West Omaha neighbors oppose plans to build a sports court

omahaOMAHA, Neb. (AP) — Neighbors are fighting plans by a man who tore down a $600,000 house behind his west Omaha home so he could build a backyard sports court.

Tom Eagan Jr. asked re-zoning to allow him to build a concrete sports court on a vacant land he owns at a City of Omaha Planning Board meeting Wednesday.

Two lawyers representing nearby homeowners and neighbors are opposing the request. They argue that Eagan is trying to turn a front yard in their Ronson Heights neighborhood into an unsightly backyard.

Eagan says the lot would be for his children to play on. He says he plans to make the lot appealing with landscaping, including 30-plus pine trees.

Fat finger: Typo caused Amazon’s big cloud-computing outage

amazonNEW YORK (AP) — Amazon says an incorrectly typed command during a routine debugging of its billing system caused the five-hour outage of some Amazon Web Services servers on Tuesday.

In a summary posted online, the Seattle company says a command meant to remove a small number of servers for one of its S3 subsystems was entered incorrectly and a larger set of servers was removed. A full restart was required, which took longer than expected due to how fast Amazon Web Services has grown over the past few years.

Amazon says it is making changes to its system to make sure incorrect commands won’t trigger an outage of its web services in the future.

Amazon is the world’s largest provider of cloud services, which entails hosting companies’ computing functions on remote servers.

Officials find body in wooded area near Interstate 80

body-foundSEWARD, Neb. (AP) — Investigators say they have found a body near Interstate 80 in southeastern Nebraska after searching for a man reported missing by Illinois officials.

Officials announced the find Thursday after searching the area in Seward County on Tuesday. The Seward County Sheriff’s Office says a search by Nebraska State Patrol troopers and deputies turned up human remains in a wooded area near the interstate.

State Patrol investigators are investigating. The name of the man found dead has not been released.

An autopsy has been ordered to determine a cause of death.

Man, woman sentenced in fatal shooting of Lincoln man

LINCOLN, Neb. (AP) — A man and woman have been sentenced in the fatal shooting of a Lincoln man last year.

26-year-old Matthew Pavey was sentenced Tuesday to 75 years to life in prison for shooting and killing 27-year-old James Carr. Pavey’s co-defendant, Tiffany Welch, was also sentenced 15 to 20 years in prison for her role in the crime.

Police say Carr was found dead in an alley Jan. 4, 2016 and that Welch lured Carr to the location, where Pavey shot him.

Welch was charged with attempted robbery and Pavey was charged with second-degree murder. Last month, both pleaded no contest to the crimes.

Pavey apologized in court for what he called “tragic circumstances.”

Lancaster County District Judge Andrew Jacobsen says the evidence presented shows a premeditated robbery.

Sheriff switches sides in endorsement for Omaha mayor

OMAHA, Neb. (AP) — Four years ago, Douglas County Sheriff Tim Dunning endorsed fellow Republican Jean Stothert for mayor of Omaha. This time around, he’s endorsing her Democratic opponent, Heath Mello, citing what he calls Mayor Stothert’s fiery temperament.

Dunning says Stothert’s temper is so bad, he’s blocked her calls, because “she just … yells at you.”

Dunning also said at a news conference Wednesday to endorse Mello that he thinks Stothert has been too aggressive in annexing subdivisions on Omaha’s western edge without providing adequate police services to those new neighborhoods.

Stothert says Dunning’s switch is more about his opposition to a proposed merger of the Douglas County and Omaha Police crime labs — a proposal Stothert had pushed.

Nebraska City teacher charged with debauching boy, 16

handcuffsNEBRASKA CITY, Neb. (AP) — A Nebraska City teacher has been charged with debauching a minor.

Otoe County Attorney David Partsch said Tuesday that 27-year-old Emily Lofing is accused of arranging a meeting to have sex with a 16-year-old boy. Partsch says the boy was old enough to legally consent to sex, so debauchery is the most serious charge that could be filed in the case. Investigators think the incident happened last summer.

Online court records don’t list the name of an attorney who could comment for Lofing. A phone listed for her rings unanswered. She has not responded to an email message.

Administrators say Lofing has resigned her position at Nebraska City Middle School. Her arraignment is scheduled for March 13.

Man accused of 2 Lincoln rapes gets 36-40 years in prison

LINCOLN, Neb. (AP) — A 34-year-old man accused of raping two Lincoln women has been given 36 to 40 years in prison.

Online court records say Jaime Villasenor (HEYE’-may vee-uh-sehn-YOR’) was sentenced Tuesday in Lancaster County District Court. He’d pleaded no contest to two counts of attempted forcible sexual assault. Prosecutors had lowered the original charge in exchange for his pleas.

Court documents say he raped one of the women in November 2006 and raped the other in January 2007. Both women told investigators their attacker held a knife to their throats and threatened to cut them if they struggled.

Authorities say Villasenor returned to Lincoln after serving federal prison time for being in the country illegally. Authorities say a DNA sample taken from him matched DNA evidence found in the Lincoln cases.

Man accused of fleecing mom sent to federal prison

gavel-and-scaleOMAHA, Neb. (AP) — A man accused of defrauding his mother and others out of more than $911,000 has been sent to prison and ordered to pay back the money.

Prosecutors say 61-year-old James Kappler Jr., of Topeka, Kansas, was sentenced Tuesday to 63 months for wire fraud.

Prosecutors say Kappler had told his mother that he had contracted the staph infection MRSA, which is resistant to many antibiotics. He falsely told her he was involved in a drug study that would pay him $5 million eventually, but he needed help paying for medical care in the meantime.

Prosecutors say that when her money ran out, she sought more from her sister and friends. Prosecutor Jan Sharp said Wednesday Nebraska gained jurisdiction over the case because some of the people who helped wired money from Nebraska.

Hastings trials set for couple accused of child abuse

child-abuseHASTINGS, Neb. (AP) — Trials have been set for a Hastings woman and man accused of child abuse.

Online court records show 23-year-old Brittany Hatch pleaded not guilty Monday. Her trial is scheduled to begin May 15. The records also show 32-year-old John Brown pleaded not guilty to two counts of child abuse and one of being a habitual criminal. His trial is scheduled to begin April 24.

Police say they found the baby unresponsive after a call in November. A doctor later found that the baby had methamphetamine in her system. The doctor also found bruises, cuts to the baby’s mouth and burns on her feet.

Authorities say Brown is Hatch’s fiance but not the baby’s biological father.

Man takes plea deal in Foltz family burglary case

GREELEY, Neb. (AP) — A South Dakota man has pleaded guilty to burglarizing the home of the late Sam Foltz’s brother when he was in Lincoln honoring the Nebraska football player.

Online court records say 38-year-old Scott Davis, of Lennox, South Dakota, pleaded guilty to burglary and theft after prosecutors dropped two other charges. He also pleaded guilty to theft from a construction site on the same day. Sentencing is scheduled for April.

Authorities say Davis broke into the home of Jordan Foltz on Sept. 3 as the Foltz family attended a memorial for Sam Foltz at the Huskers’ home opener.

Davis was arrested in York County on Sept. 4 on suspicion of driving drunk, and officers say they found items in his car believed to have been stolen from Jordan Foltz.
