OMAHA, Neb. (AP) — The Nebraska Court of Appeals has affirmed a lower court’s refusal to release a man serving 65 to 100 years in prison for killing a teenager and her unborn baby.

Bobby Joe Moss was convicted in 2005 of second-degree murder in the 2003 shooting death of 17-year-old Michelle Harlan, who was eight months pregnant at the time of her death. He was also found guilty of a weapons count and of manslaughter for the death of Harlan’s fetus.

In his latest petition, Moss argued that his trial attorney was so ineffective that his constitutional rights were violated. On Tuesday, the appeals court rejected Moss’ argument.

OMAHA, Neb. (AP) — Authorities have arrested two men suspected in the fatal shooting of a man in southeast Omaha.

Police say in a news release that 24-year-old Tontavious Montgomery and 21-year-old Alphonso Hall III were arrested Monday. Warrants for their arrests listed charges of first-degree murder and use of a weapon to commit a felony. Online court records don’t list the names of attorneys who could be contacted to speak for either or both of the two men. Montgomery and Hall remained in custody Tuesday.

The two are suspected in the slaying of 22-year-old Terrance Gunn, who was found wounded in a street Sunday night and died later at an Omaha hospital.

LINCOLN, Neb. (AP) — A Nebraska judge has dismissed a charge against a Minnesota man who admitted his intention to buy marijuana in Colorado.

Court records say Judge Susan Strong said in a filing Monday that she had no jurisdiction because Erik Felsheim, of Waseca, Minnesota, committed no crime in Nebraska.

In October 2014, Felsheim and another man were arrested after a traffic stop in Lancaster County. The records say Felsheim told a sheriff’s deputy that $65,000 found in their car was earmarked to buy pot that he intended to sell in Minnesota. Felsheim was charged with possession of money intended for a drug violation and aiding the delivery of a controlled substance.

His attorney argued it is not a violation of Nebraska law to conspire to break the law of another state.

RAPID CITY, S.D. (AP) — Two boys from Nebraska and other bystanders including an Arizona man are credited with rescuing and reviving a 5-year-old girl who nearly drowned in a swimming pool at a Rapid City hotel.

Police say 12-year-old Wisdom Bass-Robinson and 13-year-old Btin Spears of Walthill, Nebraska, noticed the girl face-down in the pool at the Best Western Ramkota shortly after 8 p.m. Monday and pulled her from the water.

Rick Volk, of Phoenix, with the help of other bystanders began CPR at poolside and revived the girl. She was taken to a hospital and is expected to be fine.

Authorities did not identify the girl.

MAHA, Neb. (AP) — Police have identified a man found dead in northeast Omaha as 18-year-old Gustavo Soto.

Police say in a written statement that officers responding to a report of a shooting Monday night found Soto’s body in a vacant lot.

A witness reported hearing one shot. Police say two people were seen running north from the scene.

No arrests have been reported, and Omaha Police say they continue to investigate.

Anyone providing information that leads to the arrest and conviction the shooter is eligible for a $25,000 reward through Crime Stoppers.

PLATTSMOUTH, Neb. (AP) — A Cass County man accused of shackling his teenage nephew to a bed has been sentenced to six months in jail.

36-year-old Wade Merry was sentenced Monday. He had pleaded no contest to negligent child abuse without injury as part of a plea agreement.

Police say the 14-year-old boy was shackled to the bed at least a dozen times. A court document says Merry told authorities he restrained the boy while Merry worked overnight shifts at a bakery because he was frustrated with the boy’s behavior.

Police say Merry gave the boy a cup in case he needed to use the bathroom while shackled, and that Merry left the boy a bolt cutter in the room in case of an emergency.

The teen is in state custody.

A police news release identified the man as 22-year-old Terrance Gunn, of Omaha.

Police say officers responding to a report about a shooting found Gunn around 7:20 p.m. Sunday in a street. Police say the Gunn died later at Nebraska Medical Center.

No arrests have been reported.

PAPILLION, Neb. (AP) — A former treasurer for a volunteer fire association in Nebraska was sentenced to probation for stealing roughly $50,000 from the group.

Forty-five-year-old Michael Stubbs, who is the former treasurer for the La Vista Volunteer Firefighters Association, will serve two years of probation after he pleaded no contest to theft and tax evasion charges. Television station WOWT reports a judge on Monday sentenced Stubbs to two years of probation for each felony charge, but they will be served at the same time.

The association’s president, Joe LaPuzza, contacted La Vista police in January 2015 after noticing changes in the group’s financial books.

Stubbs was also ordered to pay over $8,000 in taxes to the Nebraska Department of Revenue and assigned to have a mental health evaluation.

CENTRAL CITY, Neb. (AP) — A “buffalo soldier” will be getting a headstone in Central City 71 years after his death.

Benjamin Jackson’s grave at Central City Cemetery has been unmarked since his death in 1945. An American Legion post will provide military rites on Memorial Day.

Military records show Jackson was a buffalo soldier who served in the U.S. Army from 1881 to 1886. Buffalo soldier was the name Indians gave to African-Americans in the army.

Merrick County Historical Society President Bill Bolte says that when the society applied for a government-issued headstone, it learned that a relative has to sign the application. The society found great-grandson Jimmie Jackson, who works in Grand Island. He signed the application, and the headstone arrived in February.
