Nearly $260K judgment for wrongly accused woman upheld

ne-supreme-courtLINCOLN, Neb. (AP) — The Nebraska Supreme Court has upheld a nearly $260,000 judgment against the city of Lincoln and a local Crime Stoppers organization for wrongly accusing a woman of theft on TV and online.

The high court in its ruling Friday rejected the city’s arguments that Shayla Funk was not entitled to damages.

Funk sued the Lincoln Police Department after her image from bank surveillance video appeared on the Lincoln-Lancaster County Crime Stoppers website with the claim that she was a “crook” who made ATM withdrawals using a stolen credit card. Police also made the claim on local TV news.

But the bank had given police video of the wrong person — a problem the Supreme Court said could have been avoided if police had simply verified the accuracy of the video.

Man who police say was recruited as killer takes plea deal

AURORA, Neb. (AP) — A Nebraska man accused of being recruited to kill another man’s wife has taken a plea deal.

Court records say 30-year-old Derrick Shirley, of Bradshaw, is scheduled to be sentenced Dec. 1. He pleaded no contest last week to a felony charge of possessing a firearm while committing a felony. Prosecutors lowered the original charge of conspiracy to commit murder.

Investigator say 38-year-old Robert Honken paid Shirley $400 to kill Honken’s wife. They say Shirley did surveillance around the woman’s Hamilton County home but never tried to kill her.

Honken has pleaded not guilty to two counts of conspiracy to commit murder. Authorities say he also tried to hire another person, but that man turned out to be an undercover officer.

Honken’s trial is scheduled to begin Nov. 14.

Driver dies after being pinned between truck, trailer

ambulance-lightsOMAHA, Neb. (AP) — Authorities say a driver has died after being pinned between his truck and a trailer he was hooking to it at a south Omaha meatpacking plant.

Police and medics were called around 3 p.m. Thursday to the facility operated by Greater Omaha. Police spokesman Michael Pecha says the man was found next to a semitrailer. The man was pronounced dead later. His name hasn’t been released.

Greater Omaha spokesman Mark Theisen says the man was a driver for the company’s trucking subsidiary.

The company declined to comment on what caused the accident.

About 400 workers tied to nuclear plant in Blair to be fired

fort-calhoun-dryBLAIR, Neb. (AP) — A new filing with the Nebraska Department of Labor says about 400 Omaha Public Power District employees involved with the Fort Calhoun nuclear plant will lose their jobs by the end of 2019.

District spokeswoman Jodi Baker said the number of affected employees is an estimate. The utility expected to have a more precise figure as it creates a clearer plan for closing the plant.

The filing says the layoffs will occur in “several rounds.” The utility notified the first group of 58 employees on Sept. 1 that it would terminate their positions on Oct. 31, a week after the nuclear plant is scheduled to permanently halt operations.

The Fort Calhoun nuclear plant is 20 miles north of Omaha. It employed about 700 people at its peak.

Offutt Air Force Base selected as finalist for drone mission

offutt-air-force-baseOFFUTT AIR FORCE BASE, Neb. (AP) — Offutt Air Force Base just south of Omaha has been selected as one of five finalists for location of a drone wing mission control unit.

Drones would be controlled from that site, but no aircraft would be assigned to Offutt.

The announcement that Offutt was chosen as one of the five finalists out of nearly 20 bases that applied to host the unmanned aerial vehicle mission follows the Pentagon’s decision in June to allocate $55 million to repair Offutt’s deteriorating runway.

Democratic state Rep. Brad Ashford of Omaha says the future of Offutt and the entire Omaha area will be strong if it’s selected for the new mission.

Gov. Pete Ricketts says the mission could help Offutt thrive for years to come.

Woman sentenced for taking newborn son from Norfolk hospital

MADISON, Neb. (AP) — A woman accused of kidnapping her newborn son from a Norfolk hospital has been imprisoned.

Court records say 34-year-old Lacee Tuttle, of Pierce, was given a year for violating a custody order and 90 days for negligent child abuse. Tuttle pleaded guilty last month after prosecutors dropped a kidnapping count. Authorities say Tuttle tested positive for methamphetamine and marijuana while at the hospital, which is why custody was given to a state agency.

Judge Mark Johnson ruled at Tuttle’s sentencing Thursday that those sentences are to be served at the same time but will be served after her sentence of 180 days for unrelated convictions: theft and intentional child abuse. The records say Tuttle had a little girl with her when she was caught shoplifting from a store.

Hastings woman crossing street dies after pickup hits her

car-pedestrian-accidentHASTINGS, Neb. (AP) — Authorities say a Hastings woman has died in a hospital after being struck while walking across a street.

The accident occurred a little before 3:20 p.m. Wednesday. Hastings police say 72-year-old Joyce Schiffler was in a crosswalk when she was struck by a pickup making a left turn onto the street Schiffler was crossing. The driver told police she didn’t see Schiffler. The driver was cited for not yielding the right of way.

Police say Schiffler was taken to a Hastings hospital before being flown to a Lincoln hospital, where she died.

Police seek man suspected of exposing himself in school lot

omaha-policeOMAHA, Neb. (AP) — Omaha police are looking for a man they believe exposed himself to three Millard North High School students in separate incidents.

Police say that all of the incidents happened Wednesday afternoon. One teen told police she was in the school’s parking lot around 4:30 p.m. when she was approached by a black pickup and the driver asked for help. She says as she approached the truck, the driver exposed himself.

Two other teens reported almost identical encounters in the parking lot with a similarly described man in a black pickup over the next 80 minutes.

The girls all said the man drove off after exposing himself.

Kansas woman killed, husband injured in Nebraska crash

polk-county-sheriffSTROMSBURG, Neb. (AP) — Nebraska authorities say a Kansas woman has been killed in a rollover crash.

Polk County Sheriff Dwaine Ladwig said in a news release that first responders reached the crash site east of Stromsburg around 2:30 p.m. Wednesday.

80-year-old Deloris Marshall, of Kansas City, was pronounced dead at the scene. She’d been thrown from the vehicle. Her husband, Maewethers Marshall, was taken to Osceola for medical treatment.

Ladwig says Maewethers Marshall had been driving. The crash is being investigated.

Hall County Jail turning away other agencies’ inmates

jail-cellGRAND ISLAND, Neb. (AP) — The Hall County Jail is getting so close to full the corrections director is turning away inmates from other agencies.

Corrections Director Todd Bahensky told county supervisors Tuesday that he recently rejected a request to house Sarpy County inmates.

As of Tuesday, the 300-bed jail was holding 274 inmates and detainees. Of those, 71 were state inmates, 34 were federal detainees for Immigration and Customs Enforcement, one was held for the Federal Bureau of Prisons and 13 were for other counties.

Bahensky said it’s not desirable to go to total capacity because officials have to have enough space to place each inmate at the proper level of security. But he also noted that turning away inmates means less outside-the-county revenue for the county.
