraska child care provider is in hot water after authorities say a child in her care tested positive for the psychoactive drug in marijuana.

The Lancaster County Sheriff’s Office says deputies were called to a Lincoln hospital emergency room for a 2-year-old girl brought in for being lethargic. Doctors discovered the toddler was suffering from exposure to THC.

After questioning from investigators, the child’s 31-year-old in-home day care operator in Hickman said she had baked marijuana brownies and used the same pan to bake cookies for the children in her day care.

The Sheriff’s Office ticketed the woman on suspicion of child abuse. The Nebraska Department of Health and Human Services, which licenses her day care, issued an emergency order Wednesday closing the day care.

Officials have recommended other children at the day care be tested for the drug.

1 person killed, 2 wounded in shooting outside Omaha store

crime-scene-police-shootOMAHA, Neb. (AP) — Authorities say a man was slain and two other people wounded outside a convenience store in northeast Omaha.

The shooting occurred a little after 10 p.m. Tuesday. Police say the man was pronounced dead at the scene outside the B & T store. Another man and a woman were taken to a hospital.

The names of those involved and other details about the incident have not been released. It’s unclear whether the shooting was related to two other shootings reported in the area Tuesday night.

No arrests have been reported.

Woman who stole nearly $37K from employer gets 90 days

gavel-and-scaleMADISON, Neb. (AP) — A woman who stole nearly $37,000 from her Norfolk employer has been sentenced to 90 days in Madison County Jail.

At her hearing Monday in Madison, Tonya Pearson also was sentenced to three years of probation and ordered to pay nearly $1,200 in restitution. The 40-year-old pleaded guilty to unauthorized use of a financial transaction device after making a plea agreement with prosecutors.

Court records say Pearson used an Allied Tour & Travel credit card to make nonbusiness-related purchase.

Douglas County to settle convicted killer’s lawsuit for $40K

OMAHA, Neb. (AP) — Douglas County officials have agreed to pay $40,000 to a convicted killer who said he was injured by a fall while in county custody.

The county Board of Commissioners voted Tuesday to settle the lawsuit filed by Avery Tyler shortly after his sentencing in 2014 to life in prison. He’d been convicted of fatally shooting 24-year-old Delayno Wright in September 2012.

Tyler said in his lawsuit that he was cuffed and shackled in a van when he was taken back to jail after a courthouse hearing. The lawsuit said the chains that bound his feet caught on a latch on the van floor, causing him to fall as he tried to exit the van. The lawsuit said the fall severely injured Tyler.
