handcuffsOMAHA, Neb. (AP) — The county attorney says a car driver and his passenger will be charged in the crash death of a motorcyclist in Omaha.

The charges stem from an accident Sunday night in which a car went out of control and struck a motorcycle, fatally injuring 18-year-old Fredy Reyes-Garcia, of Omaha.

Douglas County Attorney Don Kleine (kleyen) said in a news release Thursday that 28-year-old Langston Perkins will be charged with vehicular homicide and leaving the scene of a fatal accident. Authorities say Julian Hernandez is safe and unharmed.

Hall County Officials Pass Regulations for Adult Businesses

adults-onlyGRAND ISLAND, Neb. (AP) — Hall County officials have passed new zoning regulations for adult-oriented businesses in the county.

The county board unanimously passed the regulations during a Tuesday morning meeting. The regulations include expanding zoning for strip clubs, cabarets, pornographic book and video stores, and other adult-oriented businesses from 300 acres to nearly 9,000 acres.

The new regulations state such businesses are prohibited from public full nudity and lewd and lascivious acts. The businesses also must close by midnight, and a six-foot buffer must be maintained between club employees and patrons.

The new regulations come amid a pending federal lawsuit against Hall County by a Lincoln businessman who wants to open a strip club. The lawsuit claims county zoning is too restrictive in the space set aside for adult entertainment.

Omaha Police Chief Slams Probation Order for Georgia Woman

omaha-policeOMAHA, Neb. (AP) — Omaha Police Chief Todd Schmaderer says he’s disappointed in a Georgia court’s decision to sentence a woman to probation for illegally buying a gun used to kill an Omaha officer.

On Monday, a judge sentenced Jalita Johnson, of Atlanta, to 180 days of home confinement and a year’s probation.

Federal prosecutors say Johnson said she was buying the handgun, a 50-round drum magazine and ammunition for herself. She later admitted she bought it on behalf of her boyfriend, Marcus Wheeler, a convicted felon.

Police say Wheeler opened fire on officers trying to arrest him on May 20, killing Officer Kerrie Orozco. Wheeler was killed when another officer returned fire.

Schmaderer says straw purchases are linked to gun violence, and “the court missed an opportunity to make a bold statement.”

Twenty-two-year-old Cody Murphree and 23-year-old Jacob Christiansen, both of Norfolk, were sentenced Wednesday morning in Wayne County District Court. They had pleaded guilty to theft after taking plea deals with prosecutors. The two also must make restitution of $13,900 to Elkhorn Valley Bank & Trust in Hoskins.

A third man convicted of the same charges, 24-year-old David Rhodes, of Madison, Alabama, is scheduled to be sentenced on Dec. 2.

The Nebraska State Patrol says the ATM was taken on June 23 from the vestibule of the bank near the bank lobby.

Teen’s Nebraska City Murder Trial Scheduled for March

gavel-and-scaleNEBRASKA CITY, Neb. (AP) — A March trial has been scheduled for a 17-year-old girl who’s accused of fatally driving her pickup over a woman in the Nebraska City library parking lot.

The girl pleaded not guilty on Tuesday in Otoe County District Court to charges of murder, use of a weapon and leaving the scene of an injury accident. Her trial is set to begin on March 9. The Associated Press generally doesn’t name juveniles accused of crimes.

Prosecutors say the girl and 22-year-old Amber Shipley got into an altercation outside the library on Sept. 14 and say the girl drove toward Shipley and ran her over.

The girl’s attorney, Jerry Sena (SEE’-nuh), said Wednesday that he’s planning to file a motion in the next two weeks to move her case to juvenile court.

Omaha Tribe Members Vote to Move Marijuana Measures Forward

marijuana-jointLINCOLN, Neb. (AP) — Votes by Omaha Tribe members are encouraging tribal leaders to continue looking into the marijuana business and allowing recreational use on its northeast Nebraska reservation.

Voters overwhelmingly approved measures Tuesday regarding recreational use, medicinal use and a proposal to grow industrial hemp. The referendum votes merely provide guidance. The Tribal Council will make the final decision.

Indian tribal law expert Lance Morgan has said a Just Department memo issued last year on the subject doesn’t actually let tribes legalize marijuana. Rather, it lets them work with U.S. attorneys, and Morgan says U.S. attorneys in many states have been unwilling to let tribes move forward.

A spokesman for the U.S. attorney in Nebraska didn’t immediately return a call Wednesday from The Associated Press.
