Federal jury indicts ex members of Winnebago Tribal Council

Winnebago Indians LogoOMAHA, Neb. (AP) — The U.S. Attorney’s office for Nebraska says nine former members of the Winnebago Tribal Council have been indicted on 11 federal counts related to misappropriation of tribal money.

U.S. Attorney Deborah Gilg says a federal grand jury returned the indictments Wednesday against former council chairman John Blackhawk and former council members Darwin Snyder, Thomas Snowball Jr., Louis Houghton, Lawrence Payer, Travis Mallory, Charles Aldrich, Morgan Earth and Ramona Wolfe. Each is charged with conspiracy, theft, wire fraud and misapplication of funds belonging to an Indian gaming establishment.

Prosecutors say the council conspired to enrich themselves by siphoning $327,500 over two years from the tribe’s WinneVegas Casino in the form of gift certificates and pre-paid debit cards issued and paid for by the casino.

Man appeals ruling that favored Lincoln in free speech suit

federal-court-of-appealsLINCOLN, Neb. (AP) — A Lincoln man arrested and convicted of trespassing for handing out religious leaflets on public land is appealing a ruling last month favoring the city.

Larry Ball filed notice Tuesday that he is appealing U.S. District Judge Laurie Smith Camp’s ruling to the 8th U.S. Circuit Court of Appeals.

Last month, Smith Camp granted the city of Lincoln’s request for summary judgment, ending Ball’s lawsuit.

The 78-year-old Ball sued after being found guilty last year of two misdemeanor trespassing counts and fined $100. Ball has maintained that the area in front of the Pinnacle Bank Arena entrance where he was handing out pamphlets is a public sidewalk and that the city violated his free-speech rights.

But the city says the area is quasi-public because it’s contracted to private tenants.

Authorities to provide details about Kansas officer’s death

KANSAS CITY, Kan. (AP) — Authorities are expected to release further details about the fatal shooting of a Kansas City, Kansas, police captain who was searching for a drive-by shooting suspect.

Police are holding a Wednesday morning news conference in the shooting death of Capt. Robert Melton. A suspect is in custody, but the person’s name hasn’t been released because no charges had been filed by Tuesday night, hours after the shooting.

The 46-year-old Melton was a 17-year veteran of the department.

Police spokesman Tom Tomasic said Melton was searching for a suspect in a drive-by shooting when he drove up to someone matching the description. Tomasic said that before Melton could get out of his vehicle, the person opened fire and hit the officer multiple times.

Slain Kansas City cop was in honor guard at funeral

kansas-city-kansas-policeA Kansas City, Kansas, police captain who was gunned down while looking for a suspect in a drive-by shooting was a member of the department’s honor guard at the funeral for a fellow officer who was fatally shot near Kansas City two months ago.

Police say Capt. Robert Melton was shot in his car Tuesday after driving up to someone who matched the description of a suspect in a drive-by shooting. The suspected shooter is in custody.

Melton’s LinkedIn profile says he served in the Kansas Army National Guard and was deployed to Afghanistan from September 2010 to March 2012.

He also was a member of the honor guard at the funeral for detective Brad Lancaster, who fatally was shot near Kansas Speedway on May 9.

Melton was honored Tuesday night at Kauffman Stadium in Kansas City, Missouri, with a moment of silence before the Royals game against Cleveland.

Ex-school official to stand trial in domestic violence case

GRAND ISLAND, Neb. (AP) — A former Shelton school superintendent will stand trial in Hall County District Court on three charges in a domestic violence case.

45-year-old Brian Redinger waived his right Tuesday to a preliminary hearing. His attorney, Kevin Knake, says Redinger and his wife would like to see the case go to trial as soon as possible.

Redinger is charged with making terroristic threats and two other assault-related charges.

Sheriff’s investigators say that on April 10, Redinger attacked his wife, hitting her head on a car dashboard and later driving at her before she escaped to safety at a Hall County truck stop.

He resigned his position as superintendent of Shelton Public Schools some weeks after his arrest.

Nebraskan charged with crash death of Iowa motorcyclist

OMAHA, Neb. (AP) — A 27-year-old man has been charged with vehicular homicide for the crash death of a motorcyclist in Omaha.

The Douglas County attorney’s office says Nicholas Colabello’s first court hearing is scheduled for Tuesday. Online court records don’t list the name of an attorney who could be contacted to comment for Colabello, who lives in Papillion (puh-PIHL’-yuhn).

Police say the collision happened around 1:30 a.m. Saturday. Investigators say a westbound car driven by Colabello turned left in front of a motorcycle operated by 31-year-old Dustin Roof, of Council Bluffs, Iowa. Police say Roof was taken to an Omaha hospital, where he was pronounced dead.

The county attorney’s office says Colabello’s blood tested out above the legal limit for alcohol.

Fremont man dies after jumping off rope swing into lake

FREMONT, Neb. (AP) — Authorities say a 22-year-old man had died after jumping off a rope swing into a private lake south of Fremont.

The Dodge County Sheriff’s Office says deputies and medics were dispatched around 2:45 a.m. Saturday to Emerson Estates. They found 22-year-old Harrison Harner on the lake bank. They performed CPR, but he was pronounced dead later at Fremont Health Medical Center.

Investigators say friends of Harner reported that he began struggling for air after he jumped off the rope swing into the water. They pulled him to shore.

Autopsy results are expected in a few weeks.

Omaha police: Training, security to ramp up after attacks

omaha-policeOMAHA, Neb. (AP) — Omaha police officials say the department will step up its event security and officer training in the wake of deadly attacks on officers in Dallas and Baton Rouge, Louisiana.

Omaha Police Chief Todd Schmaderer says security will be strengthened for the public’s safety at major events, such as the minute of silence ceremony this Sept. 11.

All Omaha officers will also soon receive additional daylong active-shooter training. The new training will cover some of the tactics that have been used in recent attacks, particularly the sniper in Dallas and the truck attack in Nice, France.

Schmaderer says he commends the Omaha community and his department for working to cultivate a positive relationship that has helped curtail crime and violence.

Boys playing in garage blamed for Lincoln fire

fireLINCOLN, Neb. (AP) — Boys playing in a garage are being blamed for a fire that spread to two houses in Lincoln.

Firefighters were dispatched to the homes just after 5 p.m. Monday. Fire investigator Mike Wright says boys 7, 8 and 11 were playing when one knocked over a gas can, spilling gas onto the floor. One of the boys then struck a piece of flint, igniting the flames.

The fire damage to the garage and two houses was estimated at about $250,000. None of the boys or occupants of the houses was injured.

One firefighter was sent to a hospital to be checked out for exertion during the day’s heat.

Man killed in Knox County crash, authorities say

fatal-accidentVERDIGRE, Neb. (AP) — A 32-year-old man has been killed in northeast Nebraska’s Knox County.

The accident occurred just before 7 a.m. Saturday on a rural road about four miles northeast of Ashfall Fossil Beds. The Nebraska State Patrol says Dana Ziegenbein, of Pierce, lost control of the truck he was driving. It struck a bridge, ran off the roadway and rolled, pinning Ziegenbein beneath it when it came to rest.
